Dear Mr. Wood:
Staff has reviewed your proposed amendment to the proffers and application plan. We have a
number of questions and comments which we believe should be considered before your ZMA
moves forward to the Planning Commission. We would be glad to meet with you to discuss
these issues.
All comments from all reviewers are provided in this letter, however the major issues that will
need to be addressed before moving forward to the Planning Commission are listed below.
Many of these show up in other comments by each reviewer listed in this letter, however it is
important to identify the major concerns, and these should be addressed with a resubmittal:
Planning
Comprehensive Plan.
The proposed development is within Places 29 Master Plan of the Comprehensive Plan ( "Plan ")
and designated as Urban Mixed Use in Centers. It is also subject to the Albemarle County
Design Standards Manual as well as the Conceptual Master Plan & Design Guidelines for
Hollymead Town Center ( "Design Guidelines ").
Neighborhood Model
General comments on how well the proposed development meets the principles of the
Neighborhood Model are provided here. More detailed comments may be provided at a later
date if changes are made and /or after more detailed plans are provided. Since this is an
amendment to a previously approved rezoning that only contains limited changes, not all
principles are applicable.
Pedestrian The Places 29 Greenway Plan recommends a multi -use greenway
Orientation path in this area. Parks and Recreation supports a 6" compacted
gravel. The greenway is a feature that is part of the interconnection to
parks and sidewalk systems within all of Hollymead Town Center.

1. It is recommended that Engineering be removed from inspection or review of the trail
and given to Parks and Recreation.

Planning and Zoning Services
Proffers:
1. There are several proffers that have changed from the original, i.e., see 1 B, 1 D and 2.
Staff has not reviewed them and they were not part of the prior submittal. Please clarify
your intention.
1. The proffers must reflect an updated date and ZMA number reference (ZMA2012- 00005)
and the rezoned area is no longer RA, but PD -MC to PD -MC.
2. Proffer 3: It is suggested that the 2 benches be installed "within 30 days after transit
service to the transit stop ".
5. Proffer 8 suggestions: "The Owner shall construct... "... "generally" should be changed
to "location identified in the yellow dashed line on Exhibit C ". Sentence 22 Construction of
the trail and stairs as referenced on A2 of the Application Plan and shall be complete prior to
issuance of the Certificate of Occupancy for Buildings B or C ( "the Buildings ") ". The
"alternate tie" needs to reference Exhibit C and the specific trail. "The Owner shall design
and construct stairs located in between Buildings B and C. The stair design to be approved
by Parks and Recreation in consultation with Rivanna Water & Sewer Authority due to their
existing easement at or prior to issuance of a Building Permit for the Buildings. The trail and
stairs will be deemed complete upon approval by Parks and Recreation."
Finally, the cash bond is not a proffer. Any reduction has to go through the normal bond
reduction process.

Resubmittal

Notification and Advertisement Fees
Recently, the Board of Supervisors amended the zoning ordinance to require that applicants
pay for the notification costs for public hearings. Prior to scheduling a public hearing with the
Planning Commission the following must be paid:
$ 387.44 Cost for notification of adjoining owners (minimum $200 + actual postage /$1 per
owner after 50 adjoining owners)
$255.60 Legal ad cost for Planning Commission
$476.28 Total amount due prior to Planning Commission public hearing
Prior to the Board of Supervisor's public hearing, payment of the newspaper advertisement for
the Board hearing needed.
$ 255.60 Additional amount due prior to Board of Supervisors public hearing
$ 898.94 Total amount for all notifications Fees may be paid in advance. Payment for both
the Planning Commission and Board of Supervisors public hearings may be paid at the same
time.
Additional notification fees will not be required unless a deferral takes place and adjoining
owners need to be notified of a new date.

ACTION AFTER RECEIPT OF COMMENT LETTER
Within 30 days of the date of this letter, please do one of the following:
(1) Resubmit in response to review comments
(2) Request indefinite deferral
(3) Request that your Planning Commission public hearing date be set
(4) Withdraw your application
(1) Resubmittal in Response to Review Comments
If you plan to resubmit within 30 days, make sure that the resubmittal is on or before a
resubmittal date as published in the project review schedule. The full resubmittal schedule may
be found at www.albemarle.org in the "forms" section at the Community Development page.
Be sure to include the resubmittal form on the last page of your comment letter with your
submittal.
The application fee which you paid covers staff review of the initial submittal and one
resubmittal. Each subsequent resubmittal requires an additional fee. (See attached Fee
Schedule.)
(2) Request Indefinite Deferral
If you plan to resubmit after 30 days from the date of the comment letter, you need to request
an indefinite deferral. Please provide a written request and state your justification for
requesting the deferral. (Indefinite deferral means that you intend to resubmit /request a
public hearing be set with the Planning Commission after the 30 day period.)
(3) Request Planning Commission Public Hearing Date be Set
in
At this time, you may schedule a public hearing with the Planning Commission. However, we
do not advise that you go directly to public hearing if staff has identified issues in need of
resolution that can be addressed with a resubmittal.
After outstanding issues have been resolved and /or when you are ready to request a public
hearing, staff will set your public hearing date for the Planning Commission in accordance with
the Planning Commission's published schedule and as mutually agreed by you and the County.
The staff report and recommendation will be based on the latest information provided by you
with your initial submittal or resubmittal. Please remember that all resubmittals must be made
on or before a resubmittal date.
By no later than twenty -one (21) days before the Planning Commission's public hearing, a
newspaper advertisement fee and an adjoining owner notification fee must be paid. (See
attached Fee Schedule) Your comment letter will contain the actual fees you need to pay.
Payment for an additional newspaper advertisement is also required twenty -two (22) days prior
to the Board of Supervisors public hearing. These dates are provided on the attached Legal Ad
Payments for Public Hearings form.
Please be advised that, once a public hearing has been advertised, only one deferral prior to the
Planning Commission's public hearing will be allowed during the life of the application. The
only exception to this rule will be extraordinary circumstances, such as a major change in the
project proposal by the applicant or more issues identified by staff that have not previously
been brought to the applicant's attention. As always, an applicant may request deferral at the
Planning Commission meeting.
(4) Withdraw Your Application
If at any time you wish to withdraw your application, please provide your request in writing.
Failure to Respond
If we have not received a response from you within 30 days, we will contact you again. At that
time, you will be given 10 days to do one of the following: a) request withdrawal of your
application, b) request deferral of your application to a specific Planning Commission date as
mutually agreed to with staff, or c) request indefinite deferral and state your justification for
requesting the deferral. If none of these choices is made within 10 days, staff will schedule
your application for a public hearing based on the information provided with your original
submittal or the latest submittal staff received on a resubmittal date.

