Here is wording that should be used to revise Note #20 on the plat for Haden Place:
Upon the request of Albemarle County, a fifty (50) foot wide portion of the open space area shown as "Open
Space 8'; shall be dedicated to public use, as a necessary, for future realignment of Killdeer Lane.

Rebecca,
Per discussions with the Subdivision Agent on the Final Subdivision Plat for Haden Place and Note #20: it has been
suggested that the current wording of the note is inadequate for enforcement purposes and needs to be revised. The
agent made note that it is Zoning's call as to how the language is worded but he feels in its current state it is inadequate
and does not provide reasonable interpretation of the intent of the Code of Development and Proffer #4. 1 provide the
following as drafts of potential language to be used to revise Note #20 on the plat:
"Per General Development Plan by Dominion Development Resources dated Sept 21, 2006 and revised Feb 5, 2007, the
conceptual location for future realignment of Killdeer Lane may impact Open Space B at a future date, as such the open
space area depicted on the final site plan as Block J and depicted on the final subdivision plat as Open Space B is reserved
for dedication upon demand of the County"
OR
"Pursuant to Proffer 4 of ZMA2005 -0007 Block J (labeled on the final subdivision plat as Open Space B) is reserved for
dedication upon Demand of the County"
