The plat was originally submitted as a Family Subdivision; however, after an extensive review it
appears the property can be divided as a 2 lot division. After discussing the type of subdivision
application with the applicant it has been decided to modify the type of division from a Family
Subdivision to a 2 lot division. The County of Albemarle Division of Current Development will grant or
recommend approval of the Subdivision plat referenced above once the following comments have been
addressed: [Each comment is preceded by the applicable reference, which is to the Subdivision /Zoning
Ordinances unless otherwise specified.]
1. [14- 302(A)(1)] Name of the subdivision. With regard to the above mentioned modification to the
subdivision type, the title of the plat shall be revised to reflect the change.
2. [14- 302(A)(4)] Private easements. Provide the Deed Book reference number for the existing
50'right -of -way easement and the name of the owner of record.
3. [14- 302(A)(4) &(S)] Public /Private easements. Revise Note #1 to omit the portion which reads:
"Easements, if any, not shown." County Code requires all private and public easements be shown.
4. [14- 302(A)(9)] Building sites on proposed lots. On the plat provide the note for buildable area and
slopes so they comply with the ordinance. "Lot_ and the residue of Tax Map / Parcel each
contain a building site that complies with section 4.2.1 of the Albemarle County Zoning Ordinance."
5. [14- 302(A)(10)] Right of further division of proposed lots. On the plat omit note #7 as it does not
relate to this division because there are no development rights associated with lots in this zoning
district.
6. [14- 302(8)(7)] Reservior watershed; agricultural forestal district. A notation as to whether the land is
within an Albemarle County and /or City of Charlottesville water supply watershed or an agricultural
forestal district. Please provide the following notes: "The property is within the North Fork Rivanna
Intake Watershed" and "This property is not in an agricultural forestal district."
7. [14- 302(8)(9)] Floodplain. Note #2 references the property being in flood zone C. On the plat
provide the boundaries for the flood zone.
8. [14- 302(8)(10)] Stream buffers. On the plat depict the required stream buffers (100' on each side of
the stream). Also, provide the following note: "The stream buffers shown heron shall be managed in
accordance with the Albemarle County Water Protection Ordinance."
9. [14- 303(A)] Statement of consent to division. On the plat revise the Owner's Consent statement so it
complies with the ordinance and includes the following segment: "Any reference to future potential
development is to be deemed as theoretical only. All statements affixed to this plat are true and
correct to the best of my knowledge."
10. [14- 303(0)] Signature panels. Remove the signature panels for Board of Supervisors and Planning
Commission, as these are not the agents who sign /approve the plat. Revise the signature panel to
read "Agent for the Board of Supervisors."
11. [14- 302(8)(1)] General Information. When the plat is revised, please provide the date of the last
revision on the plat.
12. [14 -309 & 14 -310] Soil evaluations; Health Director Approval of wells and septic systems. While you
have provided soil work for the proposed lot, it appears that both the Primary and Reserve (P /R)
systems for both lots are depicted on the residue lot. Unfortunately this does not meet County
requirements that each lot have its own P/R septic on the lot it serves. Either the boundary lines will
need to be rearranged to provide each individual lot with a P/R or additional soil work will need to
be completed to locate a P/R drainfield on Lot 1 and on the residue. Also, on the plat please remove
the 15' D/F easement as this is not permissible.
13. [Comment] It is suggested that note #4 be removed as this note does not have any bearing on this
type of division.
