Perez, Senior Planner Division: Planning Date: November 13, 2012 Subject: SUB 2012— 00125 Haden Place- Final Subdivision Plat prior to a Preliminary Fax 434 - 972 -4126 The County of Albemarle Planning Division will approve the plat referenced above once the following comments have been satisfactorily addressed (The following comments are those that have been identified at this time. Additional comments or conditions may be added or eliminated based on further review.): [Each comment is preceded by the applicable reference, which is to the Subdivision /Zoning Ordinances unless otherwise specified.] 1. [14- 302(A)4 & 14 -317] Private easements & Instrument evidencing maintenance. The private street easement for Haden Place (private road) should be `conveyed' to the Haden Place Homeowners Association (HOA). A maintenance agreement shall also be submitted for review /approval by the County Attorney's Office. Also, the access easements (the alleys) on the plat should be `conveyed' to the HOA and a maintenance agreement shall also be submitted for review /approval by the County Attorney's Office. 2. [14- 303(E)] Dimension standards and information on all lots, streets, alleys, easements, and shared driveways. Easements shown for private streets and alleys shall be labeled as "private street easement ", "alley easement ". Also, the easement holder(s) shall be identified on the plat. Revise the plat as appropriate to address the above comment. 3. [14- 303(N)] Statement pertaining to private streets. Because the subdivision contains a private streets, the following statement must be added to the plat: "The streets in this subdivision may not meet the standards for acceptance into the secondary system of state highways and will not be maintained by the Virginia Department of Transportation or the County of Albemarle. " 4. [14 -317] Instrument evidencing maintenance of certain improvements. Because the subdivision contains one (1) or more improvements that are not to be maintained by the County or any authority or other public agency, the subdivider shall submit with the final plat an instrument assuring the perpetual maintenance of the improvement. Please submit a maintenance agreement for the proposed Open Space areas for review /approval by the County Attorney's Office. 5. [ZMA 2005 - 0007 /Approved Concept Plan] Within Block E all lots must be between 1,800 SF and 3,000 SF in size. However Lot 19 and Lot 18 are both below the 1,800 SF thresholds. Revise to bring each of these lots within the minimum size as specified in the rezoning. 6. [14 -400] Minimum lot requirements. Provide the plat with a notation of the required min lot sizes for each block per the Rezoning Approved Concept plan. 7. [14- 303(S)] Control points. Revise the exhibit sheet to show at least four (4) control points, evenly distributed across the property and located at survey property corners. At the option of the subdivider, the control points may be shown on a copy of the final plat, rather than on the original final plat. 8. [Comment] On sheet 1 of 3 the note; "Drainage Easements are shown on sheets 3 of 4" is inaccurate. As there are currently only 3 sheets associated with the plat. Revise if appropriate. 9. [14- 302(B)1] General information. Add a revision date to all future submittals. 10. [14 -435] Surety in lieu of completion of on -site improvements. This plat cannot be signed by the County until all necessary bonds have been posted. 11. [14- 216(B)5] On sheet 1 of 3 Note #13 states: `All new public street right -of -ways shown hereon are hereby Dedicated to Albemarle County, VA" However the statement needs to be revised to read: "All new public street right -of -ways shown hereon are hereby Dedicated to Public Use" 12. [14- 302(A)(9)] Building sites on proposed lots. On the plat provide the required note for buildable area. Provide the following note on the plat: "Parcel [letter or number] and the residue of Tax Map /Parcel [numbers] each contain a building site that complies with section 4.2.1 of the Albemarle County Zoning Ordinance. " 13. [14- 303(D)] Acreage of lots. In addition to the acres of each parcel, provide the square footage of the associated parcels. 14. [Section 14- 302B(5)] Zoning. Sheet 1 of 3 denotes the property as NMD zoning. However; the proffers associated with this site are also part of the zoning for the parcel. The proffers need to be referenced on the plat. 15. [Comment] This plat cannot be approved until RWSA, ACSA, and VDOT complete their reviews and grant their approval. Engineering and Zoning have reviewed the plat and their comments are provided below. Inspections, E911, and Fire /rescue have reviewed the plat and have no objections. Zoning — Rebecca Ragsdale 1. 1 recommend the proffers be on a sheet of the plat or a reference to them and also the code of development. 2. Proffer 1- Construction of Off -site Improvements- The deadline for completion of proffer 1A is April 3• 2013. Proffer 1 B, Stormwater Drainage to Powell's Creek, must be completed according to the proffer prior to the first building permit within Haden Place. 3. Proffer 2- Interparcel Connection to Summerford Lane- The deadline for construction of this connection is April 3, 2013. 4. Proffer 3- Vehicular Ingress /Egress- SDP 2007 -111 was approved to show bollards to prohibit this connection. VDOT should advise the applicant when the improvements have been completed to Killdeer /Jarman's Gap and the bollards may be removed. 5. Proffer 4- Future Dedication for Realignment of Killdeer Lane- A note should be on the plat regarding this proffer which could impact "Open Space B ". 6. Proffer 5 -Cash Proffers- This proffer will be met at the time of building permit for each unit. 7. Proffer 6- Affordable Housing- There should be a note on the plat regarding this proffer which requires Lots 14,15,16,21,22,and 23 to meet the affordability requirements of the proffer. 8. Proffer 7- Historic Resources- This proffer has been satisfied. 9. Proffer 8- 0verlot Grading Plan- Please confirm with the County Engineer if this proffer has already been met with SDP 2007 -111 (Sheet S3). 10. Setbacks- Note 5 regarding setbacks, and the table should at the bottom right of Sheet 1, should include a reference to the Haden Place Code of Development, dated February 5, 2007 and approved by 2 the Board of Supervisors February 14, 2007, for additional setback and other requirements (Sheets A6.1 -A6.3 of the plan /code of development). 11. Green Space /Amenities /Community Green- The Open Space of 1.35 acres shown in the Area Summary on Sheet 1 meets the minimum 20% for required Greenspace per the Code of Development. Greenspace and amenity areas must comply with all Code of Development requirements. The proposed plat does not show the Community Green, an approx. 2,828 required amenity per the code of development and that will be located central to Haden Place. Engineering — Michelle Roberge 1) Callout the stormsewer easements in Lot 28 and Lot 9. 2) Approval of the plat can only be recommended when improvements have been bonded per "14- 435 ". The applicant shall submit a request for a bond estimate. The requested estimates shall be for; - Erosion & Sediment Control per Water Protection Ordinance section 17 -207 - Stormwater Management per Water Protection Ordinance section 17 -306 - Subdivision (roads, drainage, etc.) per Subdivision Ordinance section 14 -435; & Water & Sewer per Subdivision Ordinance section 14 -435; $250 fee required E911 - Andrew Slack No objection Building Inspections - Jay Schlothauer No objection Fire and Rescue — Robbie Gilmer No objection VDOT — Joel DeNunzio Comments pending ACSA — Alex Morrison Comments pending RWSA —Victoria Fort Comments pending Please contact Christopher P.
