Dear Ms. Albrecht:
Staff has reviewed your re- submittal requesting to include a required application plan for property
zoned PDSC (Planned Development Shopping Center).
We have the following comments, majority of which, we have previously discussed with you.
Although we believe these issues should be resolved before your proposal goes to public hearing,
we understand your request to bring this to public hearing with the Planning Commission in July.
We would be glad to meet with you to discuss these issues. Our comments are provided below:
Planning
Neighborhood Model
The previous staff comment letter described how the proposed development meets. or does not
meet the principles of the Neighborhood Model. The following information describes the
outstanding issues as they relate to the principles of the Neighborhood Model:
Pedestrian Orientation - Sidewalks are proposed on the site, and a'striped crosswalk connecting
the sidewalk on the subject site to one corner of the adjacent property is shown on the revised
plan. Additional pedestrian connections are not shown, although they were considered. This
principle is partially addressed.
Neighborhood Friendly Streets and Paths — As you are aware, the street is not really a street, but a
travelway and parking area. This principle is not addressed.
Interconnected Streets and Transportation Networks —The revised plan shows two -way
circulation on all travelways within the proposed development and two interconnections to the
rear of the Shopper's World shopping center. As noted above, pedestrian connections are shown
on one side of the development to the adjacent property. Alternative transportation networks are
available in the vicinity, but connections from this site to these transportation systems are not
readily accessible. This principle is partially addressed.
Relegated Parking — Parking is located at the rear of the site, which is the entrance to the building
and the two loading areas are located at the front of the site which is the rear of the proposed
building. Majority of the parking area for this proposed development is not visible from public
roads. This principle is addressed.
Site Planning That Respects Terrain — As previously noted, retaining walls are proposed on the site
and critical slopes will be disturbed, even though they are manmade slopes. The applicant has
provided a request for a critical slopes waiver, which staff does not see as a major issue.
Zoning
The following comments related to zoning matters have been provided by Amelia McCulley:
• The potential uses will be limited by available parking, as acknowledged by you.
Because the adjacent owner is not open to shared parking, parking requirement
reductions will be limited.
• The plan,shows grading up to the 20 ft undisturbed buffer. Given this fact, it is likely that
grading will encroach into the buffer and that a waiver to allow some disturbance will be
necessary. Staff suggests that you address this with the rezoning.
Site Plan /Subdivision
The following comments regarding your proposal's ability to meet site plan or subdivision
ordinance requirements in the future have been provided by Bill Fritz:
• The maintenance.of the landscaping and buffer will be difficult between the proposed
fencing and the adjacent residential lots. Access can be achieved thru the Berkely
subdivision but access from the commercial portion of the property will be extremely
difficult. If not properly maintained invasive species such as poison ivy or kudzu may take
over potentially impacting the residential properties. This development may want to
approach the adjacent residential property owners to discuss maintenance possibilities
which may include land transfer or easements.
Engineering and Water Resources
The following comments related to engineering and water resources have been provided by Glenn
Brooks. These concerns are recommended to be addressed with the rezoning:
• Traffic generation figures and a study examining impacts to the entrances to public roads
should be provided.
VDOT has indicated the main focus should be on access from Rt. 29; the dual lefts at the
signal on 29N, and depending on how the traffic enters from 295, either lefts on Berkmar,
or rights into the shopping center.
A plan showing the truck circulation should be provided. It should indicate how trucks are
to enter, turnaround, and leave the site to public roads. Turning radius movements should

