Dear Mr. Myers:
Staff has reviewed your initial submittal to establish outdoor sales /storage /display of automobiles
in association with a new Price Hyundai auto dealership. Our questions and comments are listed
below. Many of the comments identify issues that will need to be addressed with your future site
plan submittal, but some comments need to be addressed with a revised plan before we can
recommend approval and forward your proposal to public hearing. Those that need to be
corrected prior to public hearing are the parking calculations and the related zoning issues (all
detailed under "Zoning" below) and resolution of issues related to parcel 1116 (see Current
Development comment #3 and the map attached to this letter). As you resolve the parking count
issues, you may also find it most useful to resolve the parking stall sizes at this time (see
Engineering comment #2). We would be glad to meet with you to discuss these issues. Our
comments are provided below:
Planning
Initial comments on how your proposal generally relates to the Comprehensive Plan are provided
below. Comments on conformity with the Comprehensive Plan are provided to the Planning
Commission and Beard of Supervisors as part of the staff report.
The Comprehensive Plan shows this area as commercial mixed use in Neighborhood 2. This
designation includes community and regional retail, commercial service, and auto
commercial service as primary uses. The proposed use is similar in type and scale to the
designated uses. The Comprehensive Plan (Chapter 2, Natural Resources and Cultural
Assets) establishes the goals for preserving the scenic resources that are essential to the
County's character, economic vitality and quality of life. The Entrance Corridor Overlay
District is intended to support that goal by maintaining the visual integrity of the County's
roadways. The Architectural Review Board addresses potential adverse aesthetic impacts in
the Entrance Corridors by applying the County's Entrance Corridor Design Guidelines
during their review of development proposals. The ARB has reviewed the subject request
for conformance with the Design Guidelines and forwarded a recommendation of "no
objection" with conditions to the Planning Commission.
Zoning
The following comments related to zoning matters have been provided by Francis MacCall:
1. Per the numbers of display spaces provided on the plan the use of the auto dealership
requires a total of 47 spaces. The office use and the over the counter sales use are not
used in calculation the auto dealership use thus should be removed
The required parking for the auto dealership should be reflected as follows:
Automobile service station: One (1) space per each employee plus two (2) spaces per each
service stall.

Motor vehicle sales, including automobiles, farm equipment and trucks: One (1) space
per one thousand five hundred (1,500) square feet of display area. Spaces for customers
shall be clearly delineated on the ground, signed and maintained for customers only.

Please clarify where the area of display for the SHOWROOM / GLASS DISPLAY AREA:
6,130sf is located. The note of "DISPLAY PARKING" between the building and the 6'
sidewalk does not add up to 6130sf but only 4144sf. Where is the additional area of
outdoor display? Adjust the calculation above as needed.
3. The amount of total parking provided that is shown for "CUSTOMER PARKING" and
"EMPLOYEE PARKING" exceeds the amount permitted for the proposed auto dealership.
The requirement for the use is 47 parking spaces and there are 72 spaces shown as non -
display parking. You would be permitted to have 20% more that the required parking
which would be 9 spaces for a total of 56 spaces designated for this use. Adjust the
numbers above as needed.
4. If this plan is going to be used as the concept plan for the proposed use then the area that
is subject to the SP should be clearly identified by outlining the area with thicker line or a
"bubble" line so that it is clear what conditions apply to this use. The other uses and
parking should not be construed to be approved with this plan.

