Staff has reviewed your re- submittal information, dated October 15, 2012.
Thank you for your response letter. We have a few comments which are listed below:
• In regards to the discrepancy for the total number of units and vacant residential parcels in
Glenmore, we reviewed the information you submitted and find the total number of units
you have provided is not consistent with our total. We have worked through the various
discrepancies and after a lot of research and double checking the information with our real
estate and zoning staff we feel the accurate total for built units is 702 and 95 for the vacant
residential parcels, which is inclusive of the 34 proposed Leake lots. This brings the total
units and vacant lots to 797.
Engineering and Water Resources
The following comments related to engineering and water resources have been provided by Glenn
Brooks:
• The connection to the neighborhood outside of Glenmore (Running Deer) was intended to
be an emergency connection only. It was not designed or approved as a road, and thus
should not have driveways accessing it. .
• A shared access to lot 26 - 27 will be recommended with the critical slopes waiver.

2012- 00001, a project known as "Glenmore* TNT 94 -73 Rezoning" (the "Project "), which includes an
application plan prepared by Collins Engineering, LLC entitled "Glenmore TMP 94 -73. Rezoning Plan" and
with a latest revision date of June 04, 2012 (the "Application Plan ").
Pursuant to Section 33.3 of the Albemarle County Zoning Ordinance, the Owner hereby voluntarily proffers the

Staff has reviewed your re- submittal information, dated June 4, 2012.
We have a few questions and comments which are listed below:
The following issue needs to be resolved prior to the rezoning public hearing. As you are
aware, there is a limit regarding the maximum number of units that can be built within
Glenmore before an amendment is required for the Glenmore ZMA. The maximum
number of units allowed in Glenmore is 813.
ZMA200600016, also known as Leake allowed 110 single family units. However of the 110
single family units, 34 single family units could be counted as part of the 813 units and 76
single family units were in addition to and not counted as part of the 813 units authorized
in Glenmore. In trying to determine how this rezoning request fits in with the prior
approved rezoning requests as they relate to the total amount of units allowed in
Glenmore, we have done some research. We are showing that somewhere between 792
and 800 units /lots for single family units are designated in Glenmore and this does not
include the 110 units approved with the Leake rezoning. With the information we have,
which is based on the County's real estate assessors information, being so close to the 813
maximum units allowed in Glenmore, we feel it is important for you to provide a tabulation
of the number of units /lots that you have for Glenmore development. Although the
additional 5 lots being proposed as a result of the subject rezoning might be within the
required 813 limitation for units within Glenmore, it needs to be clearly acknowledged that
the total expected number of units for Leake and Glenmore might not be what was
originally expected. If there is an expectation that there will be over 813 single family
units /lots within Glenmore, then an amendment to the Glenmore ZMA would be required.

Mr. Sansovich is aware of this issue, as I have met with him to discuss this concern.
Please clarify the following information described in your response letter dated June 4, 2012:
• You have described that a variation has been submitted for the revision to the open space.
Who was this submitted to? We do not have record of this.
• You have also described a critical slopes waiver has been submitted. Has this been
submitted with this rezoning request? We have record that a critical slopes waiver was
submitted with SUB2012- 00016. It is not clear when a critical slopes waiver was submitted
for the subject rezoning request.
The following information is provided for your information.
• The revised plan shows that the amount of open space is actually being increased with this
proposal. There is a surplus of open space within the Glenmore development that exceeds
the required 25% of common open space.
Proffers
The following first two bullets should be resolved prior to a public hearing with the Planning
Commission. The third bullet is submitted for additional clarification:
• Make sure you are providing the correct proffer format. It appears the format of the
signature line and date of proffer signature are not consistent with other approved
proffers.
• Proffer 1. Cash proffer for Capital Improvements Projects. The cash proffer contribution
has recently been revised to $19,753.68. This proffer should be corrected with the revised
amount.
• Proffer 2. Improvements to the Emergency Access Gate from Running Deer Subdivision.
Are the improvements to the fence /gate already complete? It is my understanding that the
gate was recently changed. Are there additional improvements expected for the gate?

Dear Scott:
Staff has reviewed your initial submittal requesting to rezone 2 acres from Rural Area (RA) zoning
district to Planned Residential Development (PRD) zoning district in order to create a lot for a
single family detached residence that will become a part of the Glenmore Subdivision.
We have a few questions and comments which are listed below:
Planning
Initial comments on how your proposal generally relates to the Comprehensive Plan are provided
below. Comments on conformity with the Comprehensive Plan are provided to the Planning
Commission and Board of Supervisors as part of the staff report.
The Village of Rivanna Master Plan designates this area as Neighborhood Density (Low) which
represents residential areas where a density of 2 residential units per acre or less is expected.
Housing is expected to be single - family detached. This rezoning proposal is for a single - family
detached unit on 2 acres in the development area. The rezoning request is consistent with the
Village of Rivanna Master Plan.
Neighborhood Model
The proposed single - family detached unit will become part of the Glenmore subdivision, an
existing residential development. The nature of this proposal is not much different than the
existing, developed lots in Glenmore. The Neighborhood Model principals were reviewed with the
Glenmore rezoning.
• Section 8.5.1 of the Zoning Ordinance needs to be followed completely.
• Describe what will be happening with the existing open space. Will open space be lost or

