The Albemarle County Planning Division will grant or recommend approval of the subdivision
plat referenced above once the following comments have been addressed. The following
comments are those that have been identified at this time. Additional comments may be added or
eliminated based on further review. [Each comment is preceded by the applicable reference to
the Subdivision Ordinance, unless otherwise specified.]
1. [14- 215(7)] Please add a note to identify this land as being located in a water supply
protection area. Please also add a note indicating this land is not within an
agricultural- forestal district and is not subject to a conservation or open -
space agreement.
2. [14- 302(A)10] Right of further division of proposed lots. Please edit the note regarding
development rights to read "Parcel X is assigned 3 development rights and
may /may not be further divided and when further divided these rights shall
not comprise more than 30.35 acres. The residue of Tax Map 85 Parcel
24B is retaining 3 development rights and when further divided it shall not
consist of more than 20.85 acres."
3. [14- 302(B)8] Yards. Please show the location of all yards required by this chapter and
the zoning ordinance, which may be shown graphically or described in a
note on the plat. Section 10.4 of the Zoning Ordinance contains the
required yards for the Rural Areas zoning district.
4. [14- 303(E)] Dimension standards and information on all lots, streets, alleys,
easements, and shared driveways. Please review the full contents of this
section. Please edit the label of the "New 25' Access Easement" to be a
shown as a "Private Street Easement." The easement holders need to be
identified on the plat. Please also add a note to indicate that the
maintenance of this easement shall be by the owners of the lots affected,
not by the Virginia Department of Transportation or the county.
5. [14- 303(L)] Public utility, drainage and sight distance easements. Show any and all
public utility, drainage and sight distance easements that exist.
6. [14- 303(N)] Statement pertaining to private streets. Please add the note:
"The street in this subdivision may not meet the standards for acceptance
into the secondary system of state highways and will not be maintained by
the Virginia Department of Transportation or the County of Albemarle."
7. [14 -312] Location of existing buildings. Please show any existing structures on
Parcel X and Parcel 24B.
8. [14 -316] Approval of entrance onto public streets. Please submit evidence
that the entrance of the new private street complies with Virginia
Department of Transportation standards.
9. [14 -412] Standards for private streets only. For future reference, please be advised
of the following standards for residential private streets:
Streets serving two lots. Each private street serving two (2) lots: (i)
shall not exceed a sixteen (16) percent grade calculated over a
distance of fifty (50) feet; (ii) shall have a travelway that is at least
ten (10) feet in width; and (iii) shall include a rectangular zone
superjacent to the driveway that is clear of all obstructions,
including any structures and vegetation, that is at least ten (10) feet
in width and fourteen (14) feet in height. The subdivider shall
demonstrate to the satisfaction of the county engineer that the
street will meet the requirements of this subsection.
Frequently, a 25 -foot access easement is not adequate for construction and
maintenance purposes. We recommend increasing the width of the access
easement to be 30 feet.
