The agent made note that it is Zoning's call as to how the language is worded but he feels in its current state it is inadequate and does not provide reasonable interpretation of the intent of the Code of Development and Proffer #4. 1 provide the following as drafts of potential language to be used to revise Note #20 on the plat: "Per General Development Plan by Dominion Development Resources dated Sept 21, 2006 and revised Feb 5, 2007, the conceptual location for future realignment of Killdeer Lane may impact Open Space B at a future date, as such the open space area depicted on the final site plan as Block J and depicted on the final subdivision plat as Open Space B is reserved for dedication upon demand of the County" OR "Pursuant to Proffer 4 of ZMA2005 -0007 Block J (labeled on the final subdivision plat as Open Space B) is reserved for dedication upon Demand of the County" Let me know how you wish to proceed, the blue version or the red version, the choice is yours.
