RE: SP 2013 -28: Sonic Drive -thru (North Town Center)
Dear Mr. Collins:
Staff has reviewed your initial submittal for the above - referenced application for a drive -thru window. We have a
number of comments on your proposal. Some of the comments identify issues that will need to be addressed with your
final site plan submittal but may become conditions of the Special Use Permit (SP). The following issues are those
that would need to be addressed with a revised plan for the SP before staff can recommend approval of the SP. This is
because these issues affect the functionality of the drive -thru and its visibility from the Entrance Corridor:
1. Provide proof that the trees, shrubs and dumpster are permitted in the existing sanitary sewer easement along
the southern perimeter of the project area. Provide a deed book and page reference for that easement.
2. Revise the landscape plan to show the limits of the sanitary sewer easement beneath the row of Inkberry
Holly shrubs. Replace the Inkberry Holly shrubs with a mix of three evergreen shrub species, planted in an
informal, staggered arrangement, and provide proof that they would be allowed in that easement. If they
aren't allowed, increase the planting area. Show their planting heights at 36" minimum. These plantings
should screen views of the drive -thru menu board, as viewed from the Entrance Corridor (see ARB
comments).
3. The stacking in the drive -thru lane is impeding pedestrian use of the ramp crossing the drive -thru lane. It is
recommended that you revise the site layout to remedy this issue. This is only a recommendation, not a
requirement.
4. The 8 westernmost angled parking spaces, across from the entrance to the drive -thru lane, do not have the
required 16 foot travelway width. Revise the site layout to remedy this issue.
5. Widen the drive -thru lane to the minimum 12 foot width required. Drive -thru lane radii appears too small for
AASHTO single unit truck.
6. Widen the bypass lane, along the south side of the building, to the minimum 16 foot width required.
Reviewer's comments are listed below.
Planning
Comments on conformity with the Comprehensive Plan are provided to the Planning Commission and Board of
Supervisors as part of the staff report. Initial comments on how your proposal generally relates to the Comprehensive
Plan are provided here:
The Places29 Master Plan shows this area as commercial mixed use in Neighborhood 2. This designation includes
retail, commercial services, office, hotel/motel/conference facilities and wholesale uses. The proposed use is
similar in type and scale to the designated uses and to other such established uses in the immediate area.
Although the scope of a drive -thru request is somewhat limited for full consideration of Neighborhood Model
principles, the proposal does provide interconnected sidewalks, relegated parking and a building of human scale.
Zoning
The following comments related to zoning matters have been provided by Francis MacCall:
1. The stacking spaces are adequate for this use.
2. The required parking for this use is being met within the development of the Northtown
Center site and the use of the Shopping Center parking calculation.
3. Signage will be addressed through the appropriate permits.
Engineering and Water Resources
The following comments related to engineering and water resources have been provided by Max Greene:
1. Travel ways do not appear to meet the minimum widths per 18-4.12.16,18-4.12.17 and ACDSM 7.C.2. 60
degree parking requires a minimum 20' isle with a minimum stall depth of 20.1 feet for the entire length of
parking area. 18' depth appears to be shown incorrectly.
2. Bumper Blocks are recommended to ensure cars are not hanging out in the travel lane.
3. Drive -thru lane radii appears too small for AASHTO single unit truck. 18- 4.12.17.d
Architectural Review Board:
The ARB has reviewed the subject request for conformance with the Entrance Corridor Design Guidelines and
forwarded the recommendations below as they relate to the drive -thru use. The full text of the ARB's action is also
copied below. Please note that the ARB's recommendation is based on the appearance of the development as
illustrated in the plans they reviewed. Changes to the plan (including those resulting from requirements of other
reviewing agencies) could result in revised ARB requirements.
The following comments were provided by the ARB at their February 3, 2014 review of the proposal:
Regarding the he Special Use Permit for the drive -thru window: The Board by a vote of 5:0, forwarded the following
recommendation to the Planning Commission.
1. Remove the door from the EC elevation and infill with brick on both sides of the stone.
2. Revise the landscape plan to show the limits of the sanitary sewer easement beneath the row of Inkberry
Holly shrubs. Replace the Inkberry Holly shrubs with a mix of three evergreen shrub species, planted in an
informal, staggered arrangement, and provide proof that they would be allowed in that easement. If they
aren't allowed, increase the planting area. Show their planting heights at 36" minimum.
3. Provide proof that all the proposed plantings along the southern boundary are permitted in the sanitary sewer
easement.. If the trees aren't permitted, increase the planting area.
4. Ensure that landscaping will screen the stall menu boards and the drive -thru menu boards as viewed from the
EC.
Regarding the Initial Site Plan: The Board by a vote of 5:0, forwarded the following recommendation to the Agent for
the Site Review Committee.
Staff recommends that the ARB forward the following recommendations to the agent:
• Regarding requirements to satisfy the design guidelines as per § 18- 30.6.4(2), (3) and (5):

