Subject: SUB201200073 The Preserve at Glenmore - Preliminary (Initial Submittal)
The Planner will recommend approval of the plat referred to above when the following items
have been fully addressed. (Additional comments or conditions may be added or eliminated
based on further review.) [Each comment is preceded by the applicable reference to the
Albemarle County Code.]
1. [14- 203A(1)(b)/14- 218(B)(ii) /14 -234]
Planning Commission review.
Initial Submittal:
This preliminary plat requires Planning Commission review and approval rather than
administrative review and approval due to the proposed new private street, regardless of
whether it is called up to the Planning Commission by a member of the public. Pay the
difference in fee cost, which is $700 ($2,200 for plats requiring Planning Commission
Review compared to $1500 for plats under administrative review.)
2. [14- 203E(2), (3), (4), (5)]
Private street fees.
Initial Submittal:
Pay the private street fees, which include $670 for the authorization of a private street,
$400 for each review of a private street, and $540 for the waiver of curb and gutter.
3. [14- 203(G)(3)]
Tier 3 Groundwater Assessment.
Initial Submittal:
Pay $510 for a Tier 3 Groundwater Assessment, which is required to be initiated in draft
form for all preliminary plats showing lots where at least 3 lots are 5 acres or less. A
groundwater management plan must be approved in its final form prior to final plat
approval.
4. [14- 203(I)]
Adjacent owner notices.
Initial Submittal.
Pay $206.75 for mailing the adjacent property owners notices; this sum figure includes
postage.
6. [14 -/14- 224.1]
Curb and gutter.
Initial Submittal. Show curb and gutter on "Road A" or submit a curb and gutter waiver
request, including written justification, for review and approval.
7. [14- 302(A)2]
Vicinity map.
Initial Submittal.
The vicinity map is inadequate. Provide a vicinity map of all other phases of "Glenmore"
subdivisions for which final plats have been approved, as the extended Glenmore
community appears to have exceeded its maximum number of lots allowed. "Glenmore"
refers to the original "Glenmore" community, the Rivanna Village at Glenmore,
Glenmore Leake, Glenmore Livengood, and the Preserve at Glenmore /Glen Oaks under
their various names.
8. [14- 216(B)(3)]
Existing or platted streets.
Initial Submittal.
Provide the right -of -way width for all existing and platted streets shown on the plat. In
the sheet layout on sheet 1, revise Carroll Creek Drive to say Carroll Creek Road.
9. [14- 216(B)(10)]
Right of further division of proposed lots.
Initial Submittal.
The development rights note is incomplete and is not phrased as required by this section.
"Lots" may be used instead of the "parcel" and "residue" language that is required. The
note must be verbatim otherwise. Deviations from the verbatim language may only
exceed the information required, not be more general that the verbatim language, as is
currently shown in the development rights note on sheets 2 and 3. Refer to SUB -2010-
115 and /or SUB - 2010 -154 for how the development rights note should read. Revise to a
statement similar to the notes approved with SUB - 2010 -115 and/or SUB - 2010 -154. This
note should include the following language: "Original tax map 94 Parcels 15 and 16 each
had 5 development rights. With SUB - 2010 -154 recorded at deed book 413 8, page
number 339, new lots 1, 2, 3, and 4 were each assigned a development right from the
original (5) development rights that belonged to Tax Map 94 Parcel 16, and may not be
further divided. The remaining development right on Tax Map 94 and Parcel 15 is being
assigned to lot 5. The aggregate acreage of lots 1, 2, 3, 4, and 5, is less than 31 acres.
Original Tax Map 94 Parcel 16 had 5 development rights, which were assigned to Tax
Map 94 Parcel 15 at D. B. 3863 Pages 363 -378. New lots 6, 7, 8, 9, and 10, will each be
assigned a development right from the remaining 5 development rights and may not be
further divided. Lots 11, 12, and 13 will not require the use of a development right."
Please note that this language assumes approval of the plat as presented in the initial
submittal and is subject to change as /if the lot lines are revised.
10. [14- 216(B)(12)]
Topography.
Initial Submittal.
Revise existing topography to show a maximum of five (5) foot contours. Revise
proposed grading to show a maximum of five (5) foot contours.
13. [14- 216(B)(13)]
Proposed facilities.
Initial Submittal:
Proposed facilities are missing. Show the location of proposed water and sewer lines and
related improvements. Show proposed drainage and stormwater management facilities
and related improvements. Remove note number 3 on sheet 1.
14. [14- 302(B)5]
Zoning classification.
Initial Submittal:
This property is subject to a special use permit: SP- 2006 -031. However, a previous staff
report for SUB - 2010 -115 indicates that the applicant has elected to abandon this special
use permit by not building the Glen Oaks Stream Crossing. Reference this special use
permit file number (SP- 2006 -031) and add a note that this special use permit is no longer
being pursued.
