The County of Albemarle Planning Division will grant or recommend approval of the Boundary Line Adjustment
Plat referenced above once the following comments have been addressed: [Each comment is preceded by the
applicable reference, which is to the Subdivision /Zoning Ordinances unless otherwise specified.]
[14-302(A)(10)&18-10.3.1] Right of further division of proposed lots. While the development rights note
as proposed is approvable, it should be noted that revised parcel 21 D will not be able to realize all 5
development rights within the 1980 boundaries of that parcel (8.562 acres). Since revised parcel 21 C is
only 5 acres (2 development rights maximum due to acreage), development right potential can be preserved
by transferring one development right with Parcel X. If you choose to transfer a development right, please
add a statement that development rights must be used within the 1980 boundaries of their parcel of origin to
the development rights note.
2. [14- 302(8)2] Name of plat preparer. The seal of the plat preparer must be added to the plat before final
approval.
3. [14- 302(8)(10)] Stream buffers. Show and label the stream buffer. Please also add the following note,
"The stream buffer(s) shown hereon shall be managed in accordance with the Albemarle County Water
Protection Ordinance ".
4. [14- 303(A)] Statement of consent to division. The County's standard consent statement was revised
effective January 1, 2014 to be in compliance with state code. Please revise the statement on the plat to
the following: "The platting or dedication of the following described land [insert a correct description of the
land subdivided] is with the free consent and in accordance with the desire of the undersigned owners,
proprietors and trustees if any." (see the new checklists for all subdivision applications)
Staff has provided references to provisions of Chapter 14 of the Code of the County of Albemarle. The Code is
kept up to date by the County Attorney's office. The Code may found on the County Attorney's website which
may be found under "Departments and Services" at Albemarle.org.
In accord with the provisions of Section 14- 229(B) of Chapter 14 of the Code if the developer fails to submit a
revised final plat to address all of the requirements within six (6) months after the date of this letter the
application shall be deemed to have been voluntarily withdrawn by the developer.
