The County of Albemarle Planning Division will recommend approval of the plat referenced above once the
following comments have been satisfactorily addressed (The following comments are those that have been
identified at this time. Additional comments or conditions may be added or eliminated based on further review.):
[Each comment is preceded by the applicable reference, which is to the Subdivision /Zoning Ordinances unless
otherwise specified.]
[14- 302(A)4 &5] Private and public easements. Provide the location and dimensions of all existing and
proposed private and public easements. Existing easements shall be labeled with the deed book and page
number and owner of record. The deed book and page number for all existing easements must be provided
before this plat can be approved. The drainage easement in Phase I must match what is approved with the
recent Letter of Revision. Show the alley easement that runs behind the Phase I townhomes.
Rev1: Comment not fully addressed. Please show the alley easement that runs behind the Phase I
townhomes. It also appears that the DB and PG reference for the Phase I subdivision and many of
the easements should be DB 4308 PG 239; PG 249 was for the deed of drainage easement.
2. [14- 302(A)l5] Identification of all owners and certain interest holders. Provide the name of the holders of
any easements affecting the property.
Rev1: Comment not fully addressed. Provide the name of the holders of all private easements
affecting the property.
3. [14- 302(B)l] General information. It appears that this submittal is not printed to scale. When the signature
copy is submitted, it must be a properly scaled plat.
Rev1: Comment still valid for signature submittal.
4. [14- 302(B)8] Yards. Commercial buildings in Block 2 have a 5' "build to" from street, a 5' side setback and
a 10' rear setback. It appears that all setbacks are shown at 5'. Please correct the rear setback and label
all setbacks, or list the setback information on the Cover Sheet.
Rev1: Comment not fully addressed. The `front' of the commercial parcels is Belvedere Blvd and the
`rear' is the parking lot, so it appears the setbacks are reversed. However, upon further
investigation, I discovered that the preliminary and final site plan were approved showing 5'
setbacks for both the `front' and `rear'. There were several variations approved that modified
setbacks and layout, so perhaps this plat should reverse my previous request and show a 5' setback
for both.
5. [14- 303(D)] Acreage of lots. The acreage of the private right -of -way should be part of Phase I. Please
revise the information provided to indicate a starting acreage that already has the right -of -way area
subtracted.

acreage that already has the right -of -way area subtracted. Additionally, it seems that the acreage
provided for Phase III double counts the 0.015 acres being transferred to the right -of -way; please
verify and revise.
6. [14- 303(G)] Ownership of common areas. Provide the intended ownership of all common areas.

7. [14 -317 & Condition of Preliminary Approval] Instrument evidencing maintenance of certain
improvements. Please provide an instrument for the maintenance of privately owned improvements for
review by the County Attorney's office. This instrument should also provide some information regarding how
the `common area' parking lot is to be shared among the various users.
Rev1: Comment not fully addressed. The County Attorney's Office has reviewed the Supplemental
Declaration and approved it with edits (edits will be forwarded). Once the plat is approvable and the
edits have been completed, please resubmit (with correct `last revised' date) for final approval.
8. [Belvedere Code of Development] The Code of Development indicates that the 8' multipurpose trail is to
be within the right -of -way of Belvedere Boulevard. Through work on other projects in Belvedere, it has
come to light that the trail strays outside of the right -of -way in many places. In order to ensure future VDOT
maintenance of this trail, please verify that the portion that runs along the front of the Town Center is entirely
outside of this parcel (minimum 1' outside of the trail edge). If portions are within this parcel, a boundary
line adjustment will be required to increase the right -of -way to a minimum of 1' outside of the trail.
Rev1: It appears that this comment has been addressed. However, VDOT comment is still pending.
9. [Comment] This plat cannot be approved until all reviewers grant their approval. Inspections, Fire rescue
and E911 have completed their reviews and have no objections. Engineering comments have been
provided. VDOT and ACSA comments, if any, will be forwarded upon receipt. Additional road bonds must
also be posted prior to Final Plat approval.

10. [Comment] This plat cannot be approved until the plat for Phase I has been approved and recorded.
