Mr. Morris,
As discussed over the phone I've looked into your inquiry of modifying the easement from 20' as it is currently
proposed and increase it to 30'. What the proposal is running up against is the required 25' setback on an
internal road in the Rural Areas (RA) zoning of the County. Originally the width of the easement was proposed
to be 30'; however, the location of the existing house and it's proximity to the proposed easement caused the
need for a reduced easement width to meet the setback requirement. With a 20' wide easement the setback from
the house is met by providing a 267 setback. However if the applicant is unwilling or unable to reduce the
width of the easement to 20' as discussed other potential solutions might be:
A) Apply for a Boundary Line adjustment with TMP 112 -33D1 (Mr. Offield) to gain additional acreage to the
TMP 112 -33D4 (Douglas Scott and Donna Scott) and increase the easement to 30' within the extra space.
B) Work with the adjacent property owner of TMP 122 -33D1 to have a portion of the 30' easement on his
property. He will be required to sign the plat and shall not be permitted access to the road.
C) Vary the easement width to begin as 20' near the house and once the house is cleared increase the width to
30'.
The above are just some of the potential options Planning Staff was able to come up with to remedy the issue
discussed above, there may be more but this is what I was able to come up with. Hope that helps.
