Subject: SUB 2012 —00094 Willow Lake View — Final (lots C1 -C8, Al, A2, and Common Area)
The County of Albemarle Division of Current Development will grant or recommend approval of the Final
plat referenced above once the following comments have been addressed: [Each comment is preceded
by the applicable reference, which is to the Subdivision /Zoning Ordinances unless otherwise specified.]
1) [Condition of Approval SUB2010 -156 #1] Provide the following note: "All grading shall be in
general accord with the grading shown on the plat titled "Willow Lake View Preliminary
Subdivision Plat" (SUB2010- 00156) last revised 23 March, 2011. Grading for lots Cl and C2 shall
be performed at the same time. Grading for lots C7 & C8 shall be performed at the same time.
Grading for lots C3, C4, C5, and C6 shall be performed at the sometime. Grading for lots Aland
A2 may occur individually." Please revise. REV 1. Comment addressed.
2) [Condition of Approval SUB2010 -156 #2] The final plat must show easements necessary to
allow grading to occur in accord with condition #1. Thus the grading easements for each of the
lots shall be larger and encompass all grading to occur on the lots. Revise. REV 1. Comment
addressed.
3) [Condition of Approval SUB2010 -156 #3] It appears that the location of the proposed 15' access
easement to the recreation & common area does not match the location as shown on
preliminary plat? Revise the access easement to match preliminary plat, which depicts this
easement on the property line of C1 and C2 and more in conformity with the new temp grading
easement. Rev2. Comment has not been addressed.
4) [Condition of Approval SUB2010 -156 #4] The final plat must depict the shared driveways for
access as shown on the preliminary plat. Please depict these access ways on the final plat. REV
1. Comment addressed.
5) [14- 303(E)] Provide the dimensions of the shared driveway easements on the final plat. These
easements must also be labeled as "shared driveway easement" and the easement holder(s)
shall be identified on the plat. Also on the plat provide a note stating "The maintenance of the
shared driveway easements shall be by the owners of the lots affected by the shared driveway
easement, not by the Virginia Department of Transportation or the County." REV 1. Comment
addressed.
6) [14 -317] Provide maintenance agreements for each of the "shared driveways "; these will be
submitted for County Attorney review and approval. To aid in the development of these docs, I
have attached a shared maintenance agreement template. Rev 1. Per discussions with applicant
the County is in agreeance that the only true "shared driveway" is for Lots C1 and C2. Please
provide the required documentation for County review.
Rev2. County awaits these documents for review /approval.
7) [14 -316] The subdivider shall submit, prior to or with the final plat, evidence satisfactory to the
agent that the entrance of the principal means of access for each lot onto any existing or
proposed public street complies with Virginia Department of Transportation standards. Rev 2.
Comment has not been addressed. Comments from VDOT are pending. Please contact VDOT to
follow up on this item.
8) Lt-onumun or Hpproval SUB2010 -156 #5] The final plat must depict the 100' stream buffer for
the normal pool of Willow Lake. Please revise to show the buffer on all applicable lots. Also,
pursuant to section 14- 303(1) of the subdivision ordinance, on the plat provide a note which
explains why the buffer has been provided as shown, ie. Planning Commission Condition of
4pproval #5, dated... REV 1. Comment addressed.
9) [Comment] The final plat attempts to extinguish the 5' wide sidewalk easement located on Lot
C6 and C7. In order for this to be done the HOA needs to sign off on this, or have this vacated
on some other plat because these owners do not own the easement. Rev 1. Per discussions with
the applicant they intend to put this item in the deed and have the HOA who owns the
easement sign the deed. Awaiting deed work for County review.
Rev 2. 1 have since discussed the vacation /extinguishing of the 5'sidewalk easement with the
Agent and have been advised that the previous arrangement /discussion noted above will not
suffice for his approval. Per the Agent there are four ways to accomplish the proposed
extinguishing of the existing 5'sidewalk easement (see below):
A) The existing Willow Lake Property Owners Association (owners of the easement) shall
sign this plat, which provides agreement to the extinguishment of the 5" sidewalk
easement.
B) The existing Willow Lake Property Owners Association (owners of the easement) can
sign another plat extinguishing the easement; this will need to be set to record and the
DB page ref info shall be noted on the final sub plat before the final sub plat can be
approved.
C) A deed extinguishing the 5'sidewalk easement shall be signed by the existing Willow
Lake Property Owners Association (owners of the easement) and this deed shall be set
to record and the DB page ref info shall be noted on the final sub plat before the final
sub plat can be approved.
D) The 5' easement shall remain and no extinguishing of the easement will take place.
Please advise how you wish to proceed.
10. [14- 303(G) & ZMA1984 -01] With regard to the portion of TMP 77E1 -1 -B deemed "Common
Area" to remain undeveloped, per condition #9 of the proffers from ZMA1984 -01 (see attached
document) thus this area shall be in ownership of a "Willow Lake Property Owners Association ". Is
this the intent of the developer? Rev 2. Per discussions with the applicant, they intend to put this
section of the property in a "Willow Lake Property Owners Association ". Awaiting deed work for
County review.
11. [Condition of Approval SUB2010 -156 #1(c)] Provide the open space maintenance documents
for review and approval by the County Attorney. If these have already been approved, provide
approval letter and a copy of the documents for the file. To aid in the development of these docs, I
have attached a template. Rev 2. Comment has not been addressed. Awaiting documents for
County review.
12. lComment] The final plat has a note on sheet 2 and 3 which states "This plat not for
recordation..." Revise appropriately; such as omitting the note on sheets to be recorded as well as
revisions of the sheet numbers depending on how many sheets will be included in the plat to be
recorded. REV 1. Comment addressed.
13. [14 -414] Public water and sewer are required for this development. Install the utilities [14 -434]
or bond the installation [14 -435] prior to approval of the plat. Rev 1. Comment will be
addressed prior to approval of the final plat.
14. [14- 302B(8)] On the plat the setbacks listed in note "H" incorrectly lists side yard setbacks as
15', these setbacks are actually 10'. Please revise. REV 1. Comment addressed.
15. [14- 302B(5)] On the plat under the zoning of the properties, please provide the rezoning
information for ZMA1984 -01 w/ proffers. REV 1. Comment addressed.
Engineering - Michael Koslow
1. Location of proposed for 15' access easement to recreation & common area does not match location
shown on preliminary plat. Require the access easement to match preliminary plat per April 5, 2011
Planning Commission condition of approval of critical slope waiver request for this parcel. That
easement appears to be coincident with the lot line between proposed lots C1 and C2.
2. Please identify apparent sanitary sewer manhole located approximately 3/4 of the way from Willow
Lake Drive to Willow Lake in proposed lot C6.
3. Recommend improvements to existing drainage swales in lots C6 and C7 which contain excessive gully
erosion (greater than 2' deep of gullies). These improvements will be a requirement for land
disturbance permits associated with construction on these proposed lots.