5. The parking calculations on the left of the plan should only reflect the proposed use for this
concept plan. The reference on the plan to the "BANK & RESTAURANT PARKING" spaces
can remain but should be noted to the left that they are not part of the calculation and are
not intended to be used by the auto dealership.
Current Development
The following comments regarding your proposal's ability to meet site plan or subdivision
ordinance requirements in the future have been provided by Ellie Ray:
I have reviewed the concept plan for the above noted application and offer the following
comments in regards to site plan requirements (The following comments are those that have
been identified at this time. Additional comments or conditions may be added or eliminated
based on further review.): (Each comment is preceded by the applicable reference, which is to
the Subdivision /Zoning Ordinances unless otherwise specified.]
1. [Comment] The previously approved site plan must be amended to reflect the new
proposal.
2. [Comment] It appears that a 24' access easement is provided for this site through the
previous phase. For reference, should any of the phases be subdivided a minimum -30'
private street easement would be required, and private street approval would be r
necessary for frontage for any potential divisions.
3. [32.5.2(a)] The boundary information provided does not include reference to TMP
045000000111130; all existing parcels should be referenced.
4. [32.5.2(a)] Information should be provided regarding the waiver granted for disturbance
of critical slopes, including the associated conditions of approval, by reference to the
approval letter for SDP 200400045 dated October 28, 2005.
5. [32.5.2(b) & 4.12.4(a)] The number of parking spaces provided may not exceed the
number of spaces required by more than twenty (20) percent. The required parking
calculations should be approved by Zoning during site plan review. Some of the
calculations provided appear to be incorrect.
6. [32.6.2(]) & Comment] Many of the proposed plantings appear to have site conflicts.
Some are in utility easements and some are directly on top of proposed utilities and
drainage structures. Plants must be moved to more suitable locations or approval from the
associated agency (VDOT, ACSA, etc) that they will allow the plantings within their
property /easement must be provided.
7. [32.6.20), s2.7.9.4(b) & Condition of approval] Existing trees may be preserved in lieu of
planting new plant materials in order to satisfy the landscaping and screening
requirements of section 32.7.9 or to meet conditions of approval, subject to the agent's
approval. It appears the Preliminary Site Plan and first Final Site Plan were approved with a
condition that certain trees along the border of the 20' undisturbed buffer be marked and
preserved. The landscape plan should show the trees to be preserved, the limits of
clearing, the location and type of protective fencing, grade changes requiring tree wells or
walls, and trenching or tunneling proposed beyond the limits of clearing.
8. [32.6.20) & 32.7.9.5(a)] An area of at least five (5) percent of the paved parking and
vehicular circulation area shall be landscaped with trees or shrubs. Neither the areas of
street trees and shrubs required by sections 32.7.9.5(d) and (e), nor shrubs planted
between a parking area and the building shall be counted toward the minimum landscaped
area for a parking lot. The 5% requirement refers to square footage of planting space, not
tree canopy. All relevant information to verify this requirement is met will be required.
9. [32.6.2(j) & 32.7.9.8] A minimum 10% tree canopy will be required.
10. [Condition of Preliminary Approval] Virginia Department of Transportation approval of
entrance design, signal improvements, frontage and turn lane improvements as well as any
associated road plans and drainage plans.
11. [Condition of Preliminary Approval] The 18' retaining wall on the northern side of the site
cannot disturb the undisturbed buffer for a footing or reinforcing grid. The plan must be
revised as necessary, or provide computations, details and construction methods to avoid
disturbance of the buffer.
12. [Condition of Preliminary Approval] Grading to the edge of the undisturbed wooded
buffer on the sides of the site will likely cut tree root systems, damaging and eventually
killing trees. On final plans, the grading should be moved back, or specific trees surveyed
and marked on plans to ensure survivability of trees within the undisturked buffer.
Eneineerine and Water Resources
The following comments related to engineering and water resources have been provided by
Michelle Roberge:
My recommendations are regarding the site plan.
1) Please provide curb and gutter for travelway behind bldg.
2) In the middle section of parking lot, please provide 9' x 18' parking stalls.
3) Please address the runoff north of site for the quality and quantity criteria.
Entrance Corridor
The following comments related to the Entrance Corridor Design Guidelines have been provided
by Margaret Maliszewski:
At its meeting on February 19, 2013, the ARB voted 4:0 to forward the following
recommendation to the Planning Commission regarding the special use permit request for
ARB- 2013 -01, Price Hyundai at Northtown Center:
The ARB has no objection to the request for the Special Use Permit with the following
conditions:
1. Vehicles shall not be elevated anywhere on site.
2. Vehicles shall be displayed only in areas indicated for display shown on the plan
entitled "Architectural Review Board Submission for Phase 1 Northtown Center — Jim
Price Hyundai" by Dominion Engineering and dated 1/14/13. Display parking in the
parking lot shall be only in designated striped parking spaces, as identified on this plan.
3. Final site plan approval is subject to ARB approval of the lighting plan (submitted with
the site plan). Maximum light levels shall not exceed 30 footcandles.
4. Final site plan approval is subject to ARB approval of the landscape plan (submitted
with the site plan). Landscaping shown on the plan may be required to be in excess of
the minimum requirements of ARB guidelines and /or the Zoning Ordinance to mitigate
visual impacts of the proposed use.
Please see the attached ARB action letter for additional comments to be addressed prior to
final site plan approval.
VDOT
Comments have not yet been received from VDOT. They will be forwarded as soon as they are
available.
RWSA
The following comments have been provided bar Victoria Fort:
1. Capacity issues for sewer that may affect this proposal None Known
2. Requires Rivanna Water and Sewer Authority Capacity Certification Yes X No

