Planning, Zoning and ARB staff have identified concerns with the language /form of the proposed amendment to the Special Use Permit. The language will need to be modified to address the issues noted below before staff can recommend approval of the amendment. We would be glad to meet with you to discuss these issues. Planning The following comments /questions related to planning matters have been provided by Brent Nelson: The application drawing refers to lot numbers but does not contain a lot layout plan for reference, refers to Zones A, B & C but does not contain a plan showing the location of those zones and refers to Attachment C but does not contain that attachment. The application plan should contain all referenced documents to avoid confusion and aid in review. The first sentence in both Notes II and III refers to the buildings in those locations as being of a brick material. The inference is that all sides of the structure are to be constructed that way. This is then contradicted by the second sentence in both notes that goes on to say there are exceptions to the side and rear elevations permitting the use of siding. The wording needs to be simplified so the intent is clear. Proposed Note III states "With the exception of the existing buildings on Lots 19, 30, 31 and 32, all rear facing exteriors shall be either red brick or white painted brick to the eave return or full eave Page 1 of 3 return." The note does not indicate what the proposed condition is for the rear of Lots 19, 30, 31 and 32. The proposed revision to Condition 9, states in several places "...brick to the eave return or full eave return " should it not state "...brick to the eave return or full eave return whichever is higher "? Miscellaneous typos: Note III, sentence 3: All side facing exteriors shall be either red brick of white brick ( "of" should be "o r" Note III, sentence 4: With the exception of the existing buildings on Lots 19, 30, 31 and 32, all Rear ( "Rear" should be "rear ") facing exteriors shall be either red brick of white ( "of" should be "or "). Zoning The following comments /questions related to zoning matters have been provided by Ron Higgins: New wording for "Note #9" should be made more specific and clear. For instance "White siding" should be further defined to specify material (wood, hardi -plank and not vinyl or aluminum, if this is the case). I believe they are trying to say that gable ends and dormers can be other than brick, so they should say so. The exceptions for the rear walls on units #s 19, 30, 31 & 32 are essentially the change they are asking, since I /we do not believe the original condition was speaking of the gable ends or dormers. Entrance Corridor The following comments /questions related to the Entrance Corridor Guidelines have been provided by Margaret Maliszewski: Note number 3 reads in part: "All attached single family buildings lying within Zone B and Zone C shall be red brick or white painted brick with gable and hip roofs." Are both types of roof required in a single building? Should the "and" be changed to "and /or "? Note number 3 reads in part: "Front facing gable ends shall be red or white painted brick. All side facing exteriors shall be either red brick or white painted brick to the eave return of full eave return. " Gables and sides will always match the front brick and brick color, right? If so, the wording can be simplified. If not, the building will have an odd appearance. Note number 3 reads in part: "Sunrooms, bay or box windows, front entryways and dormers are permissible non -brick features." Will sunrooms always look just like the one illustrated in Attachment E? If not, alternate wording should be used. "Front entryway" should be made more specific, more descriptive. Action after Receipt of Comments After you have read this letter, please take one of the actions identified on "Action After Receipt of Comment Letter" which is attached. Page 2 of 3 Resubmittal If you choose to resubmit, please use the attached form. There is no fee for the first resubmittal. The resubmittal date schedule is provided for your convenience. Notification and Advertisement Fees Recently, the Board of Supervisors amended the zoning ordinance to require that applicants pay for the notification costs for public hearings. Prior to scheduling a public hearing with the Planning Commission, payment of the following fees is needed: $255.60: Cost for newspaper advertisement $239.67: Cost for notification of adjoining owners (minimum $200 + actual postage /$1 per owner after 50 adjoining owners) $495.27: Total amount due prior to Planning Commission public hearing Prior to the Board of Supervisor's public hearing, payment of the newspaper advertisement for the Board hearing needed. $255.60 Additional amount due prior to Board of Supervisors public hearing $750.87: Total amount for all notifications Fees may be paid in advance. Payment for both the Planning Commission and Board of Supervisors public hearings may be paid at the same time. Additional notification fees will not be required unless a deferral takes place and adjoining owners need to be notified of a new date.
