Perez, Senior Planner Division: Planning Date: December 14, 2012 Subject: SUB 2012— 00125 Haden Place- Final Subdivision Plat prior to a Preliminary Fax 434 - 972 -4126 The County of Albemarle Planning Division will approve the plat referenced above once the following comments have been satisfactorily addressed (The following comments are those that have been identified at this time. Additional comments or conditions may be added or eliminated based on further review.): [Each comment is preceded by the applicable reference, which is to the Subdivision /Zoning Ordinances unless otherwise specified.] 1. [14- 302(A)4 & 14 -317] Private easements & Instrument evidencing maintenance. The private street easement for Haden Place (private road) should be `conveyed' to the Haden Place Homeowners Association (HOA). A maintenance agreement shall also be submitted for review /approval by the County Attorney's Office. Also, the access easements (the alleys) on the plat should be `conveyed' to the HOA and a maintenance agreement shall also be submitted for review /approval by the County Attorney's Office. Rev1. Documents for County Attorney review have not yet been received. 2. [14- 303(E)] Dimension standards and information on all lots, streets, alleys, easements, and shared driveways. Easements shown for private streets and alleys shall be labeled as "private street easement ", "alley easement ". Also, the easement holder(s) shall be identified on the plat. Revise the plat as appropriate to address the above comment. Rev1. While the private street easements have been correctly labeled, it appears the "alley easements" are still incorrectly labeled as "access easements." Revise plat to correctly label easements as "alley easements ", including reference in note #17. 3. [14- 303(N)] Statement pertaining to private streets. Because the subdivision contains a private street, the following statement must be added to the plat: "The streets in this subdivision may not meet the standards for acceptance into the secondary system of state highways and will not be maintained by the Virginia Department of Transportation or the County of Albemarle. " Rev 1. Comment addressed. 4. [14 -317] Instrument evidencing maintenance of certain improvements. Because the subdivision contains one (1) or more improvements that are not to be maintained by the County or any authority or other public agency, the subdivider shall submit with the final plat an instrument assuring the perpetual maintenance of the improvement. Please submit a maintenance agreement for the proposed Open Space areas for review /approval by the County Attorney's Office. Rev1. Documents for County Attorney review have not yet been received. 5. [ZMA 2005 - 0007 /Approved Concept Plan] Within Block E all lots must be between 1,800 SF and 3,000 SF in size. However Lot 19 and Lot 18 are both below the 1,800 SF thresholds. Revise to bring each of these lots within the minimum size as specified in the rezoning. Rev 1. Comment addressed. 6. [14 -400] Minimum lot requirements. Provide the plat with a notation of the required min lot sizes for each block per the Rezoning Approved Concept plan. Rev 1. Comment addressed. 7. [14- 303(S)] Control points. Revise the exhibit sheet to show at least four (4) control points, evenly distributed across the property and located at survey property corners. At the option of the subdivider, the control points may be shown on a copy of the final plat, rather than on the original final plat. Rev 1. Comment addressed. 8. [Comment] On sheet 1 of 3 the note; "Drainage Easements are shown on sheets 3 of 4" is inaccurate. As there are currently only 3 sheets associated with the plat. Revise if appropriate. Rev 1. Comment addressed. 9. [14- 302(B)l] General information. Add a revision date to all future submittals. Rev 1. Comment addressed. 10. [14 -435] Surety in lieu of completion of on -site improvements. This plat cannot be signed by the County until all necessary bonds have been posted. Rev 1. Pending. 11. [14- 216(B)5] On sheet 1 of 3 Note #13 states: `All new public street right -of -ways shown hereon are hereby Dedicated to Albemarle County, VA" However the statement needs to be revised to read: "All new public street right -of -ways shown hereon are hereby Dedicated to Public Use" Rev 1. Comment addressed. 12. [14- 302(A)(9)] Building sites on proposed lots. On the plat provide the required note for buildable area. Provide the following note on the plat: "Parcel (letter or number) and the residue of Tax Map /Parcel [numbers) each contain a building site that complies with section 4.2.1 of the Albemarle County Zoning Ordinance. " Rev 1. Comment not appropriately addressed. Revise note #16, if appropriate, to note that each lot in the subdivision contains a building site... 13. [14- 303(D)] Acreage of lots. In addition to the acres of each parcel, provide the square footage of the associated parcels. Rev 1. Comment recanted. 14. [Section 14- 302B(5)] Zoning. Sheet 1 of 3 denotes the property as NMD zoning. However; the proffers associated with this site are also part of the zoning for the parcel. The proffers need to be referenced on the nlaf Rcv 4 r nmmcnf mrlrlrncsed. 15. [Initial Comment #15 Revised] This plat cannot be approved until ACSA and VDOT complete their reviews and grant their approval. Engineering has reviewed the plat and their comments are provided below. Inspections, E911, Zoning, RWSA, and Fire /rescue have reviewed the plat and have no objections. Comments are pending from ACSA, once received staff will forward them to the applicant. 16. [New Comment] As you know there is an "offsite site - distance easement" on an adjacent owner's property (TMP 56 -8A). The County received the blank sight distance easement which the County Attorney has commented on. The offsite site - distance easement does not appear to be accurately reflected on the Haden Place final subdivision plat? (/0 the applicants intent is to depict/obtain the offsite site distance easement on the final subdivision plat for Haden Place additional information will be required to be placed on the plat per the ordinance. Please advise if this is your intent. (If) it is your intent to obtain the offsite easement through a separate plat w/ associated deed, the plat will need to be reviewed, approved, and recorded prior to this subdivision plat for Haden Place can be approved. If this is the applicant's intent, also assure the deed book and page reference of the easement is provided on the final subdivision plat for Haden Place. 2 Zoning — Rebecca Ragsdale 1) All of the Zoning /Proffer comments made in my 11/13/12 memo have been addressed on the plat or either acknowledged by the applicant in their review comment letter. Proffer 3 had been satisfied. The applicant noted Proffer 8 had been confirmed at site review by Engineering. Engineering — Michelle Roberge 1) Approval of the plat can only be recommended when improvements have been bonded per "14- 435 ". The applicant shall submit a request for a bond estimate for the following: - Subdivision (roads, drainage, etc.) per Subdivision Ordinance section 14 -435; & Water & Sewer per Subdivision Ordinance section 14 -435; $250 fee required E911 - Andrew Slack Approved Building Inspections - Jay Schlothauer No objection Fire and Rescue — Robbie Gilmer No objection RWSA —Victoria Fort No objections VDOT — Joel DeNunzio Comments pending ACSA —Alex Morrison Comments pending Please contact Christopher P.
