Preliminary comments for the following divisions of the Department of Community Development and other agencies, as applicable, are attached: Albemarle County Division of Planning (Planner) - requested changes Albemarle County Division of Engineering - no objections Albemarle County Division of Inspections - no objections Albemarle County Division of Information Services (E911) - requested changes Albemarle County Department of Fire Rescue - no objections Virginia Department of Transportation - no objections Comments reflect information available at the time the development proposal was reviewed, and should not be considered final. However, the Site Review Committee has attempted to identify all issues that could affect approval of the proposed project. Please make the revisions that have been identified as necessary for preliminary approval by the Site Review Committee. If you choose not to make the requested revisions, please submit in writing justification for not incorporating such revisions. Submit five (5) full size copies to the Department of Community Development including responses to each of the attached comments of the Site Review Committee by October 1, 2012. Failure to submit this information by this date will result in suspension of the review schedule. Dinh — Final plat prior to a Preliminary (Initial Submittal) The Planner will recommend approval of the plat referred to above when the following items have been fully addressed. (Additional comments or conditions may be added or eliminated based on further review.) [Each comment is preceded by the applicable reference to the Albemarle County Code.] 1. *[14-2321 The subdivision shown on this plat does not qualify as a 2 -lot subdivision in the rural areas. The definition of a 2 -lot subdivision for which the agent can authorize a private street is as follows: [14- 232(B)2]: "A two -lot subdivision if the division contains only two lots and the private street will serve only those lots and will be the sole and direct means of access to a public street." The proposed private street would serve 3 lots. Therefore, planning commission review and approval is required. 2. [14- 302(A)3] Existing or platted streets. Label the road name (Broad Ax Rd./ Rt. 682) and road width. 3. [14- 302(A)8] Proposed lots. Provide the approximate dimensions for the residue of TMP 73 -7. Show the entire boundary of the this lot. 4. [14- 302(A)12] Topography. Label areas of critical slopes (slopes greater than 25 %). Show all proposed grading on each proposed lot, including access, clearing and all other lot improvements. 5. [14- 302(B)5] Zoning classification. Add Entrance Corridors under Zoning. 6. [14- 302(B)6] Tax map and parcel number. Revise the TMP to be 07300- 00 -00- 00700. 7. [14- 302(B)7] Reservoir watershed; agricultural forestal district. Revise the name of the reservoir watershed to be XYZ. Add a note that the TMP 73 -7 is not located in an agricultural- forestal district. 8. [14- 302(B)8] The building appears to encroach on the 75' front yard setback. Demonstrate that the 75' front yard setback has been met. If the building is existing, demonstrate /provide evidence that the [18 -6.3] Nonconforming structures is applicable. 9. [14- 302(B)9] Flood plain. Remove the current flood plain note. Add a note that TMP 73 -7 is located in the Flood Hazard overlay district. 10. [14- 302(B)10] Stream buffer. Show /delineate the WPO /stream buffer on the far end of existing TMP 73- Add a note "The stream buffer(s) shown hereon shall be managed in accordance with the Albemarle County Water Protection Ordinance." 11. [14- 302(B)1] General information. Add or revise the date of last revision with each submittal. 12. [14- 303(C)] Boundary lines. Show the exterior boundaries for the entire parcel with bearings in degrees, minutes and seconds. Curvilinear data shall include radius, central angle, arc length, and tangent distance. 13. [14- 303(E)] Dimension standards and information on all lots, streets, alleys, easements, and shared driveways. If a private street is authorized and approved, a private street easement must be shown. Label the easement holders. 14. [ 14- 303(M)] Street names. If a private street is authorized and approved, provide a list of 3 potential road names to the E911 reviewer, Andrew Slack, for review and approval. 15. [14- 303(R)] Parent parcel access. Add a note that reads: "All subsequent divisions of the residue shall enter only onto such street(s) shown on the approved final plat and shall have no immediate access onto any public street." 16. [14- 303(S)] Control points. Revise the exhibit sheet to show at least four (4) control points, evenly distributed across the entire property and located at survey property corners. 17. [14 -306] Private streets information. Submit a private street authorization request for review and approval, including accompanying written justification. The agent cannot authorize a private street serving 3 lots in the rural areas. Obtain approval from the Planning Commission. Submit justification that allows the Planning Commission to make the findings required, which are listed in [14- 232(A)]. 18. [14- 308.1/ 17 -4021 Tier II Groundwater Assessment. A Tier II Groundwater Assessment has been initiated. Results are pending. Notice will be given once results are ready. 19. [14 -309/ 14 -3101 Soil evaluations /Health Dept. approval No soils evaluations were received with the initial submittal. Provide soils evaluations to forward to the Health Dept. for review and approval. 20. [14 -317] Instrument evidencing maintenance of certain improvements. If the private street is authorized and approved, provide a private street maintenance agreement for review and approval by the County Attorney's Office. 21. [14 -400] Minimum lot requirements have not been met. Specifically, the 75' front yard setback has not been met. 22. [14 -402] Lot shape. The proposed lot to be divided may be considered a peculiarly shaped elongation designed solely to provide the required square footage of area. 23.[14-4031 Lot frontage. Each lot created must front on an existing or proposed street. If the private street is not authorized and approved, this lot frontage requirement will not be met. 24. [ 14 -405] Side lot lines. The side lot lines requirement has not been met. Side lot lines of each lot within a subdivision shall be approximately at right angles or radial to the street line. 25. *[14-2031 Fees. The total outstanding fee balance is $1694.05. Although this balance is typically due prior to the Site Review Committee meeting, it must be paid prior to review of any re- submittal.