be accommodated on the plan. Such movement may also necessitate easements on
adjoining property.
These concerns can be addressed with the site plan:
• Drainage provisions must be made to accommodate drainage from surrounding
development through this development. It appears drainage needs to be picked up before
it flows over retaining walls or through the parking and travelway areas. It may need to be
conveyed through easements.
It appears that drainage above the wall in the northeast direction will need to be picked
up. Your response letter describes an existing drainage swale in the buffer, at the northeast
corner of the property. Staff is not aware of this. It is not recommended that drainage flow
to the adjacent property in the northeast corner. This issue will need to be addressed at
some point during the site plan stage.
• The retaining walls may be a safety concern for surrounding residential development, and
adequate safety provisions should be provided.
It is noted that pedestrians access this area from the adjoining neighborhood, and a safe
way down or around the wall could be provided to accommodate them.
It appears as though an off -site easement is needed for the drainage outfall system from
the proposed bio- retention facility.
Staff recommends this issue be resolved sooner rather than later. It could be difficult to
obtain off -site easements and waiting until the site plan stage.to resolve this issue could
prolong the site plan process for this project.
Critical Slope waiver request
There are no concerns which prohibit the disturbance of the critical slopes as shown.
Entrance Corridor
The following comments related to the Entrance Corridor Guidelines have been provided by
Margaret Maliszewski:
• As previously mentioned, only the eastern corner of the site and proposed building fall
within the Route 29 Entrance Corridor, and existing buildings between the site and the EC
are expected to limit visibility of the proposed development. Prior to final site plan
approval of a Certificate of Appropriateness is required for the portions of the site and
building that fall within the EC. Standard EC guidelines will apply to those portions of the
building and site.
Proffers
• As previously commented on, you should consider whether any uses should be proffered
out given the proximity to the low density residential neighborhood. This should be
addressed with the rezoning.

As you have requested, this project is tentatively scheduled for the Planning Commission agenda
for a public hearing on July 17, 2012. The following information is sent to you again for your
information and guidance. Please be aware that fees as noted below need to be paid prior to each
public hearing.
Action after Receipt of Comments
After you have read this letter, please take one of the actions identified on "Action After Receipt
of Comment Letter" which is attached.
Resubmittal
If you choose to resubmit, please use the attached form. There is no fee for the first resubmittal.
The resubmittal date schedule is provided for your convenience.
Notification and Advertisement Fees
Recently, the Board of Supervisors amended the zoning ordinance to require that applicants pay
for the notification costs for public hearings. Prior to scheduling a public hearing with the Planning
Commission, payment of the following fees is needed:
$193.70 Cost for newspaper advertisement
$208.46 Cost for notification of adjoining owners (minimum $200 + actual postage /$1 per owner
after 50 adjoining owners)
$402.16 Total amount due prior to Planning Commission public hearing
Prior to the Board of Supervisor's public hearing, payment of the newspaper advertisement for the
Board hearing needed.
$193.70 Additional amount due prior to Board of Supervisors public hearing
$595.86 Total amount for all notifications Fees may be paid in advance. Payment for both the
Planning Commission and Board of Supervisors public hearings may be paid at the same time.
Additional notification fees will not be required unless a deferral takes place and adjoining owners
need to be notified of a new date..

ACTION AFTER RECEIPT OF COMMENT LETTER
Within 30 days of the date of this letter, please do one of the following:
(1) Resubmit in response to review comments
(2) Request indefinite deferral
(3) Request that your Planning Commission public hearing date be set
(4) Withdraw your application
(1) Resubmittal in Response to Review Comments
If you plan to resubmit within 30 days, make sure that the resubmittal is on or before a
resubmittal date as published in the project review schedule. The full resubmittal schedule may
be found at www.albemarle.org in the "forms" section at the Community Development page.
Be sure to include the resubmittal form on the last page of your comment letter with your
submittal.
The application fee which you paid covers staff review of the initial submittal and one
resubmittal. Each subsequent resubmittal requires an additional fee. (See attached Fee
Schedule.)
(2) Request Indefinite Deferral
If you plan to resubmit after 30 days from the date of the comment letter, you need to request
an indefinite deferral.. Please provide a written request and state your justification for
requesting the deferral. (Indefinite deferral means that you intend to resubmit /request a
public hearing be set with the Planning Commission after the 30 day period.)
(3) Request Planning Commission Public Hearing Date be Set
At this time, you may schedule a public hearing with the Planning.Commission. However, we
do not advise that you go directly to public he staff has identified issues in need of
resolution that can be addressed with a resubmittal.
After outstanding issues have been resolved and /or when you are ready to request a public
hearing, staff will set your public hearing date for the Planning Commission in accordance with

