Please have the applicant clarify. Are the plat and grading exhibit showing something new? What is the change requested? If it is only the new uses, why are the exhibits included? If they are needed, please clarify why, and show the correct 100' stream buffer. Current comments of 28 Jan 2013 I am in receipt of the letter of Dec 13, 2012, and email of 24 Jan 2013. I am still not clear on what is proposed. The documents talk about commitments to plan details, and then indicate that the plan is not a commitment because it is not proffered. I understand the applicant wants to revise existing proffer 2 for different uses. I have not seen any proposed proffers. The proposed uses would not necessarily require engineering comment, unless traffic and parking necessitate site changes. Without any proffers, and without a plan, I don't understand how anything is proposed. There are only statements of intentions. For example, the letter indicates, "our development is sensitive to the floodplain and to the stream located on the lower edge of the property; we intend to both mitigate and enhance the buffer along the stream and Greenways." I don't understand how this could be possible. It was not on the original rezoning. Almost the entire property is constructed of imported fill, most of it in the floodplain and buffers. (The buffer on Moores Creek is still shown incorrectly.) How can a buffer and floodplain which have been mostly removed, be mitigated and enhanced? file: E2 nna GEB 5thStreetCom.doc
