Perez, Senior Planner Division: Current Development Date: April 26, 2013 Subject: SUB 2013 — 00048 Mark Lyons - BLA Fax 434 - 972 -4126 The County of Albemarle Division of Current Development will grant or recommend approval of the Boundary Line Adjustment plat referenced above once the following comments have been addressed: [Each comment is preceded by the applicable reference, which is to the Subdivision /Zoning Ordinances unless otherwise specified.] 1. [14- 302(A)(9)] Building Site. While the existing house is to remain on the revised TMP 58- 3C, the County needs to assure that there is buildable area on the lot which meets the requirements of Chapter 18 Section 4.2.1 and 4.2.2 of the Code of Albemarle. Notably, each building site for a dwelling unit shall have an area of thirty thousand (30,000) square feet or greater and shall be of such dimensions that no one dimension exceeds any other by a ratio of more than five (5) to one (1) as described by a rectangle inscribed within the building site. After reviewing parcel history to include previous submittals and Special Exception requests (SDP2011 -31) for this parcel, it is apparent that this dwelling is not located within a building site which meets the requirements described above. The area where the dwelling is located includes 39,786 square feet exclusive of critical slopes; however, the area does not meet the five (5) to one (1) ratio required by the ordinance. Section 4.2.2(a)(3) of the Code of Albemarle allows for the rectangular shape to be modified or waived by the Board of Supervisors (BOS) pending a Special Exception request and determination. In considering such a request the BOS will consider the recommendation from the Virginia Department of Health and information provided by the developer showing that: (i) the parcel has an unusual size, topography, shape, location or other unusual physical condition; (ii) no reasonable alternative building site exists; and (iii) modifying or waiving the rectangular shape would result in less degradation of the parcel or adjacent parcels than if those dimensions were adhered to. If the applicant would like to move forward as proposed, a Special Exception request is required to be made by the applicant. The BOS will take action on the request accordingly. Please note that the initial Special Exception request, SDP2011 -31, was denied by the Agent and was never appealed by the applicant. Based on changes to the ordinance the Agent no longer makes these determination, rather the BOS is the acting entity on all Special Exceptions; however, the BOS will review the request against the same criteria as the Agent previously had done. 2. [14 -309 & 14 -310] Soil evaluations; Health Director Approval of wells and septic systems. With this proposal TMP 58 -3C is being reduced to below 5 acres, as such County staff must assure that the lot has both a primary and reserve drainfield location onsite. If the existing home has a primary system but lacks a reserve drainfield location, one shall be located by the applicant and approved by the Health Department at this time. Provide documentation of Health Department approval of primary and reserve drainfields for the revised TMP 58 -3C. OR provide three copies of the results of percolation tests or other methods of soil evaluation used to determine the suitability of the soil for septic systems with conventional drain fields for review and approval by the Health Department. 3. [14- 302(B)(7)] Reservior watershed. Revise note #9 to state that the property is in the Lower Mechums River Water Supply Watershed which is a part of the South Fork Rivanna Reservoir Water Supply Watershed. 4. [14- 302(B)(10)] Stream Buffers. Assure that the stream buffer within "Area A" is labeled as a 100' stream buffer. 5. [14- 302(B)(1)] General Information. When the plat is revised, please provide the date of the last revision on the plat.
