Winters, LS (kwinters @dominioneng.com) From: Rachel Falkenstein, Senior Planner Division: Planning Date: April 10, 2014 Subject: SUB 201400053 Horseshoe Bend Rd & Locust Grove Ln — Boundary Line Adjustment The County of Albemarle Planning Division will grant or recommend approval of the Boundary Line Adjustment Plat referenced above once the following comments have been addressed: [Each comment is preceded by the applicable reference, which is to the Subdivision /Zoning Ordinances unless otherwise specified.] 1. [14- 302(A)(2)] Vicinity Map. Revise the scale of the vicinity map to 1 inch equals 2000 feet. 2. [14- 302(A)(10)] Right of further division. Based on previous plats it appears that TMP 29 -63D and TMP 29 -80 contain 5 development rights each. Please note on the plat if development rights are being impacted by this Boundary Line Adjustment and included the following note: "Parcel [letter or number] contains [number] development rights and may /may not be further divided and when further divided these rights shall not comprise more than [number] acres. Parcel [number] contains [number] development rights and when further divided it shall not consist of more than [number] acres." 3. [14- 302(A)(16)] Dam break inundation zones. A portion of TMP 29 -63D appears to be within the dam break inundation zone according to the County's GIS. Show the limits of the zone on the plat. 4. [14- 302(B)(7)] Reservoir watershed; agricultural forestal district. According to the County's GIS the parcels are within the Lower Mechums River Water Supply Watershed. The parcels are also within the Moorman's River Agricultural- Forest District. Amend note 7 to reflect this. 5. [14- 302(B)(10)] Stream buffers. Show the locations of stream buffers as required by the Water Protection Ordinance and add the following note, "The stream buffer(s) shown hereon shall be managed in accordance with the Albemarle County Water Protection Ordinance." 6. [14- 303(A)] Statement of consent to division. The County's standard consent statement was revised effective January 1, 2014 to be in compliance with state code. Please revise the statement on the plat to the following: "The platting or dedication of the following described land [insert a correct description of the land platted] is with the free consent and in accordance with the desire of the undersigned owners, proprietors and trustees if any." *Note — I think this revision to the existing consent language will satisfy the property owners' concerns conveyed to me by Scott Peyton (concerns of calling the action a "subdivision" when it is really a boundary line adjustment). Therefore the additional note sent via email should not be needed. You may also remove the language above the County Approval signature line. This language is not required. 7. [14- 302(6)1] Date of last revision. Please add the date of last revision with each resubmittal.
