The Albemarle County Planning Division has received and distributed revision #3 last revised
and submitted on May 4, 2012. The Planner will approve the major site plan amendment
referenced above, once the following comments have been addressed. [Each comment is
preceded by the applicable reference to the Albemarle County Code, unless otherwise specified.]
Satisfied comments have been removed for clarity.
1. [32.5.6a.] Revisions. Please add a date and description of last revision for
tracking purposes.
24. [General] Please remove the reference to approval of the waivers by the
Planning Commission on 02/14/12. If desired, indicate that the
waivers were approved administratively on the dates that the action
letters were provided. Due to the Sinclair vs. County of Albemarle
VA Supreme Court case, the Planning Commission no longer has
jurisdiction over waiver reviews. However, since the action letters
pre -date this case, they are still valid.
Revision #3: Please remove the 02/14/12 date, as the Planning
Commission did not act on the waiver requests. Administrative
approval was granted prior to the Sinclair case. If desired,
reference the dates of administrative approval, 12/29/11 for both
waivers.
25. [4.17] Since lighting changes are proposed, the following comments
apply:
If the lumen level is 3000 or more, the lamp needs to be
full cutoff
Revision #3: The lamps proposed are similar to traditional style
coach lamps. These types of lights have been found to NOT meet
the full -cutoff requirement. Select a different style of lights that are
completely full- cutoff and revise the following:
Manufacturer's cut sheets
Point -by -point calculation grid (revision #3 meets this
requirement; please update for revised lighting)
Spillover cannot exceed 0.5 footcandles at the property
lines or edge of ROW /easement, whichever is closer
(revision #3 meets this requirement; please verify that
this requirement is still being met with revision #4)
Maintenance factor /light loss factor = 1.0 (revision 43
meets this requirement; please verify that this
requirement is still being met with revision #4)
Tilt must be 0 (lighting proposed in revision #3 had no
tilt; ensure the same for revision #4)
Also, Zoning has ultimately determined that no shared parking agreement is required.
