Additional comments or conditions may be added or eliminated based on further review.): [Each comment is preceded by the applicable reference, which is to the Subdivision /Zoning Ordinances unless otherwise specified.] [Comment] Please revise the chart provided on Sheet 3 to correct the density reflected in the 'remaining development available' row; the density reads 1.30 but it appears it should be 1.27. Please also include the open space provided in the 'Dedicated Open Space' column as all open space should be dedicated to the County. Rev1: Comment addressed. However, there is now a correction needed for the `cumulative density' figure in the `remaining development' row; the density of the entire subdivision is listed at 1.28 DUA, which exceeds the approved density, please verify and revise. Rev4: Comment addressed. 2. [14- 302(A)4 & 5] Private & Public easements. Label all existing easements with the deed book, page number and owner of record. Please also specify water, sewer, etc. instead of 'utility' on all easements. Rev1: Comment not fully addressed. Two easements from previous phases are still labeled `utility'; please specify the type of utility. As referenced in your comment response letter, this plat cannot be approved until the plat for Creekside III Phase Ilb -1 is recorded and all associated deed book and page references are added to this plat. Rev4: Comment not fully addressed. The two easements from the previous phase are still labeled `utility'; I am willing to approve the plat as is, if ACSA finds this acceptable. ACSA comments are still pending. 3. [14- 302(A)4 & 14 -317] Private easements & Instrument evidencing maintenance. The proposed landscape and sidewalk easements should be labeled as 'conveyed' to the Old Trail Community Association, not 'dedicated'. A maintenance agreement shall also be submitted for review; as with previous phases, a supplemental declaration should be sufficient. Rev1: Comment addressed. The supplemental declaration was approved by the County Attorney's office 7/19/12. 4. [14- 302(A)5] Public easements. Label the area for the greenway trail as a greenway easement in all areas where it crosses out of dedicated public land and into individual lots. This will result in a double ACSA Access / Greenway Easement in some areas. A Deed of Greenway Easement will also be required for these areas. Rev1: Comment addressed. However, the Deed of Greenway Easement is still under review and may require revisions. Comments will be forwarded once received. Rev4: Comment addressed. However, the Deed of Greenway Easement was forwarded to the County Attorney's Office on 11/13/12. Comments /approval are pending. 5. [14- 302(A)14] Land to be dedicated in fee or reserved. Provide a Deed of Dedication, for review by the County Attorney's Office, for the open space to be dedicated to the County. Rev1: Comment addressed. The Deed of Dedication was approved as to form by the County Attorney's office 7/19/12. 6. [14- 302(6)1] General information. Add a revision date to all future submittals. Correct the sheet reference on Sheet 2 to read `Sheet 2 of 3'. Provide the scale of the drawing. Rev1: Comment addressed. 7. [14- 303(C)] Boundary lines. Label the exterior boundary lines with bearings in degrees, minutes and seconds; the property line along the creek centerline is missing this information. Rev1: Comment addressed. 8. [14- 303(H)] Monuments. Provide the location and material of all permanent reference monuments. Rev1: Comment addressed. 9. [14- 303(1)] Bearing and distance ties. Provide a definite bearing and distance tie between not less than two permanent monuments on the exterior boundary of the property. Rev1: Comment addressed. 10. [14- 303(L)] Public utility, drainage and sight distance easements. Please provide a Deed of Easement for all drainage easements for review by the County Attorney's Office. Additionally, label all existing easements with the deed book and page reference. Rev1: Comment addressed. As indicated through email, no Deed of Drainage Easement is required. 11. [14- 303(0)] Signature panels. Remove the signature line for Old Trail Creekside 111, LLC; only the property owner signature is required. Rev1: Comment addressed. 12. [Comment] The `Tree Preservation Area', as shown on the approved preliminary plat, should extend behind lots 9 & 10; please label this area accordingly. Rev1: Comment addressed. However, please remove the `Hereby Dedicated to Albemarle County' portion of the tree preservation note; the subject land is a portion of the open space, which is already labeled for dedication. Rev4: Comment addressed. 13. [Comment] Note #8 refers to the table on Sheet 4; it appears it should say Sheet 3 instead. Rev1: Comment addressed. 14. [Comment] This plat cannot be approved until VDOT completes their review and grants their approval. Inspections, Parks and Fire /rescue have reviewed the plat and have no objections. Engineering and ACSA comments have been provided. Rev1: Comment still valid. Revisions were distributed, and this plat cannot be approved until VDOT and ACSA complete their reviews and grant their approval. Revisions were distributed; this plat cannot be approved until ACSA completes their review and grants approval. Engineering has reviewed the plat and has no objection. 15. [Comment] This plat cannot be approved until all bonds for this phase have been posted. Additionally, the Deed of Dedication, Deed of Drainage Easement and Deed of Greenway Easement must each be reviewed by the County Attorney's Office. Once the plat is approvable, the Deeds must be modified with the latest revision date and resubmitted for County Executive signature. The supplemental declaration must also be reviewed by the County Attorney's Office, but no County signature is required. The approved plat cannot be released until all associated documents are approved and signed. Rev1: Comment not fully addressed. As indicated above, it has been determined that no Deed of Drainage Easement is required. The supplemental declaration has been approved, the Deed of Dedication has been approved as to form, and the Deed of Greenway Easement is still under review. Once both deeds are approved as to form, and the plat is approvable, the Deeds must be resubmitted for signature as specified above. This plat cannot be approved until all bonds for this phase have been posted and all associated documents are approved and signed. Rev4: Comment not fully addressed. Bonds have been posted. The Deed of Dedication and Deed of Greenway Easement have been forwarded to the County Attorney's Office for review. If approved, they will be forwarded to the County Executive for signature. If they are not approved, or if any additional plat revisions are requested by ACSA, revised deeds must be submitted. Once all deeds and the plat are approved and signed, copies of the recorded deeds and supplemental declaration must be provided for the project file.