15. [14- 302(B)10]
Initial Submittal. Revise the stream buffers note to state verbatim, "The stream buffer(s)
shown hereon shall be managed in accordance with the Albemarle County Water
Protection Ordinance."
16. [14- 304/35.1(i)(2)]
Critical slopes waiver.
Initial Submittal.
If any critical slopes are proposed to be disturbed, submit a written request for a critical
slopes waiver for review and approval, including the associated fee of $425. Also, SUB -
2010 -115 shows several extensive systems of critical slopes. Verify that the critical
slopes as shown on the current plat are correct and revise if incorrect.
17. [14 -305]
Stormwater management information.
Initial Submittal.
Provide stormwater management information. Note 3 on sheet 1 is unsatisfactory.
18. [14 -306]
Private street information.
Initial Submittal.
Provide private street information.
19. [14 -217]
Initial Submittal:
The planner will recommend approval upon receipt of tentative approvals from all Site
Review Committee reviewers.
20. [Additional Zoning & Current Development Division Requirements]
Restrictions imposed by the Board of Supervisors and their period of existence;
References to previous SP approvals.
Initial Submittal:
List out the conditions of SP- 2006 -031 and indicate that the period of existence has ended
due to the fact that the applicant has elected not to pursue the Glen Oaks Stream
Crossing.
21. [General Comment]
Initial Submittal.
Revise the reference to Carroll Creek Drive in the sheet layout on sheet 1 to be Carroll
Creek Road.
22. [General Comment]
Initial Submittal.
Remove the reference and road shown as "Future Road" in the sheet layout on sheet 1.
This road has not been reviewed and will not be reviewed.
23. [General Comment]
Initial Submittal.
Remove the references and lot lines shown with lots 1 -16, which have not been approved
and are not under review with this plat in the sheet layout on sheet 1, 2, and 3.
24. [General Comment /14- 208.1/14- 203(C)21
Initial Submittal.
Remove note 1 on sheet 3. A boundary line adjustment plat must be reviewed and
approved prior to approval of this preliminary plat. No boundary line adjustment plat has
been submitted at this time. Submit a boundary line adjustment plat and associated fee of
$200.
25. [General Comment]
Initial Submittal.
On the sheet layout in sheet 1, revise the typo in the name of the owner of
09400 -00 -00 -08500 to be Kirby, Donna Louise c/o Glen Breeden.

26. [14 -416]
Individual private wells and septic systems.
Initial Submittal:
Obtain Health Dept. approval for private wells and septic on all lots.
27. [14- 302(A)4]
Private easements.
Initial Submittal:
Provide and label the location and dimensions of all existing and proposed private
easements. Existing easements must include the deed book, page number, and owner of
record. In particular, delineate and reference the 20' storm drain easement going across
Tax Map 94 Parcel 15. Delineate and reference the ingress /egress easement recorded in
Deed Book 113 Page 175 -177 and Deed Book 1073 Page 688 -693.
28. [14- 302(A)5]
Public easements.
Initial Submittal:
Provide and label the location and dimensions of all existing and proposed public
easements, if any.
29. [14- 302(A)8]
Proposed lots.
Initial Submittal:
Provide dimensions for all boundary lines of each lot, including frontage on the proposed
private street currently labeled as Road A and to Carroll Creek Road; a few dimensions
are missing.
Final tentative approval from this department will be subject to the following conditions: [These
conditions are those which have been identified at this time. Conditions may be added or
eliminated based on additional review.]
All requirements of Chapter 14 will apply, however I am providing you with the following
comments for items that I noticed during the review of the preliminary plat submitted; these
items do not have to be addressed at this time. (These comments do not constitute a review of the
final plat.)
1. [14 -303]
Statement of consent to division.
Note, verbatim, is required on the plat.
2. [14 -303M]
Street names.
In addition to authorization by the Planning Commission for the proposed private street, the
street name has to be approved by the E911 reviewer.
3. [14 -3030, P]
Signature panels, notary panels.
Signature and notary panels, per this section, must be provided.
4. [14 -309, 310, 4161
Soils work.
Health Department approval is required prior to final plat approval. Submit three (3) sets of
soils work for each parcel less than 21 acres.
5. [14 -311]
Infrastructure improvement plans, computations, and documents.
Infrastructure improvement plans, computations, and documents must be approved prior to
final plat approval.
6. [14 -317]
Instrument evidencing maintenance of certain improvements.
If the proposed private street is approved by the Planning Commission, submit a private street
maintenance agreement for review and approval by the County Attorney's Office.
7. [14- 308.1]
Tier III groundwater assessment.
Submit a groundwater management plan in final form for review and approval.
