E. 5" St. Oklahoma City, OK 73104 RE: Eldercare Gardens Charlottesville Choice Health Management Services Tax Map and Parcel: 061 WO -03-00-02600 Dear Ms. Davis; In response to your Application for Letter of Zoning Compliance, this office has researched your request and offers the following conclusions regarding the referenced parcel: ■ The property was developed as a 180 bed nursing home facility, served by 134 parking spaces. ■ The property is zoned C-1, Commercial. Per Section 22.2.2.6 and 18.2.2.9, nursing homes are allowed in the C-1 District by Special Use Permit. SP -60- 76 was approved on November 2, 1981 to allow the nursing home with conditions. The approval letter with conditions is attached. ■ The parcel is located within the Airport Impact Area. ■ The parcel is not part of a Planned Unit Development. ■ VA -80-37 was granted August 26, 1980, to allow an identification sign to be 32 square feet; a variance of 2 feet. A condition was stipulated that the variance would run with the present owner and not the land. The approval letter with the condition is attached. I:\DEPT\Community Development\Zoning & Current Development\Determin of Compliance\2007 Compliance\LCZ-2007-09 Eldercare Gardens.doc ■ This project was built under an approved site development plan, SDP -118, which shows 1-1 story building (common building) totaling 15,284 square feet and 1-3 story building totaling 13,932 square feet. (nursing home). SDP -1994- 66 amended the site plan to allow the addition of a storage building. ■ This office has no record of any outstanding zoning violations. ■ The nursing home and common building were constructed in 1980 and would have met the zoning ordinances in effect at that time. ■ The property was inspected for zoning compliance on April 25, 2007 and several items were noted as not represented on the approved site plan. ■ It is the policy of this department to purge building permit files after three years. Copies of Certificates of Occupancy are maintained on microfilm. Therefore, we have not retained any copies of Certificates of Occupancy associated with this project. Furthermore, the absence of a Certificate of Occupancy for the project will not give rise to any enforcement action. Please be aware that interior renovation that does not involve a change of use does not require a Certificate of Occupancy. You may obtain a copy of a Certificate of Occupancy for an additional fee of $25.00 each. The form included with your request has been completed to reflect this and is enclosed.
