Stoner Managing Partner Milestone 3002 nd Street NE Charlottesville, VA 22902 Dear Frank: I am in receipt of your August 29, 2013 letter requesting that the indefinite deferral of the application for ZMA201000018 Crozet Square be extended for one (1) year. Section 33.4 r.2. of the Albemarle County Zoning Ordinance says: "An application shall be deemed to have been voluntarily withdrawn if the applicant requested that further processing or formal action on the application be indefinitely deferred and the commission or the board of supervisors is not requested by the applicant to take action on the application within one (1) year after the date the deferral was requested. Upon written request received by the director of planning before the one (1) year period expires, the director may grant one extension of the deferral period for a period determined to be reasonable, taking into consideration the size or nature of the proposed use, the complexity of the review, and the laws in effect at the time the request for extension is made." On September 5, 2012 the applicant at the time, Katurah Roell, requested an indefinite deferral as the subject property was in foreclosure and in the hands of the trustee for the bank. It is my understanding that the property is now under the ownership of UB Ten, LLC, represented by David Clelland, and that you represent the current contract purchaser. You have indicated that this request for an extension of the deferral is to allow you to pick up this ZMA application, make certain modifications and resume the review process. You have also indicated an interest in seeking amendment to the zoning ordinance's Downtown Crozet District to broaden the residential use possibilities by special use permit which will entail submitting a ,ZTA and special use permit application. Your hope is to have these applications run concurrently with the ZMA. Considering the circumstances involving ownership and foreclosure that have occurred and the initiatives you intend to undertake regarding the project, I can grant your request for a one (1) year extension to no later than September 5, 2014. Please notethatthe extension is for -the -scope and -scale -of the project that has been under review and significant and substantive changes to the proposal will likely necessitate a new application. Crozet Square Page 2 July 10, 2013 I trust this extension will enable you to complete the work necessary to bring ZMA20 r 000018 Crozet Square to public hearing with the Planning Commission before September 5, 2014. As I mentioned in our telephone conversation, I advise that you schedule a pre -application meeting with staff before proceeding with further submittals. Please coordinate with Claudette Grant, the planner leading review of this proposal, regarding this and other matters pertaining to this application.
