Main St., Suite M Charlottesville VA 22902 RE: SP2013000024 and SP201300026 Blue Ridge Swim Club Dear Kelly -- Thank you for the recent application for this special use permit amendment. Please find review comments included in this letter. Please see the attached re- submittal schedule for a list of dates on which you can submit your revisions and responses to review comments (below and attached), as well as for possible Planning Commission dates. (Please note that the listed dates are the earliest possible, but actual dates need to be selected to suit the revision schedule for each project.) COMMENTS Planning (Scott Clark) • If you have not held the required community meeting for these SPs, we need to discuss the arrangements as soon as possible. We will not be able to schedule a public hearing with the Planning Commission until the meeting has been held. • Please show the 150 -foot lot -width line on the conceptual plan as required in section 4.6.1(c) of the Zoning Ordinance. This line would form the inside edge of the required front "yard" for this lot, and will help to define the limits of possible house locations. • We would recommend that you either reconfigure Parcel X to show a rectangular building site of 5:1 proportions (or less) (as required in section 4.2.2(a) of the Zoning Ordinance), or apply for a special exception from the building -site shape regulations (section 4.2.2(a)(3)) to be reviewed along with the special use permits. This would help to avoid complications at the subdivision stage. If you decide to apply for the special exception, please include information on the topics to be addressed in 4.2.2(a)(3). • Given the proximity of the existing house on TMP 58 -75D, we would recommend that the plan show a buffer area of existing vegetation along that property boundary. The exact depth of that buffer may be affected by any changes you make to the design of Parcel X, so we can discuss that while you are working on revisions. Zoning (Amelia McCulley) • Please see the attached memo. EnaineerinE (Glenn Brooks) It is recommended that a private road and maintenance agreement be provided for the two parcels. Virginia Department of Transportation (Troy Austin) • Please see attached memo. Resubmittal or Public Hearing Within 30 days of the date of this letter, please do one of the following: (1) Resubmit in response to these comments on a resubmittal date as published in the project review schedule (the full resubmittal schedule may be found at www.albemarle.oriz in the "forms" section at the Community Development page). Please use the enclosed resubmittal form; OR (2) Request a public hearing be set with the Planning Commission based on the information provided with your previous submittal (a date will be set in accordance with the Planning Commission's published schedule as mutually agreed to by you and the County), OR (3) Request indefinite deferral and state your justification for requesting the deferral. (Indefinite deferral means that you intend to resubmit /request a public hearing be set with the Planning Commission after the 30 day period.) If we have not received a response from you within 30 days, we will contact you again. At that time, you will be given 10 days to do one of the following: a) request withdrawal of your application, b) request deferral of your application to a specific Planning Commission date as mutually agreed to with staff, or c) request indefinite deferral and state your justification for requesting the deferral. If none of these actions is taken, staff will schedule your application for a public hearing based on the information provided with your original submittal. Please be advised that, once a public hearing has been advertised, only one deferral prior to the Planning Commission's public hearing will be allowed during the life of the application. The only exception to this rule will be extraordinary circumstances, such as a major change in the project proposal by the applicant or more issues identified by staff that have not previously been brought to the applicant's attention. As always, an applicant may request deferral at the Planning Commission meeting. Please feel free to contact me if you wish to meet or need additional information. Sincerely, Scott Clark Senior Planner, Planning Division �W.F County of Albemarle Department of Community Development Memorandum To: Scott Clark, Senior Planner From: Amelia McCulley, Zoning Administrator Date: January 16, 2014 Subject: SP 2013 -024 Blue Ridge Swim Club — initial review comments I have reviewed the initial submittal and have the following comments: 1. The proposed subdivision is an amendment to both prior special use permits (SP 2010 -35 and SP 2010 -41) because the subdivision conflicts with the conceptual plan approved with them. The current legal ad only seems to refer to the amendment of SP 2010 -41 but also needs to list amendment of SP 2010 -35. 2. This amendment to those special use permits involves replacing the new conceptual plan with the prior plan, this plan needs to include all the same details as the prior plan. The new plan will be the plan we use to administer and enforce those special use permits. The current plan is substantially lacking in those critical details. Please ask the applicant to revise the plan to include them. 3. The proposed well on the existing conceptual plan appears to be in the area proposed for the new lot. Please ask the applicant to clarify the location of the well on what will remain the property of the swim club / camp rather than the residential lot. A well is an accessory use and by definition, needs to remain on the parcel with the primary use it serves. 4. Please keep in mind that development of the proposed residential lot can result in tree removal and disturbance. If some of these wooded areas are critical to the swim club and camp, you may wish to include notes on the plan and conditions which limit their disturbance. 5. Please ask the applicant to review the plan as follows: a. Show the location of the well for the swim club /camp; b. Revise note #1 to include SP 2010 -41. The note doesn't need to state the proposed subdivision would not affect those uses — this is more of an application justification than an appropriate note on a plan; c. Delete note #2. It is not advisable to agree to further subdivision without review at a later date. If we wish to allow further subdivision, it should not be a note but a condition of the special use permits with clear criteria — for example that any subdivision is consistent with the SP approval and plan. d. Please revise this plan to provide the same details as the current conceptual plan. The revised plan will continue to guide the uses under the special use permit.