o As per § 32.4.2.2(b)(3) and 30.6.4(c)(3) and EC Guidelines 35a and 36b, it is not clear that
sufficient planting area is available along the north side of the parking lot to accommodate trees at
2'/2" caliper, 40' on center; or along the south side of the parking lot (drive -thru travelway) to
accommodate shrubs and trees at 2'/2" caliper, 40' on center; or that sufficient planting area is
available to accommodate shrubs along the western edge of the drive -thru to mitigate the appearance
of the drive -thru use and its associated site features.
Regarding recommendations on the plan as it relates to the guidelines:
o See comments on the preliminary proposal.
Regarding recommended conditions of initial site plan approval:
o A Certificate of Appropriateness is required prior to final site plan approval.
o Clarify how the trees along the north edge of the parking lot will be allowed to reach their natural
form, without excessive pruning, when planted so close to the canopy.
o Provide proof that all the proposed tree and shrub plantings along the southern boundary of the
parking lot and shrubs along the western edge of the travelway are permitted in the sanitary sewer
easements at both locations.
• Regarding conditions to be satisfied prior to issuance of a grading permit:
o None
Regarding the preliminary site and architectural designs: The ARB offers the following comments on the preliminary
site plan and architectural design:
1. Provide building material and color samples for review.
2. Remove the poster display boards from the proposal.
3. Provide an interior building floor plan.
4. Provide a site/building elevation, as viewed from the EC, showing the entire width of the site including the
canopies and building.
5. Provide specs on the proposed glass. Ensure that the VLT shall not drop below 40% and the VLR shall not
exceed 30 %.
6. Provide a dumpster enclosure detail on the site plan drawings. A brick wall enclosure, of the same red brick
in the building, would provide a coordinated appearance.
7. Revise the proposal by relocating all the rooftop units to the EC end of the roof and revising their design so
the top of the unit is below the top of the cornice. Provide a section to confirm.
8. Revise the site plan drawings by labeling all site features shown. On Sheet 5 Site Cross- Sections, verify
which of the cross sections labeled "CROSS SECTION 2" is actually Section 3 and revise the drawing
accordingly.
9. Reduce the negative visual impact of the drive -thru and its associated features, as viewed from the EC, by
revising the planting plan to reduce visibility of this area and redesign the rear and side elevations to relieve
the back door appearance.
10. Revise the Plant Schedule on Sheet 4 Landscape Plan to show all shrub planting heights at 24" minimum.
Include shrub plantings "IV" & "IS" in the schedule.
11. Revise the drawing to show the limits of the sanitary sewer easement beneath the Inkberry Holly shrubs.
Replace the Inkberry Holly shrubs with a mix of three evergreen shrub species, planted in an informal,
staggered arrangement and provide proof that they would be allowed in that easement. Show their planting
heights at 36" minimum.
12. Revise Sheet 4 Landscaping Plan by reducing the spacing of the 1 Allee Elm & 2 London Plane trees, shown
along the northern edge of the site, to 40' maximum. Add another large tree.
13. Include a dashed outline on the landscape plan showing the limits of the canopies. Clarify how the trees will
be allowed to reach their natural form, without excessive pruning, when planted so close to the canopy.
14. Add another large tree in the planting island immediately east of the dumpster enclosure (south end of the
site) and provide proof that all the proposed plantings along the southern boundary are permitted in the
sanitary sewer easement. If trees aren't permitted, increase the planting area.
15. Provide a complete lighting plan for review. All wall and site lights shall be full cutoff fixtures. Canopy lights
shall be flush -mount or recessed. Wall lights shall be down lights only and located so as to illuminate the
sidewalk without over - illuminating the building.
16. Include the standard lighting note on the lighting plan.
17. Provide a lighting plan that limits canopy illumination values to 20 footcandles.
18. Separate applications for signs are required. The sign type is appropriate; however, overly intense sign colors
will not be approved and illumination will be limited to internal illumination of the channel letter text with no
illumination of the backer panel.
19. Remove the poster display boards from the proposal.
20. The stall menu boards facing the EC should not be internally illuminated.
21. Provide a 3D visualization illustrating the view from the corridor, with existing and proposed vegetation.
22. Provide additional information on the stall menu boards to clarify the "advertisement" side.
VDOT
Comments provided by Troy Austin from VDOT are attached.
ACSA/RWSA
The following comments were provided by Alexander Morrison for the ACSA:
The ACSA has reviewed the above - referenced special use permit for the proposed Sonic at North Town Center. The
ACSA hereby approves the special use permit with the following conditions:
1. No obstruction can be placed in existing or future easements.
2. The ACSA will review any resubmittal of the special use permit as well as the final site plan to ensure no
reconfiguration of the site places obstructions in existing or future easements.
The following comments were provided by Victoria Fort for the RWSA:
1. Capacity issues for sewer that may affect this proposal. None Known
2. Requires Rivanna Water and Sewer Authority Capacity Certification. Yes X No

