The County of Albemarle Planning Division will recommend approval of the plat referenced above once the
following comments have been satisfactorily addressed (The following comments are those that have been
identified at this time. Additional comments or conditions may be added or eliminated based on further review.):
[Each comment is preceded by the applicable reference, which is to the Subdivision /Zoning Ordinances unless
otherwise specified.]
1. [14- 302(A)4] Private easements. Please dimension all parts of the alley easement.
2. [14- 302(A)4] Private easements. It appears that the sidewalk that was previously in the common area is
now proposed to be within lots 1 -10. This layout will require a sidewalk easement to be established for
maintenance. Additionally, a supplemental declaration must be submitted that addresses the maintenance
of this sidewalk as the previous declaration only covered improvements within the common area. This
declaration must be reviewed and approved by the County Attorney's Office and recorded with the plat.
3. [14- 302(A)4] Private easements. Where side setbacks are less than 4'11 ", a 6' maintenance easement
must be established on the property adjacent to the side setback; it appears this will apply to lots 1, 5, 6 and
10. See Table 9 note 3 in the Belvedere Code of Development.
4. [14- 302(A)6] Alleys and shared driveways. The alley easement scales at less than the required 20'; please
verify that the easement is a minimum of 20' wide.
5. [14- 302(A)11] Instrument creating property proposed for subdivision. Include DB 4349 PG 264 in the
Phase III label as this is the instrument that created the residue parcel now being divided.
6. [14- 302(B)l] General information. Each sheet has a different date; please revise.
7. [14- 302(8)8] Yards. Townhomes that are adjacent to an alley must have a 3' side setback; show this
setback on Lot 1 where the turn - around extends into the lot. See Table 9 note 4 in the Belvedere Code of
Development.
8. [14- 302(8)8] Yards. The front "build -to" and setback requirements for this phase were changed with
variation #43; there is no required "build -to" or setback, but the units must be a minimum of 7' from the alley
to meet Engineering requirements for driveway length. Revise the "8' B.T.L." label and line to demonstrate
this minimum setback from the alley.
9. [14- 302(8)8] Yards. The setbacks on commercial lot #24 now have to be from the access easement, not
the property line. Please show the correct setbacks.
10. [14- 303(C)] Boundary lines. Label any existing boundary lines that are to be vacated.
11. [14- 303(G)] Ownership of common areas. Indicate the intended ownership of all common areas.
12. [14- 303(S)] Control points. Provide at least four (4) control points, evenly distributed across the property
and located at survey property corners, and shown on each sheet depicting the property. It appears that
only three are shown, and only on one sheet. At the option of the subdivider, the control points may be
shown on a copy of the final plat, rather than on the original final plat.
13. [14 -317 & Condition of Preliminary Approval] Instrument evidencing maintenance of certain
improvements. An instrument for the maintenance of privately owned improvements (sidewalks, common
areas and private alley) must be submitted for review and approval by the County Attorney's office. This
document must be recorded with the plat.
14. [Comment] The approved site plan shows a 5' wide sidewalk between lots 5 & 6 with 1' of common area
on each side. The common area shown on this plat is only 4.98' wide; revise to show what was approved
on the site plan.
15. [Comment] The right -of -way adjustment adjacent to lot 10 appears to make the lot very narrow at the back;
please verify that this allows enough space for the intended dwelling unit and required 6' maintenance
easement (if the side yard is less than 4'11 ").
16. [Comment] This plat cannot be approved until all reviewers grant their approval. Inspections, VDOT, Fire
rescue, and E911 have completed their reviews and have no objections. Engineering comments have been
provided. ACSA comments are forthcoming. Road bonds must also be posted prior to Final Plat approval.