The proposed proffer amendments for Hollymead Town Center area A -1 have been reviewed. The
following comments are provided for your review;
Proffer 8: There are no engineering reasons why this trail could not be built. There are similar
trails in other parts of the county that have been successful. If location is an issue for safety, a new
location and design could be an acceptable alternative.
Rev. 1: This proffer has been revised with the Parks & Rec. Department to a lesser standard as
provided in Exhibit B. Please ensure that the Community Development Engineering Division be
completely removed and dissociated with any enforcement action, including bonding, inspection,
and field fittings. Please leave this all up to Parks and Rec., preferably in the proffer itself. (I
know these stone dust trails and general lines drawn on maps are great for meetings and
compromise deals, but they are absolutely disasters to inspect and enforce to any sort of quality.
There is no consideration given to exact location, cross - grades, longitudinal grades, side slopes,
drainage, testing, etc. It's all just to be "worked out in the field" with a considerable time and
resource expense. Please do not put that burden on the engineering division.)
2. Proffer 9: I have not been approached about a pedestrian signal and crossing of route 29. Such a
crossing location would be best situated at the existing traffic signals on Rt. 29. Crossing at other
locations are not recommended.

requirements are provided by Bill Fritz:
1. The Applicant is proposing a Class B -Type 1 primitive nature trail which can be a dirt
path just wide enough to mark its location (similar to the Appalachian Trail). This is not the
typical type of trail expected in the development areas. Asphalt is recommended based on the
level of activity for this trail. This will allow for ease of maintenance by motorized vehicles. It
will allow for easy two way pedestrian traffic and allow bicycles to use the path at the same time
as pedestrians with minimal conflict. A primitive trail is better suited to areas of relative low
density of use and is completely unsuitable for an area where pedestrian traffic is being
encouraged and where a nearby mix of residential and commercial activity will occur.

The Greenways Plan for Albemarle County. Additionally, it is not recommended that it be
reduced to 5 feet in width at this location, since it is designed as an urban area to be used
frequently.
Planning and Zoning Services
Application Plan:
1. The approved Application Plan contains several references to the greenway trail that are
inconsistent with the proposed changes:
-Page Al references a 10 foot wide Greenway Trail
-page A2 & A3 reference a 10 foot wide Asphalt Greenway Trail
Proffers:
1. The proffers must reflect an updated date and ZMA number reference.
2. Proffer 3: The Owner is currently in violation of the public transit stop location since it
was required to be constructed with the first site plan or street plans. The transit stop must
either be constructed or the proffer language should be changed. Additionally, the Applicant
should consider showing the location change that was suggested by the Applicant and
supported by Staff.
3. Proffer 4: The amended proffer amount of $50,000 is not significant, given the original
proffer contributed a total of $250,000. Transit service is determined in part by County
budgeting and it is anticipated that service will not be provided within 5 years. It is
recommended that the deadline be changed to at least 10 years.
4. Proffer 6: Staff does not recommend removal of the Community Development Authority
( "CDA "). There are several other rezonings that are subject to a similar proffer, such as
Stonefield (Albemarle Place), and Hollymead Town Center Areas B, C, and D. Additionally
It does not obligate the Applicant in any way unless the County requests the CDA and all
owners petition and consent to the CDA.
5. Proffer 8: As mentioned above, the greenway is shown on the application plan and
referenced in the proffer. It is not recommended that the trail be reduced to a Class B -Type
1 trail in this area. The Plan recommends multi -use trails in this area which are 10 foot wide
and paved. Portions of this trail are already built such as the Abington section of Hollymead
Town Center. To use any different class of trail except for a 10 foot wide paved path does
not provide consistency within Hollymead Town Center.
6. Proffer 9: As mentioned above, VDOT does not recommend an at grade pedestrian
crossing over Route 29. It is suggested that alternate options for the cash proffer should be
reviewed such as a bridge or upgrades to existing intersections.
Additional Comment
1. The Applicant recently proposed changes to the square footage and arrangement of
buildings at the corner of Meeting Street and Town Center Drive. If those changes are still
being suggested, they should be addressed with this amendment.

Subject: HTC, A -1, proffer amendments (ZMA201200005)
The proposed proffer amendments for Hollymead Town Center area A -1 have been reviewed. The
following comments are provided for your review;
Proffer 8: There are no engineering reasons why this trail could not be built. There are similar
trails in other parts of the county that have been successful. If location is an issue for safety, a new
location and design could be an acceptable alternative.
2. Proffer 9: I have not been approached about a pedestrian signal and crossing of route 29. Such a
crossing location would be best situated at the existing traffic signals on Rt. 29. Crossing at other
locations are not recommended.
