I have finished reviewing this plat and the relevant previous applications (SUB- 2004 - 00321, SUB - 2006 - 00090, and WPO- 2004 - 00056). Engineering cannot recommend approval of the plat at this time because of the stream crossing. When the subdivision was initially submitted, reviewed, and approved in 2004 and 2005, the associated stormwater management plan proposed just one biofilter to treat the runoff from this development. For treatment in all other drainage areas, existing stream buffers were proposed to be vegetated and protected by deed. The construction and use of the 60" HDPE pipe runs counter to this approved SWM plan. In 2004 and 2005, an existing crossing was originally intended to be used for access to lot 16 (referred to as lot 15 in the SWM plan) from lot 14. At some time between 2007 and today, this plan was abandoned and a second stream crossing was added about 30ft upstream. This was both a violation of the approved SWM plan and the County's Water Protection Ordinance (Sections 17 -317, 17 -318, 17 -320, and 17 -321). Moving forward, one of these crossings must be removed. The crossing that remains must meet all requirements of Section 17 -320.13 including the submittal and approval of a mitigation plan. This mitigation plan will be reviewed using the previous SWM application number: WPO- 2004 - 00056. The work must be approved and bonded prior to engineering recommending approval of this subdivision plat. Please submit a WPO application and $150 fee with a plan showing the necessary mitigation plantings (please refer to page 10 and 11 of 35 of the design manual) and the removal of one of the crossings. Army Corps approval of the stream crossing removal will also be needed. Generally, this is an email from the ACE regional contact acknowledging the proposed work. The following is for information purposes only, but will be of importance once a building permit application for the southern parcel is sought. The alignment of the shared driveway is proposed over a 100ft section that is sloped at 20 %. Significant cut grading will be necessary to establish the maximum slope of 16 %. Additional fill in and around the stream to meet this 16% maximum grade will not be allowed. To avoid considerable grading, a different alignment could be platted. [18- 4.6.6]
