HomeMy WebLinkAboutSDP201300046 Review Comments Final Site Plan and Comps. 2013-09-26C � � vIRGIN�' County of Albemarle Department of Community Development Memorandum To: Cheryl Lynn Taylor (c.taylor @velocitel.com) From: Brent Nelson - Planner Division: Planning Services Date: September 17, 2013 [Revised: September 26, 2013] Subject: SDP - 201300046- Gillenwater Property - Tier II PWSF The Planner for the Planning Division of the Albemarle County Department of Community Development will recommend approval for the plan referred to above when the following items have been satisfactorily addressed. The following comments are those that have been identified at this time. Additional comments or conditions may be added or eliminated based on further review. Comments are preceded by the applicable reference to the Albemarle County Code. 1. [Section 4.2.5] Critical Slopes, Modification or Waiver Sheet E &S — 1 Erosion & Sediment Control Plan shows areas where existing critical slopes will be disturbed to construct the facility. A critical slope waiver request as described in Section 4.2.5 will be required. This request will be handled as a Special Exception ([Section 33.9] Special Exceptions; Relevant Factors to Be Considered; Conditions) to be reviewed by the Board of Supervisors. 2. [Section 5.1.4 (b) (2)] Setbacks. Notwithstanding section 4.10.3.1(b), the agent may authorize a facility to be located closer in distance than the height of the tower or other mounting structure to any lot line if the applicant obtains an easement or other recordable document showing agreement between the lot owners, acceptable to the county attorney addressing development on the part of the abutting parcel sharing the common lot line that is within the facility's fall zone (e.g., the setback of an eighty (80) foot -tall facility could be reduced to thirty (30) feet if an easement is established prohibiting development on the abutting lot within a fifty (50) footfall zone). If the right - of -way for a public street is within the fall zone, the Virginia Department of Transportation shall be included in the staff review, in lieu of recording an easement or other document. [Revised comment: September 26, 20131 Sheet A -0 Site Plan shows the fall zone for the proposed 128.9' tall monopole extending across State Route 708, Dry Bridge Road and on to Tax Map 73, Parcel 32A. That parcel is under separate ownership. Written permission from VDOT, allowing the fall zone in the right -of -way, is required. A signed/notarized easement plat and deed for the section of fall zone extending onto TMP 73 -32A is also required. Sheet A -0 Site Plan shows the fall zone 128.9' setback originating at the monopole. With the recent review of another AT &T PWSF proposal, it has been determined that the 128.9' setback (fall zone) would be from the closest ground equipment to the right -of -way, which in this case is the equipment shelter. Revise all applicable drawings to show the 128.9' fall zone setback originating from the side of the equipment shelter closest to the Dry Bridge Road right -of -way. [Section 5.1.4 (a) (4b)] The plans and supporting drawings, calculations and documentation shall show: Elevation. The benchmarks and datum used for elevations. The datum shall coincide with the Virginia State Plane Coordinate System, South Zone, North American Datum of 1983 (NAD83), United States Survey Feet North American Vertical Datum of 1988 (NAVD88), and the benchmarks shall be acceptable to the county engineer. The benchmark used is not indicated on the drawings. 4. [Section 5.1.4(c)(4)] Prior to issuance of a building permit, the applicant shall submit a tree conservation plan prepared by a certified arborist. The plan shall be submitted to the agent for review and approval to assure that all applicable requirements have been satisfied. The plan shall specify tree protection methods and procedures, and identify all existing trees to be removed on the parcel for the installation, operation and maintenance of the facility. [5.1.4(c) (5)] The installation, operation and maintenance of the facility shall be conducted in accordance with the tree conservation plan. Dead and dying trees identified by the arborist's report may be removed if so noted on the tree conservation plan. If tree removal is later requested that was not approved by the agent when the tree conservation plan was approved, the applicant shall submit an amended plan. The agent may approve the amended plan if the proposed tree removal will not adversely affect the visibility of the facility from any location off of the parcel. The agent may impose reasonable conditions to assure that the purposes of this paragraph are achieved Sheet A -1 Compound Plan contains a tree inventory and the location of those trees. With the exception of the reference tree & an adjacent Hemlock tree, the location of tree drip lines was not shown on the drawing; therefore, the impact of the proposed construction on these trees could not be determined. Revise Sheet A -1 Compound Plan to show the drip lines of the trees located within the 50' radius of the tower. A tree conservation plan prepared by a certified arborist verifying that the trees could survive the impacts of this proposal is required. [Section 5.1.4(c)(7)] The owner of the facility shall submit a report to the agent by no earlier than May or no later than July 1 of each year. The report shall identify each user of the existing structure, and include a drawing, photograph or other illustration identifying which equipment is owned and /or operated by each personal wireless service provider. Multiple users on a single tower or other mounting structure may submit a single report, provided that the report includes a statement signed by a representative from each user acquiescing in the report. This is not a condition of approval for the proposal under review, just a reminder. 6. Miscellaneous: a. Sheet E & S -1 Erosion and Sediment Control Plan appears to show no proposed grading with this proposal — verify this is true or revise to show proposed contours. The exact location, limits of and proposed grading associated with the proposed pull off /parking area are not shown. Revise the drawing to show. b. Revise Sheet A -1, Compound Plan to indicate the proposed surface of the walkway to the facility. c. Sheet A -1, Compound Plan states the proposed antennas are less than 1,152 square inches in area but does not indicate the antenna dimensions. Revise the drawing to include the dimensions.