the Planning Commission's published schedule and as mutually agreed by you and the County.
The staff report and recommendation will be based on the latest information provided by you
with your initial submittal or resubmittal. Please remember that all resubmittals must be made
on or before a resubmittal date.
By no later than twenty -one (21) days before the Planning Commission's public hearing, a
newspaper advertisement fee and an adjoining owner notification fee must be paid. (See
attached Fee Schedule) Your comment letter will contain the actual fees you need to pay.
Payment for an additional newspaper advertisement is also required twenty -two (22) days prior
to the Board of Supervisors public hearing. These dates are provided on the attached Legal Ad
Payments for Public Hearings form.
Please be advised that, once a public hearing has been advertised, only one deferral prior to the
Planning Commission's public hearing will be allowed during the life of the application. The
only exception to this rule will-be extraordinary circumstances, such as a major change in the
project proposal by the applicant or more issues identified by staff that have not previously
been brought to the applicant's attention. As always, an applicant may request deferral at the
Planning Commission meeting.
(4) Withdraw Your Application
If at anytime you wish to withdraw your application, please provide your request in writing.
Failure to Respond
If we have not received a response from you within 30 days, we will contact you again. At that
time, you will be given 10 days to do one of the following: a) request withdrawal of your
application, b) request deferral of your application to a specific Planning Commission date as
mutually agreed to with staff, or c) request indefinite deferral and state your justification for
requesting the deferral. If none of these choices is made within 10 days, staff will schedule
your application for a public hearing based on the information provided with your original
submittal or the latest submittal staff received on a resubmittal date.

Counter. Make checks payable to the County of Albemarle. Do not send checks directly to the

To be paid after staff review for public notice:
Most applications for Special Use Permits and Zoning Map Amendment require at least one public hearing by the Planning Commission
and one public hearing by the Board of Supervisors. Virginia State Code requires that notice for public hearings be made by publishing
a legal advertisement in the newspaper and by mailing letters to adjacent property owners. Therefore, at least two fees for public notice
are required before a Zoning Map Amendment may be heard by the Board of Supervisors. The total fee for public notice will be
provided to the applicant after the final cost is determined and must be paid before the application is heard by a public body.

I have reviewed the second submittal (dated May 7th) and have the following comments:
1. The potential uses will be limited by available parking, as acknowledged by the applicant.
Because the adjacent owner is not open to shared parking, parking requirement reductions will
be limited.
2. The plan shows grading up to the 20 ft undisturbed buffer. Given this fact, it is likely that
grading will encroach into the buffer and that a waiver to allow some disturbance will be
necessary. Staff suggests that the applicant address this with the rezoning.

Staff has reviewed your initial submittal requesting to include a required application plan for
property zoned PDSC (Planned Development Shopping Center).
We have a number of questions and comments which we believe should be resolved before your
proposal goes to public hearing. We would be glad to meet with you to discuss these issues. Our
comments are provided below:
Planning
Initial comments on how your proposal generally relates to the Comprehensive Plan are provided
below. Comments on conformity with the Comprehensive Plan. are provided to the Planning
Commission and Board of Supervisors as part of the staff report.
• The Places 29 Master Plan designates this property as Urban Mixed Use (in Centers). which
allows retail, residential; commercial, employment, office, institutional, and open space. -
uses.
• This property is zoned PDSC, which allows shopping centers, retail sales and service uses;
residential by special use permit at a density of (15 units /acre). Dwellings are not proposed
and no change in the existing zoning district is proposed.
• The property is located in a portion, of the existing Shopper's World shopping center. The
proposed application plan is consistent with the Places 29 Master Plan designation of "
Urban Mixed Use.
• The County's Open Space Plan does not describe any significant features on this site.
Neighborhood Model
The following describes how the proposed development meets or does not meet the principles of
the Neighborhood Model:

