Adam,
I have reviewed the LOR and, unfortunately, there is an issue. This exhibit notes that the 'edge of the alley easement
closest to the building is on top of the alley edge of pavement'. This would give a maximum alley easement of 18'.
There is also a label that says 'variable width alley access easement'. Alley Easements are required to be a minimum of
20' wide, and the preliminary, final and all subsequent modifications of the site plan have shown it that way. So, the
proper easement line needs to be shown as well as the correct 10' building setback line. It appears that once the correct
setback line is shown, the proposed decks may extend too far into the setback (the decks haven't been shown on any
previous site plan). Additionally, engineering said that if the decks have support posts, they cannot be within the sight
distance area (from 2' off the ground to 8' off the ground) in the 7' minimum driveway length (7' in from the edge of the
alley pavement). All of these changes need to be made (with support posts noted) before the LOR can be approved. As I
said before, and especially given that there is a retaining wall within the 20' alley easement that will prevent cars from
access to any sort of overhang space, shortening these driveways is going to make for a very tight site ... there isn't
anything in the ordinance that requires a longer driveway, but I do think the entire situation should be given
consideration.
I also noticed a couple of other things that should be corrected:
1. The plat refers to a 50' R/W in front of the townhouses, when it should say variable width as approved with
LOR #1 (See attached)
2. The DI and easement next to Lot 19 has been modified from what is shown and has an offset easement (5' on
the townhouse side and 15' on the road side as approved with LOR #2 (see attached). It appears the surveyor
must be working with an old file that doesn't shown this change, this must be accurately reflected.
3. The garage elevations shown on lots 11 -15 appear to be incorrect.

I haven't received the LOR yet, it usually takes a day or two for things like that to get to my mailbox. I will try to review it
as quickly as I can once I receive it. Rebecca can't process the permits until it's officially approved, so unfortunately it
can't happen immediately. Rebecca is gone for the day, but I will try to locate the LOR on Monday and get my review
completed.

Any word from Ron today? Scott Collins confirmed to me that the shared parking determination was based on 2 parking
spaces per townhome, which will be accommodated by the garages.
I'd like to submit the LOR tomorrow, and I'm hoping that the building permits can be approved this week.

Adam,
I checked with Engineering and I think they have a minimum driveway length of 7' (for safety reasons), so make sure the
modification allows for at least 7' from the edge of pavement. I also spoke with David to make are there aren't any
planning issues I'm overlooking and he doesn't seem to think there are. So, as long as Ron didn't consider parking in the
driveways as part of his shared parking determination, it should be fine to reduce the driveway length. As an aside, I
don't think it's a good idea and will eventually cause issues with residents trying to parking in their driveways but I guess
the code doesn't have any provision to cover this.
Once I get the official word from Zoning, I'll let you know. If it's fine to move forward, you will need to submit a LOR.
The exhibit you submitted to Rebecca for the permits is fine, but you will need to submit a copy with the LOR
application and fee. It's just a way of documenting all changes that occur to any approved site plan, and it should be a
quick and easy review since we will have worked out the questions ahead of time.

I've attached the shared parking approval letter. I have reached out to Collins for more info, but I'm pretty sure that the
analysis is based on each townhouse parcel contributing 2 parking spaces via the garages (at least that's my
interpretation of the info on the site plan cover sheet). Thus, we did not assume any parking in the driveways.
Also, I'd like to point out that the driveways for townhouse lots 1 -10 were approved as 11' -13' in length on the site plan,
so it seems that 13' -15' driveways as currently proposed for townhouse lots 11 -19 should be acceptable as well.
If they are deemed OK, let me know if we need to do a LOR or if the information provided with the permit application
will suffice from a documentation standpoint.

I'm looking in to the parking /driveway issue. Apparently there was a shared parking agreement approved for this site,
so Rebecca is checking with Ron to determine how he made the call on that agreement. It may not be today, but I will
get back to you as soon as I hear something back from Zoning.