Fire /Rescue
The following comments related to Fire /Rescue issues have been provided by Howard
Lagomarsino:
No objections to the special use permit request. Keep in mind as plan moves forward to other
approval processes we will be concerned about the following:
1. Hydrant spacing shall be 400 ft per travel way around the building.
2. FDC Locations shall be on the address side of the buildings and within 50 ft of a fire
hydrant. And located so that when the fire apparatus is hooked to the hydrant and FDC
it doesn't block access for other apparatus. This may require a free standing FDC
located in a parking lot island with a fire hydrant.
3. Fire Access roads shall have a width of 20 ft unobstructed width.
4. Need to advise the fire official of the construction type so the fire flow can be
determined.
5. Key box required contact Fire Offical during construction to determine a location.
SP Conditions
At this point in the review process, we anticipate that recommended conditions of approval for
the Special Use Permit will include those conditions recommended by the Architectural Review
Board.
Action after Receipt of Comments
After you have read this letter, please take one of the actions identified on "Action After Receipt of
Comment Letter" which is attached.
Resubmittal
If you choose to resubmit, please use the attached form. There is no fee for the first resubmittal.
The resubmittal date schedule is provided for your convenience.
Notification and Advertisement Fees
Recently, the Board of Supervisors amended the zoning ordinance to require that applicants pay
for the notification costs for public hearings. Prior to scheduling a public hearing with the Planning
Commission, payment of the following fees is needed:
$ 167.60 Cost for newspaper advertisement
212.22 Cost for notification of adjoining owners (minimum $200 + actual postage /$1 per owner
after 50 adjoining owners)
$ 379.82 Total amount due prior to Planning Commission public hearing
Prior to the Board of Supervisor's public hearing, payment of the newspaper advertisement for the
Board hearing is needed.
$ 167.60 Additional amount due prior to Board of Supervisors public hearing
$ 547.42 Total amount for all notifications Fees may be paid in advance. Payment for both the
Planning Commission and Board of Supervisors public hearings may be paid at the some time.
Additional notification fees will not be required unless a deferral takes place and adjoining owners
need to be notified of a new date.

ACTION AFTER RECEIPT OF COMNUNT LETTER
Within 30 days of the date of this letter, please do one of the following:
(1) Resubmit in response to review comments
(2) Request indefinite deferral
(3) Request that your Planning Commission public hearing date be set
(4) Withdraw your application
(1) Resubmittal in Response to Review Comments
If you plan to resubmit within 30 days, make sure that the resubmittal is on or before a
resubmittal date as published in the project review schedule. The full resubmittal schedule may
be found at www.albemarle.org in the "forms" section at the Community Development page. Be
sure to include the resubmittal form on the last page of your comment letter with your submittal.
The application fee which you paid covers staff review of the initial submittal and one resubmittal.
Each subsequent resubmittal requires an additional fee. (See attached Fee Schedule.)
(2) Request Indefinite Deferral
If you plan to resubmit after 30 flays from the date of the comment letter, you need to request an
indefinite deferral., Please provide a written request and state your justification for requesting the
deferral. (Indefinite deferral means that you intend to resubmit /request a public hearing be set
with the Planning Commission after the 30 day period.)

At this time, you may schedule a public hearing with the Planning Commission. However, we do
not advise that you go directly to public hearing if staff has identified issues in need of resolution
that can be addressed with a resubmittal.
After outstanding issues have been resolved and /or when you are ready to, request a public
hearing, staff will set your public hearing date for the Planning Commission in accordance with the
Planning Commission's published schedule and as mutually agreed by you and the County. The
staff report and recommendation will be based on the latest information provided by you with
your initial submittal or resubmittal. Please remember that all resubmittals must be made on or
before a resubmittal date.
By no later than twenty -one (21) days before the Planning Commission's public hearing, a
newspaper advertisement fee and an adjoining owner notification fee must be paid. (See attached
Fee Schedule) Your comment letter will contain the actual fees you need to pay. Payment for an
additional newspaper advertisement is also required twenty -two (22) days prior to the Board of
Supervisors public hearing. These dates are provided on the attached Legal Ad Payments for
Public Hearings form.
Please be advised that, once a public hearing has been advertised, only one deferral prior to the
Planning Commission's public hearing will be allowed during the life of the application. The only
exception to this rule will be extraordinary circumstances, such as a major change in the project
proposal by the applicant or more issues identified by staff that have not previously been brought
to the applicant's attention. As always, an applicant may request deferral at the Planning
Commission meeting.
(4) Withdraw Your Application
If at any time you wish to withdraw your application, please provide your request in writing.
Failure to Respond
If we have not received a response from you within 30 days, we will contact you again. At that
time, you will be given 10 days to do one of the following: a) request withdrawal of your
application, b) request deferral of your application to a specific Planning Commission date as
mutually agreed to with staff, or c) request indefinite deferral and state your justification for
requesting the deferral. If none of these choices is made within 10 days, staff will schedule your
application for a public hearing based on the information provided with your original submittal or
the latest submittal staff received on a resubmittal date.

