Ladies and Gentlemen:
In response to your request for a Letter of Zoning Compliance, please be advised of
the following:
The Department of Community Development is responsible for (a)
enforcement of building code and zoning ordinance regulations for
commercial development in Albemarle County, Virginia, and (b) the issuance
of Certificates of Occupancy in Albemarle County, Virginia. The Department
of Community Development is not responsible for fire codes and regulations,
which responsibility falls to the Department of Fire & Rescue.
• The Project, more particularly described in Exhibit A attached hereto, is zoned
Commercial (C -1), which zoning is proper for the structure and existing uses
of the Project and related amenities comprising the Project, and accordingly
the Project is a conforming use.
• Attached hereto as Exhibit B is a web link to the applicable ordinance relating
to the zoning and use of the Project.
• The Project is developed with a building and associated parking.
• The Project does not have an approved site plan since it appears that the
building was constructed prior to site plan regulations being in effect in
Albemarle County.

• A site inspection was conducted for this Project and showed no violations of
the zoning ordinance for use of the Project.
• This office has no record of open violations for this Project.
A Certificate of Occupancy was issued on September 9, 1999 for interior
renovations. It is the policy of this department to purge building permit files
after three years. Copies of Certificates of Occupancy are maintained on
microfilm. Therefore, we have not retained any paper copies of Certificates of
Occupancy associated with this Project. Furthermore, the absence of a
Certificate of Occupancy for the Project will not give rise to any enforcement
action. Please be aware that interior renovation that does not involve a
change of use does not require a Certificate of Occupancy. You may obtain a
copy of a Certificate of Occupancy for an additional fee of $25.00 each by
contacting Esther Grace, Records Manager at (434) 296 -5832.

All that certain lot or parcel of land, with improvements thereon and appurtenances
thereunto belonging, on Berkmar Drive in Albemarle County, Virginia, designated as
Lot 13, ` Berkmar' Subdivision on a plat recorded in the Clerk's Office of the Circuit
Court of Albemarle County, Virginia, in Deed Book 410, page 210, being the same
property conveyed to Joseph W. Richmond, Jr., Trustee of the Anvince Land Trust
pursuant to a Virginia Land Trust Agreement dated May 3, 1989, by deed from
Charles F. Pietsch, Jr., and Sarah B. Pietsch, dated April 26, 1989, recorded in the
said Clerk's Office in Deed Book 1046, page 213.
