Many of my comments in my April 9, 2012 comment memo have been addressed. Zoning has reviewed these requests to determine if they are eligible variations under §18- 8.5.5.3, and meet the proffers Code of Development, and General Development Plan for ZMA 2004 -07. Variations #145 Five variations have been submitted and two of those were submitted May 14. Comments for Variations #1, #2, and #3 were provided in my April 9, 2012 comment letter. The area of Variations #1 and #3 are no longer within the limits of this plat and Variation #4 has been withdrawn. My previous comments regarding Variation #2 (item #2 in my April 9, 2012 letter) have been addressed with the May 14, 2012 resubmittal of the plat and new variation application. The variation needed for changes to street design has been submitted as Variation #5 on May 14, 2012. This request is eligible under §18- 8.5.5.3.a.5. are eligible for a variation request, subject to recommendation for approval by the County Engineer. This variation request may be approved with a recommendation for approval by the County Engineer. Grading -Sheet 5 and Proffer 5 of ZMA 2004 -007 As commented on previously by Engineering in Phillip Custer's March 29, 2012 comment memo, this proposal does not meet the requirements of Proffer 5 based on the proposed grading and retaining walls shown on Sheet 5 of the plat. Grading should be revised to meet this proffer and be reviewed and approved by the County Engineer.