Counter. Make checks payable to the County of Albemarle. Do not send checks directly to the

Dear Mr. Anderson,
The Albemarle County Architectural Review Board, at its meeting on February 19, 2013, completed
a review of the above -noted request. The Board took the following actions.
Regarding the Special Use Permit, the Board by a vote of 4:0, forwarded the following
recommendation to the Planning Commission:
The ARB expressed no objection to the special use permit, subject to the following conditions:
1. Vehicles shall not be elevated anywhere on site.
2. Vehicles shall be displayed only in a=s indicated for display shown on the plan entitled
"Architectural Review Board Submission for Phase 1 Northtown Center — Jim Price Hyundai"
by Dominion Engineering and dated 1/14/13. Display parking in the parking lot shall be only in
designated striped parking spaces, as identified on this plan.
3. Final site plan approval is subject to ARB approval of the lighting plan (submitted with the site
plan). Maximum light levels shall not exceed 30 footcandles.
4. Final site plan approval is subject to ARB approval of the landscape plan (submitted with the
site plan). Landscaping shown on the plan may be required to be in excess of the minimum
requirements of ARB guidelines andlor the Zoning Ordinance to mitigate visual impacts of the
proposed use.
Regarding the Conceptual Site Plan, The board of emd the following comments:
1. Include the wash/alignment building in the elevation drawings.
2. Revise the south elevation of the parts /service building to improve the window proportions,
relieve the utilitarian appearance, and coordinate more with the showroom.

3. Provide a roof plan.
4. Include building dimensions and the drawing scale on the elevation drawings.
5. Provide a perspective view of the development as seen from the EC to clarify the extent of
visibility and the impact of the parts /service and wash/alignment buildings.
6. Revise the entrance element to increase coordination with the showroom building design.
Consider size, shape, color, detailing and overall character.
7. Add the following note to the site plan and the architectural drawings: "Visibility of all
mechanical equipment from the Entrance Corridor shall be eliminated."
8. Provide wall sign information with the ARB site plan/architectural applications. The review of
entrance element signs will be closely tied to the review of the entrance element.
Lighting:
9. Revise the lighting plan so that light levels do not exceed 30 footcandles anywhere on site.
10. Indicate on the plan if the light poles are to be installed on bases. If they are, clarify on the plan
that the 20' height includes the bases.
11. Add the following note to the lighting and /or site plan: "Each outdoor luminaire equipped with a
lamp that emits 3,000 or more initial lumens shall be a full cutoff luminaire and shall be
arranged or shielded to reflect light away from adjoining residential districts and away from
adjacent roads. The spillover of lighting from luminaires onto public roads and property in
residential or rural areas zoning districts shall not exceed one half footcandle."
Site /Landscaping:
12. Indicate the scale on the site plan drawings and include a north arrow.
13. Increase the size of the QC Willow Oak at the north end of the EC frontage to 3 %z" caliper
minimum at planting.
14. Add LN to the plant schedule.
15. Correct the plant schedule to indicate that Quercus Phellos is Willow Oak and that Quercus
Coccinea is Scarlet Oak.
16. Verify and correct the QP, PL, LN, IC, JV, PT, PO, and LB quantities.
17. Ensure that the number of proposed plants for any one species is limited to 25% of the total
proposed for that plant type (tree /shrub).
18. Include the biofilter plant schedule in the current plan for reference.
19. Provide trees and shrubs in the area west of the west end of biofilter #2.
20. Ensure that all utilities and utility easements are clearly identified on the plans. Resolve all
tree /utility conflicts without decreasing the amount of planting proposed.
21. Add trees in the western half of the parking row adjacent to biofilter #2.
22. Consider adding trees at the front of the building.
23. Add evergreen trees along the south elevation of the parts /service building to help relieve the
utilitarian appearance.
24. Resolve the shrub /sidewalk/planting strip conflicts near the wash/alignment building.
25. Add the following note to the landscape plan: "All site plantings of trees and shrubs shall be
allowed to reach, and be maintained at, mature height; the topping of trees is prohibited. Shrubs
and trees shall be pruned minimally and only to support the overall health of the plant."
26. Indicate wall heights and proposed materials for the retaining wall in the parking lot.
27. Revise the landscape plan to clearly show trees to be preserved, grading held outside the
dripline of trees to remain, the limits of clearing, and the location and type of protective fencing.
Coordinate proposed tree locations with undisturbed buffer limits.
28. Consider planting the partially completed rain garden #3 with the Price Hyundai proposal.

other means will facilitate review and approval.