Pedestrian Orientation — While there appears to be proposed sidewalks on the site, there do not
appear to be sidewalks leading to adjacent properties, which could be useful since a shopping
center is one of the. adjacent parcels. It is not clear if this principle is addressed.
Neighborhood Friendly Streets and Paths —the street is'not really a street, but a travelway and
parking area. This principle is not addressed.
Interconnected Streets'and Transportation Networks -the circulation pattern for this site is
unclear. Will there be one way or two way traffic? This principle needs to be addressed.
Parks and Open Space —This is a small infill site. This principle is not applicable.
Neighborhood Centers —This is part of the existing Shopper's World development. There are other
shopping centers located in the vicinity with.office /meeting space. This principle is met.
Buildings and Spaces of Human Scale — Based on the submitted site sections, it appears the
proposed building and spaces are of human scale. This principle is met.
Relegated Parking— Parking is located at the rear of the site, which is the entrance to the building.
It appears that loading areas are located at the front of the site as shown. It is not clear that the
parking is relegated.
Mixture of Uses —This site is part of a shopping center. The uses within the shopping center along
with the proposed uses are a mixture of commercial uses. However, with the proximity of
additional commercial and residential uses in close proximity to this property, staff does not see
this as a major issue.
Mixture of Housing Types and Affordability — This is, not applicable, given the type of facility
proposed.
Redevelopment —This is the development of a vacant infill property. This principle is not
applicable.
Site Planning That Respects Terrain — Retaining walls are _proposed on the site and critical slopes..
will .be disturbed even though they are manmade slopes. Minimal disturbance to the terrain is
suggested.
Clear Boundaries with the Rural Areas — Not Applicable.
More detailed comments may. be provided after more detailed plans are provided.
• Please provide a copy of the easement /documentation allowing right -of -way access
between this site and the Shopper's World site.
Zoning
The following comments related to zoning matters have been provided by Amelia McCulley:

• A critical slopes waiver can be processed with this rezoning request. Even though it was
previously determined that a waiver was not necessary because the slopes were approved
and established as a result of the prior site. plan, the Zoning Ordinance was amended after
that time. It is no longer a completely administrative finding.
• Zoning staff is open to options whereby the required parking spaces will be reduced
through various means. for example, if parking in the existing shopping center will be
available and could practically.be used by the new building, we'd like to. see shared.
parking. Also, if this site is served by a transit stop within a reasonable walking distance,
that's another measure to reduce the required parking.
• Please incorporate sidewalks and pedestrian paths that will connect this site to the
adjoining sites.
• Landscape screening is also required.within the buffer adjacent to the residentially- zoned
properties. Also see comments from Site plan staff (Bill Fritz). Please address. Ordinance
requirements for landscaping in this area. It has been an area of concern for prior
proposals.
Site Plan /Subdivision
The following comments regarding your proposal's ability to meet site plan or subdivision
ordinance requirements in the future have been provided by Bill Fritz:
• A critical slopes waiver is required. Staff recommends this be addressed during the
rezoning review. A critical slopes waiver was approved with SDP 1996 -62 but that approval
has expired:
• During the review of SDP 1996 -62 the issue of screening was brought up. It would be
appropriate to show methods of screening on the application plan.
• Careful attention should be given to insure that adequate turning radius is available for
truck movements. This does not have to be addressed at the rezoning stage.- This
information is provided to the applicant as advisory at this time only. Turning movements
and all other design requirements will be addressed during the site plan review.
Engineering and Water Resources
The following comments related to engineering and water resources have been provided by Glenn
Brooks:
• Traffic generation figures and a study examining impacts to the entrances to public roads
should be provided.
• A plan showing the truck circulation should be provided. It should indicate how trucks are
to enter, turnaround, and leave the site to public roads. Turning radius movements should
be accommodated on the plan. Such movement may also necessitate easements on
adjoining property.
• Drainage provisions must be made to accommodate drainage from surrounding
development through this development. It appears drainage needs to be picked up before
it flows over retaining walls or through the parking and travelway areas. It may need to be
conveyed through easements.

