Additional comments or conditions may be added or eliminated based on further review.) [Each comment is preceded by the applicable reference to the Albemarle County Code.] 1. [14 -302 (A)(14)] Land to be dedicated in fee or reserved. State whether the open space and cemetery will be owned and maintained by the HOA or dedicated to public use. Rev1: Comment addressed. 2. [14 -302 (A)(3); 14- 303(E)] Existing or platted streets, Dimension standards. Show all of Regent Street all the way to its intersection with Worth Xing. State whether that it will be dedicated to public use. Also, all the other roads in the development must be dedicated to public use, since they are not existing roads. Rev1: Comment not adequately addressed. You must show Regent Street all the way out to Worth Xing. Also, Regent Street has not been dedicated. The deed book referenced is for a temporary construction easement, not dedication of the road. You must show the whole road, and the easement that is shown in the referenced deed. 3. [14- 302(B)(4)] Places of burial. Show the exact location of the cemetery Rev1: Comment addressed. 4. [14- 303(G)] Ownership of Common Areas. Provide the ownership of all common areas. Rev1: Comment addressed. However, please provide a copy of the HOA documents to show that the maintenance of these areas will be maintained. Rev1: Comment not addressed. HOA documents need to be submitted. 5. [14- 303(K)] Temporary turn arounds. Show a temporary turn around for the end of Decatur Drive. Rev1: Comment addressed. 6. [14- 303(L)] Easements. Show all easements, including site distance easements on the plat. If there are construction or grading easements needed on adjacent property to construct Regent Street, these need to be shown on the plat, and the adjacent owners need to be signatories as well. 1 Rev1: The temporary grading easement that is referenced in the deed is not shown on the plat for Regent Street. Since it is an existing easement, the adjacent owners do not need to be signatories, however, the easement still needs to be shown on the plat. 7. [14 -316] VDOT. Approval from the Virginia Department of Transportation is required. Rev1: Comment not addressed. 8. [14 -317] Instrument. Provide an instrument for the maintenance of the open space and cemetery to be reviewed and approved by the County Attorney. Also, provide deeds of easement for the storm drainage easements. Rev1: Comment not addressed. 9. [14 -413] Improvements of existing public streets. Regent Street needs to be shown in whole, it is a part of the subdivision. Also, is it an existing public street? If not, it needs to be dedicated to public use. Rev1: Comment not addressed. The deed book referenced is not sufficient. That shows an access easement, not a public street, which Regent Street is now required to be a public street. 10. [14 -435] Surety. All bonds must be posted for all improvements prior to signing of the final plat. Rev1: Comment not addressed. 11. [Proffer #1 (B)] Regent Street right of way needs to be shown offsite in its entirety, and dedicated to public use, as shown on the application plan. Rev1: Comment not addressed. See comments concerning Regent Street above, and please read the proffer in whole to address this comment. 12. [Proffer #31 If affordable units are being constructed, they need to be shown /indicated on the plat per this proffer for tracking purposes. Rev1: Comment not addressed. Five units need to be provided. You cannot round down. 15% of 29 is 4.35, which would equal 5 total units. 13. [Application Plan] Be aware that the application plan requires that the cemetery be fenced off and protected with a black decorative fence. A sign must also be provided to designate the cemetery and its historical significance. Rev1: Comment addressed /pending for CO.