SP Conditions
At this point in the review process, we anticipate that recommended conditions of approval for the Special Use Permit
will relate to the need to adequately address deficiencies in the layout of the site & drive -thru design, as outlined on
page 1, and the need for sufficient plantings to mitigate drive -thru impacts, as conditioned by the Architectural
Review Board.
Action after Receipt of Comments
After you have read this letter, please take one of the actions identified on "Action After Receipt of Comment Letter"
which is attached.
Resubmittal
If you choose to resubmit, please use the attached form. There is no fee for the first resubmittal. The resubmittal date
schedule is provided for your convenience.
Notification and Advertisement Fees
Recently, the Board of Supervisors amended the zoning ordinance to require that applicants pay for the notification
costs for public hearings. Prior to scheduling a public hearing with the Planning Commission, payment of the
following fees is needed:
$262.30 Cost for newspaper advertisement
$200.00 Cost for notification of adjoining owners (minimum $200 + actual postage /$1 per owner after 50
adjoining owners)

$462.30 Total amount due prior to Planning Commission public hearing
Prior to the Board of Supervisor's public hearing, payment of the newspaper advertisement for the Board hearing
needed.

Within 30 days of the date of this letter, please do one of the following:

If you plan to resubmit within 30 days, make sure that the resubmittal is on or before a resubmittal
date as published in the project review schedule. The full resubmittal schedule may be found at

(2) Request Indefinite Deferral
If you plan to resubmit after 30 days from the date of the comment letter, you need to request an
indefinite deferral. Please provide a written request and state your justification for requesting the
deferral. (Indefinite deferral means that you intend to resubmit /request a public hearing be set with
the Planning Commission after the 30 day period.)
(3) Request Planning Commission Public Hearing Date be Set
At this time, you may schedule a public hearing with the Planning Commission. However, we do not
advise that you go directly to public hearing if staff has identified issues in need of resolution that
can be addressed with a resubmittal.
After outstanding issues have been resolved and /or when you are ready to request a public hearing,
staff will set your public hearing date for the Planning Commission in accordance with the Planning
Commission's published schedule and as mutually agreed by you and the County. The staff report
and recommendation will be based on the latest information provided by you with your initial
submittal or resubmittal. Please remember that all resubmittals must be made on or before a
resubmittal date.

By no later than twenty -one (21) days before the Planning Commission's public hearing, a newspaper
advertisement fee and an adjoining owner notification fee must be paid. (See attached Fee Schedule)
Your comment letter will contain the actual fees you need to pay. Payment for an additional
newspaper advertisement is also required twenty -two (22) days prior to the Board of Supervisors
public hearing. These dates are provided on the attached Legal Ad Payments for Public Hearings
form.
Please be advised that, once a public hearing has been advertised, only one deferral prior to the
Planning Commission's public hearing will be allowed during the life of the application. The only
exception to this rule will be extraordinary circumstances, such as a major change in the project
proposal by the applicant or more issues identified by staff that have not previously been brought to
the applicant's attention. As always, an applicant may request deferral at the Planning Commission
meeting.
(4) Withdraw Your Application
If at any time you wish to withdraw your application, please provide your request in writing.
Failure to Respond
If we have not received a response from you within 30 days, we will contact you again. At that time,
you will be given 10 days to do one of the following: a) request withdrawal of your application, b)
request deferral of your application to a specific Planning Commission date as mutually agreed to
with staff, or c) request indefinite deferral and state your justification for requesting the deferral. If
none of these choices is made within 10 days, staff will schedule your application for a public hearing
based on the information provided with your original submittal or the latest submittal staff received
on a resubmittal date.

Most applications for Special Use Permits and Zoning Map Amendment require at least one public hearing by the Planning Commission
and one public hearing by the Board of Supervisors. Virginia State Code requires that notice for public hearings be made by publishing
a legal advertisement in the newspaper and by mailing letters to adjacent property owners. Therefore, at least two fees for public notice
are required before a Zoning Map Amendment may be heard by the Board of Supervisors. The total fee for public notice will be
provided to the applicant after the final cost is determined and must be paid before the application is heard by a public body.