• The retaining walls may be a safety concern for surrounding residential development; and
adequate safety provisions should be provided.
• It appears as though an off -site easement is needed for the drainage outfall system from
the proposed bio- retention facility.
Entrance Corridor
The following comments related to the Entrance Corridor Guidelines have been provided by
Margaret Maliszewski:
• Only the eastern corner of the site and proposed building fall within the Route 29 Entrance
Corridor, and existing buildings between the site and the EC are expected to limit visibility
of the proposed development. Prior to final site plan approval a Certificate of
Appropriateness is required for the portions of the site and building that.fall within the EC.
Standard EC guidelines will apply to those portions of the building and site.
VDOT
Comments from VDOT are highlighted and attached.
ASCA
The following comments related to Albemarle County Service Authority (ACSA) have been
provided by Alexander Morrison:
• Field location will be required on an existing ACSA waterline that runs parallel to the rear
property line. Waterline may require relocation by applicant due to retaining wall. If
relocation is required, final water construction plans will be required for review by the
ACSA. This may require relocation where plants will not be located. For further information
contact Alexander J. Morrison, EIT, Civil Engineer for the ACSA, at
amorrison @serviceauthority.or or (434) 977 -4511, ext. 116.
JAUNT
The following comments related to transit service have been provided by Peter Ohlms:
• This area is in the urban fare zone for JAUNT. JAUNT provides trips primarily for people
with disabilities. Charlottesville Area .Transit (CAT) would be the main transit option for the
general public. Although CAT recently had a route serving Berkmar Drive.adjacent to the
site, it has been changed. The closest current CAT stops are all about % mile away on Rio
Road West, Commonwealth Drive, and Four Seasons Drive. Therefore, despite this site's
central regional location, it has relatively poor access to transit.
a. An accessible pedestrian connection to Commonwealth Drive could improve transit
access somewhat.
b. A marked accessible pedestrian route or sidewalks connecting to the existing
Shoppers World walkways would help in making short walk trips possible
(employees going out to lunch, for example) and could improve transit access.
• The parking lot layout appears to be sufficient to allow JAUNT to serve the buildings.

Fire /Rescue
The following comment related to Fire /Rescue has been provided by Robbie Gilmer:
c. Pending all meets the Virginia Statewide Fire Prevention Code and will be subject to
field inspections.
Proffers
• Proffers have not been submitted. Since this rezoning request is adjacent to residential
uses and district, staff suggests screening be provided and proffered.

Payment for an additional newspaper advertisement is also required twenty -two (22) days prior
to the Board of Supervisors public hearing. These dates are provided on the attached Legal Ad
Payments for Public Hearings form.
Please be advised that, once'a public hearing has been advertised, only one deferral prior to the
Planning Commission's public hearing will be allowed during the life of the application. The
only exception to this rule will be extraordinary circumstances, such as a major change in the
project proposal by the applicant or more issues identified by staff that have not previously
been brought to the applicant's attention. As always, an applicant may request deferral at the
Planning Commission meeting.
(4) Withdraw Your Application
If at any time you wish to withdraw your application, please provide your request in writing.
Failure to Respond

Below are VDOT's comments for the December, 2011 Rezoning and Special Use Permit applications:
SP -2011 -00029 Verizon Wireless. Tier III PWSF (Christopher Perez)
1. This modification to an existing tower does not require a permit from VDOT since it will access through an
existing driveway.
SP- 2011 -00031 Greenbrier Emeraency Animal Hospital (Joanne Purtsezva)
1. The estimated increase in traffic for this use is 50 to 60 VPH in the AM and PM peak hours. It is not clear
whether this is an increase in traffic or just a change to a new use that will have no net effect on traffic.
ZMA- 2011 - 00008, 00009 Three Notched Center (Megan'Yani2los)
1. Route 240 is functionally classified as a Rural Minor Arterial: VDOT records indicate that the road is 35
mph but it is posted at 25 mph..
2. The required,spacing for a full access commercial entrance at 25 mph is 355 feet and 35 mph is 470 feet. It
appears that there is enough frontage on Route 240 to meet the spacing requirements.
3. The increase in traffic from this proposed use is 166 VPH in the peak hour. A right and left turn lane
analysis needs to be provided for review in accordance with Appendix F of the VDOT Road Design
Manual.
ZMA -2011 -00010 Albrecht Place (Claudette Grant
1. ITE trip generation estimates that this use will generate 3400 vehicles per day on weekdays and 4700 VPH
on Saturdays.
2: This site does not meet the threshold for traffic to require a Chapter 527 Traffic Impact Study. This site
will generate a volume of traffic that will impact surrounding intersections on route 29 and other side roads
and it is recommended that the county require some type of traffic impact analysis for this proposed use.

the plan. Such movement may also necessitate easements an adjoining property.
3. Drainage provisions must be made to accommodate drainage from surrounding development through
this development. It appears drainage needs to be picked up before it flows over retaining walls or
through the parking and travelway areas. It may need to be conveyed through easements.
4. The retaining walls may be a safety concern for surrounding residential development, and adequate
safety provisions should be provided.
5. It appears as though an off -site easement is needed for the drainage outfall system from the proposed
bio- retention facility.
