RE: SUB2008 -287 Fontana- Phase 4C- Preliminary Subdivision Plat
Dear Mr. Nichols:
Pursuant to Albemarle County Code § 14- 219(C), the above referenced preliminary subdivision plat has
been disapproved. The specific reasons for disapproval are provided with references to specific duly
adopted ordinances, regulations or policies, including the application plan approved for ZMA2004 -018
and ZMA2011 -001, and the proffers accepted in conjunction with the approval of these rezoning
applications. Required modifications or corrections that will permit approval of the preliminary
subdivision plat are included as well.
A. Reasons for disapproval
Final Grading Plan: A prerequisite to its approval, approval of the Final Grading Plan for
Fontana Phase 4C by the County Engineer, has not been obtained. This prerequisite is
contained in Proffer 2 to Zoning Map Amendment 2004 - 00018, and it states in part:
The Final Grading Plan shall be approved by the County Engineer prior to the
approval of the first preliminary subdivision plat.
Proffer 2 must be satisfied by obtaining approval of a Final Grading Plan that satisfies the
requirements of Proffer 2. A copy of the full text of Proffer 2 is attached hereto for your
information. To comply with Proffer #2 a Water Protection Ordinance and Erosion and
Sediment Control Plan must be submitted showing the requirements listed in Proffer #2,
and approved by the County Engineer. If you have further questions about the requirements
and information to be submitted, please contact Glenn Brooks, the County Engineer.
Preliminary Plat Deficiency: Albemarle County Code §14- 302.A.3 requires that the location
width and names of all existing or platted streets and all other rights -of way be provided on
the preliminary plat. Via Florence Road, Brunello Court, and Brunello Lane do not have the
right of way width labeled. In order to comply with this requirement, show the right of way
width for all of the proposed and existing streets.
3. Preliminary Plat Deficiency: Albemarle County Code §14- 302.A.11 requires the deed book
and page number of the instrument whereby the property was created, as recorded in the
office of the clerk of the circuit court to be listed on the preliminary plat. In order to comply
with this requirement, list the deed book and page number for the property.
4. Preliminary Plat Deficiency: Albemarle County Code §14- 302.B.5 requires that all proffers be
on the preliminary plat. All the proffers from ZMA2004 -018 and ZMA2011 -001 need to be
provided on the plat.
5. Preliminary Plat Deficiency: Albemarle County Code § 14- 302.A.14 requires that the
location, acreage, and current owner of all the land intended to be dedicated for public use,
or to be reserved in a deed for the common use of lot owners in the subdivision be shown
on the preliminary plat. The rezoning application plan for ZMA2004 -018 shows pedestrian
trails in Section 4C of Fontana that connect to a trail system in other sections of Fontana. In
order to comply with this requirement, the trails need to be shown on the preliminary plat.
B. For information only: issues to be addressed as conditions for final subdivision plat approval
and related recommendations
The following are provided for information only and are not the reason for disapproval of the
preliminary subdivision plat. If and when the preliminary subdivision plat is approved, the
following would be conditions for the final subdivision plat approval. Related recommendations
are also provided. The precise language of these conditions are subject to change when the final
subdivision plat is approved. Please note that these do not include all the final plat requirements
under Albemarle County Code §14 -206, nor do they include all the proffers that will need to be
met prior to final plat approval. The following comments are those identified for final plat at this
time.
1. Transportation: Albemarle County Code §§ 14 -316, 14 -410, and 14 -411 require Virginia
Department of Transportation approval. The following requirements for VDOT approval
must be met:
General
a. Show traffic projections. Road widths should be adequate for projections based on
standards in VDOT Road Design Manual Appendix A. Roads with curb and gutter must
be at least 29' wide to accommodate parking on both sides.
b. Show vertical alignments.

a. Curb ramps will be needed at the intersection of Fontana Drive and Brunello Court.

a. Horizontal curve radii need to be at least 200' to meet VDOT Road Design Manual
standards.
b. Water lines should cross cul -de -sacs at no greater than a 45 degree angle.

a. Trees should be planted a minimum of thirty feet from the end of the intersection
radius.
Sheet C6.1.0
a. VDOT Pavement Design Guide specifies that there should be a maximum of 1.5 inches of
SM -9.5A asphalt, or 2inches only if lifted twice.
Fire protection: Albemarle County Code §14 -418 requires the final plat not to be approved
without approval from Fire and Rescue. The following requirements for Fire and Rescue
approval must be met:
a. Belluno Lane shall have a 20 foot travelway face of curb to face of curb

The following comments and recommendations are provided for information only and are not
reasons for disapproval of the preliminary subdivision plat.
Zoning recommendation for the sequence of events that need to occur: The relevant
proffers are included in an attachment and are #2, 5 and 8 from ZMA 2004 -018. Proffer #10
was revised with ZMA 2011 -01. While proffer #5 is entitled "Pedestrian Paths," it speaks to
a requirement prior to issuance of the 9t" building permit and is superseded by the other
proffers with triggers which occur first.
Reading proffers #2, 8 and 10, here is the recommended order of requirements:
i. Owner completes all bonded improvements, including paths, stormwater
management and erosion control, in phases 1, 2, 3, 4A and 4B. County releases the
bonds.
ii. Owner submits a final grading plan for phase 4C that meets requirements of proffer
#2. This shall only occur after #1 in the preceding (proffer #8).
iii. The County Engineer approves the final grading plan (per proffer #2 requirements).
iv. County may approve first preliminary plat in phase 4C (proffer #2).
V. The County Engineer may issue the grading permit for phase 4C (proffer #10).
You may obtain reinstatement of review as provided by Albemarle County Code § 14- 219(C). A
reinstatement fee of $520 must be included with the resubmittal of the plat along with the attached
revised application submittal form. If a revised plat and fee are not received within 15 days, the plat
shall be deemed to be disapproved and a new application and fee shall be required for submittal of the
plat.
In accord with Albemarle County Code § 14 -226, this decision may be appealed.
