Subject: SUB 2008 -287 Fontana Phase 4 C Preliminary Plat
Thank you for giving me the opportunity to review this plat. I have several comments and
suggestions. The notes on the plat will help inform buyers and will help us administer and enforce the
proffers.
1. As you are aware, the developer is currently disputing the pedestrian paths and does not wish
to complete them. ZMA 2011 -001 Fontana Phase 4C states "...These paths shall be
completed to the satisfaction of the County Engineer prior to grading in Phase 4C." Please
pass this information on to the Review Engineer for the WPO, so a grading permit is not
issued until either this proffer is met or it is amended.
It is appropriate for any pedestrian paths within phase 4C to connect to the path system for
Fontana. I haven't reviewed it for this. I recommend a note on the final plat per proffer #5
and the new trails within phase 4C: "The Owner shall not request that the County issue
the ninth (9th) building permit until the paths have been completed to the satisfaction of
the County Engineer."
2. It does not appear the proffer #4 of ZMA 2004 -018 is met. The plan does not appear to
indicate any existing trees. Please also make the Review Engineer for the WPO aware that a
tree conservation plan is required to be approved prior approval of the e &s plan. I recommend
that the required new trees be bonded prior to signature / final approval of the final plat.

certificate of occupancy until a final zoning inspection is performed and all required
trees are in place."
3. Please be advised that per proffer #8, "The Owner shall not submit an application for an
erosion and sediment control permit for grading until improvements have been completed for
phases 1, 2,3 and 4A and 413 of the Fontana Subdivision and all bonds held by the County in
conjunction with subdivision, stormwater management, and erosion control for prior phases
have been released by the County.
4. 1 recommend a note on the plat per proffer #9: The colors for the fagade treatments and
the colors and materials for the roofs shall be subject to prior approval by the Director
of Planning."
5. The Cascadia Connector needs to actually connect to the road. If the roadway has shifted
from the recorded access easement, it will need to be extended.
6. Proffer #2 basically calls for an overlot grading plan. The Review Engineer will need to
determine if the plan submitted meets the criteria of this proffer.
7. The cover sheet note regarding the rezoning should also list ZMA 2011 -001.
