[14 -312)] Location of existing buildings. Provide the location of all existing buildings within fifty (50) feet of any proposed easement line. Rev1: Comment addressed [Comment] Issues remain regarding VDOT and their acceptance of the sidewalk. VDOT will not accept an easement for maintenance; right- of -way must be provided including a minimum of 1' behind the sidewalk for all portions of sidewalk where VDOT maintenance is anticipated. I have discussed this with Joel and there are apparently two possible solutions; 1) submit a boundary line adjustment that dedicates additional r/w to include all of the sidewalk /trail and a foot beyond, or 2) submit a Deed of Easement that will dedicate an easement to the county for public use. Option 2 would indicate that the developer expects that the County would maintain the sidewalk upon dedication of the easement, but the County attorney does not know of any agreement that has been entered into where the County agreed to take on this responsibility. The preferred and likely most efficient option is to dedicate additional right -of -way; this allows for continuous maintenance of the entire length of sidewalk by one entity and does not involve a separate agreement with the County.
