Subject: SUB 201100090 Lots Y1 & Y2 - Final
The County of Albemarle Division of Current Development will recommend approval of the plat referenced
above once the following comments have been satisfactorily addressed (The following comments are those that
have been identified at this time. Additional comments or conditions may be added or eliminated based on
further review.): [Each comment is preceded by the applicable reference, which is to the Subdivision /Zoning
Ordinances unless otherwise specified.]
1. [14- 302(A)3] Existing or platted streets. Provide the width of all existing or platted streets.
Rev1: Comment not addressed.
2. [14- 302(A)12] Topography. Add topography information in conformity with this section should private street
approval be requested.
Revl: Comment not addressed. However, it has been determined that this information is not
required for this application.
3. [14- 302(8)2] Name of Plat preparer. Please add the name and seal of the plat preparer.
Revl: Comment addressed.
4. [14- 302(8)7] Reservoir watershed; agricultural - forestal district. Add a notation as to whether the land is
within an Albemarle County and /or City of Charlottesville water supply watershed or an agricultural - forestal
district.
Rev1: Comment not addressed.
5. [14- 303(N)] Statement pertaining to private streets. If the subdivision will contain one or more private
streets, add the following statement: "The streets in this subdivision may not meet the standards for
acceptance into the secondary system of state highways and will not be maintained by the Virginia
Department of Transportation or the County of Albemarle."
Revl: Comment not addressed.
6. [14- 303(Q)] Water supply. Add the following statement: "Under current county policy, public water and /or
sewer service will not be available to this property."
Revl: Comment not addressed.
7. [14- 303(R)] Parent parcel access. Provide the following statement, unless a waiver is granted as provided
in section 14 -404: "All subsequent divisions of the residue shall enter only onto such street(s) shown on the
approved final plat and shall have no immediate access onto to any public street."
Revl: Comment addressed. Neither parcel can be further divided.
8. [14- 303(S)] Control points. Provide at least four (4) control points, evenly distributed across the property
and located at survey property corners, and shown on each sheet depicting the property. At the option of the
subdivider, the control points may be shown on a copy of the final plat, rather than on the original final plat.
Rev1: Comment not addressed.
9. [14 -306] Private streets information. If authorization for one or more private streets is requested and has
not been previously approved as provided by section 14 -234, submit the information required to support
authorization under the applicable requirements of sections 14 -232, 14 -233 and 14- 234(A).
Rev1: Comment not addressed. However, it has been determined that for a private street in the rural
areas that serves only two lots, no formal request is required.
10. [14 -309 & 14 -310] Soil evaluations & Health director approval of septic systems. Submit the results of
percolation tests or other methods of soil evaluation used to determine the suitability of the soil for septic
systems with conventional drain fields, if septic systems are proposed to be used in the development of the
subdivision. These results shall be forwarded by the agent to the health director. [310] A final plat shall not
be approved if septic systems are proposed for the subdivision until written approval has been received from
the health director by the agent.
Rev1: Comment addressed. VDH approval has been granted.
11. [14 -316] Approval of entrance onto public streets. Submit evidence satisfactory to the agent that the
entrance of the principal means of access for each lot onto any existing or proposed public street complies
with Virginia Department of Transportation standards.
Rev1: Comment not addressed.
12. [14 -317] Instrument evidencing maintenance of certain improvements. If the subdivision will contain one (1)
or more improvements that are not to be maintained by the county or any authority or other public agency,
submit an instrument assuring the perpetual maintenance of the improvement as described in this section.
Rev1: Comment not addressed. Please submit a private street maintenance agreement for review
and approval by the County Attorney's Office. See section 14 -317 for more information on the
requirements of this document.
13. [14 -400 & 14 -403] Minimum lot requirements & Lot frontage. Each lot within a subdivision shall satisfy the
minimum lot requirements established in the zoning ordinance, and each lot within a subdivision shall have
frontage on an existing or proposed street. Lot Y2 does not have the required 250' (existing public street) or
150' (internal public or private street) lot frontage as required by Section 10.4. Given the existing frontage
limitations of TMP 87 -63B, the best way to obtain the required frontage is through a request for approval of
a private street under sections 14 -232 and 14 -234.
a) A request for a private street within the existing easement across TMP 87 -63 will require the
owner of that parcel to be party to the request, planning commission approval of the request as
demonstrated in Section 14- 232(A), and waivers of Section 14 -404 for both TMP 87 -63 and Lot
Y1 unless the existing driveways are closed.
b) A request for a private street using the existing driveway across Lot Y1 can be approved
administratively under Section 14- 232(8)2.
Rev1: Comment not fully addressed. It appears that Option B above is shown on the plat; if this is
what is proposed; please revise the "New 50' Access Easement" label to read "New 50' Private
Street Easement ".
14. [14- 404(A)] Single point of access required. Each lot, other than a corner lot within the development areas,
shall have reasonable access to the building site from only one street, shared driveway or alley established
at the same time as the subdivision; provided that, if the subdivision is in the rural areas, each lot created
from the subsequent division of any lot within the subdivision shall enter only onto such street(s) established
at the same time as the original subdivision and shall have no immediate access onto any other public
street. The proposed layout provides two points of access; this can be alleviated with the options discussed
in comment #14.
Rev1: Comment not fully addressed. Please clarify if a private street serving Lots Y1 and Y2 as
described in comment #13 Option B is what is proposed at this time. If so, please add a note stating
that Lot Y2 shall access the public street only through the new private street established with this
subdivision.
15. [14 -412] Standards for private streets only. In addition to the minimum design requirements set forth is
section 14 -410, the private street request must meet the minimum design requirements of this section.
a) A request for a private street within the existing easement across TMP 87 -63 must meet the
requirements of section 14- 412(A)2.
b) A request for a private street using the existing driveway across Lot Y1 must meet the requirements
of section 14 -412 (A)1.
Rev1: Comment not fully addressed. If a private street as described in #13 Option B above is
proposed, please add a note to the plat stating that the proposed private street meets the
requirements of Section 14- 412(A)1.
16. [14- 302(B)1] General information. The plat must include the initial application date as well as the date of all
revision submittals; please add the current (November 8, 2012) and any future revision dates to this plat.
