Subject: SP 2013 -001 Riverside Village Fill in the Floodplain — initial comments
I've reviewed this initial submittal and have the following comments:
1. This application seems to assume the foundations for the dwellings can be located in the
floodplain and that is not permitted under the FHOD. Dwellings are explicitly prohibited in the
floodplain because they are habitable space {Section 30.3.04 (4) Structures designed or
intended for human habitation, including mobile homes, regardless of proposed usage}
FEMA defines habitable as: "an enclosed area having more than 20 linear feet of finished
walls (paneling, etc.) or used for any purpose other than solely for parking of vehicles, building
access, or storage."
The foundation is considered part of the use /structure of the dwelling and is not separately
permitted within the FHOD.
2. Exhibit 2A shows a building that appears to be a dwelling in the FHOD and this is not
permitted;
3. Exhibit 2B also shows a park pavilion in the FHOD and this is considered a habitable structure
and is also not permitted. If the applicant wishes to contest this, please have him contact me.
In addition, this exhibit refers to River Road and I don't think that's the correct road name.