gained with this proposal? Does this proposal impact the required open space? Show how
it does or does not?
If this proposed property becomes part of the Glenmore development how will you make
sure that the existing proffers and conditions for property within Glenmore will be valid for
this proposed property?
• Adjacent neighbors have expressed concern regarding the emergency gate. Please explain
how you will make sure that the emergency gate remains only for emergency use and not
an access for this proposed use or other property in this area that may get developed in
the future.
The submitted PRD Amendment Plan shows five lots and the application plan appears to
show four lots. It is unclear how many lots will be created. Are you creating four lots or
five? The approved plan for Glenmore relating to this subject area shows four lots. The
application states that no new lots are being created. Would five lots create a new lot?
Please explain.
More detailed comments may be provided after more detailed plans are provided.
Zoning
The following comments related to zoning matters have been provided by Ron Higgins:
• Describe with more details what the "upgrades" to the fence at the end of Running Deer
Drive are.
• The parcel being rezoned to PRD and added to the Glenmore PRD will require
documentation showing that it is part of the Glenmore HOA covenants & restrictions.
• A variation will be needed for the open space area to be partially used as a residential lot.
• A critical slopes waiver will be needed for some of the driveways as shown on the "PRD
Amendment Plan" dated 3/27/2012.
Current Development
The following comments regarding your proposal's ability to meet site plan or subdivision
ordinance requirements in the future have been provided by Bill Fritz:
• The project as shown appears to meet the requirements of the subdivision ordinance. A
subdivision plat will be required.
_ • Locating the stormwater facilities on residential lots is generally discouraged. It may be
more appropriate to keep the facility on common open space.
Engineering and Water Resources
The following comments related to engineering and water resources -have been provided by Glenn
Brooks:
• The piping system to convey stormwater to a management facility does not seem feasible.
This is largely because the proposed squares to indicate housing types do not appear
typical of development in this area. There is usually extensive grading, landscape,
hardscape, garages, larger houses, etc., and the final product will likely not work with this
concept.
The proposed stormwater facility will not be possible without disturbing all the critical
slopes in the vicinity to build it and provide access. A more practical solution would be to

provided treatment or infiltration on the lots or to modify the culvert inlet under
Farringdon Road.
It appears as though a sight easement will be necessary on lot 47 for stopping sight
distance along the road.
ASCA
The following comments related to Albemarle County Service Authority (ACSA) have been
provided by Alexander Morrison:
• The waterline shown on the plan should be located on the west side of Running Deer
Drive because the east side is not in the ACSA Jurisdictional Area.

Within 30 days of the date of this letter, please do one of the following:
(1) Resubmit in response to review comments
(2) Request indefinite deferral
(3) Request that your Planning Commission public hearing date be set
(4) Withdraw your application
(1) Resubmittal in Response to Review Comments
If you plan to resubmit within 30 days, make sure that the resubmittal is on or before a
resubmittal date as published in the project review schedule. The full resubmittal schedule may
be found at www.albemarle.org in the "forms" section at the Community Development page.
Be sure to include the resubmittal form on the last page of your comment letter with your
submittal.
The application fee which you paid covers staff review of the initial submittal and one
resubmittal. Each subsequent resubmittal requires an additional fee. (See attached Fee
Schedule.)
(2) Request Indefinite Deferral
If you plan to resubmit after 30 days from the date of the comment letter, you need to request
an indefinite deferral. Please provide a written request and state your justification for
requesting the deferral. (Indefinite deferral means that you intend to resubmit /request a
public hearing be set with the Planning Commission after the 30 day period.)
(3) Request Planning Commission Public Hearing Date be Set
At this time, you may schedule a public hearing with the Planning Commission. However, we
do not advise that you go directly to public hearing if staff has identified issues in need of
resolution that can be addressed with a resubmittal.
After outstanding issues have been resolved and /or when you are ready to request a public
hearing, staff will set your public hearing date for the Planning Commission in accordance with

the Planning Commission's published schedule and as mutually agreed by you and the County.
The staff report and recommendation will be based on the latest information provided by you
with your initial submittal or resubmittal. Please remember that all resubmittals must be made
on or before a resubmittal date.
By no later than twenty -one (21) days before the Planning Commission's public hearing, a
newspaper advertisement fee and an adjoining owner notification fee must be paid. (See
attached Fee Schedule) Your comment letter will contain the actual fees you need to pay.
Payment for an additional newspaper advertisement is also required twenty -two (22) days prior
to the Board of Supervisors public hearing. These dates are provided on the attached Legal Ad
Payments for Public Hearings form.
Please be advised that, once a public hearing has been advertised, only one deferral prior to the
Planning Commission's public hearing will be allowed during the life of the application. The
only exception to this rule will -be extraordinary circumstances, such as a major change in the
project proposal by the applicant or "more issues identified by staff that have not previously
been brought to the applicant's attention. As always, an applicant may request deferral at the
Planning Commission meeting.
(4) Withdraw Your Application
If at anytime you wish to withdraw your application, please provide your request in writing.
Failure to Respond
If we have not received a response from you within 30 days, we will contact you again. At that
time, you will be given 10 days to do one of the following: a) request withdrawal of your
application, b) request deferral of your application to a specific Planning Commission date as
mutually agreed to with staff, or c) request indefinite deferral and state your justification for
requesting the deferral. If none of these choices is made within 10 days, staff will schedule
your application for a public hearing based on the information provided with your original
submittal or the latest submittal staff received on a resubmittal date.

To be raid after staff review for public notice:
Most applications for Special Use Permits and Zoning Map Amendment require at least one public hearing by the Planning Commission
and one public hearing by the Board of Supervisors. Virginia State Code requires that notice for public hearings be made by publishing
a legal advertisement in the newspaper and by mailing letters to adjacent property owners. Therefore, at least two fees for public notice
are required before a Zoning Map Amendment may be heard by the Board of Supervisors. The total fee for public notice will be
provided to the applicant after the final cost is determined and must be paid before the application is heard by a public body.
