Subject: SUB 201400070 Jennifer Levien — Rural Subdivision Plat
The County of Albemarle Planning Division will grant or recommend approval of the Final Plat referenced above
once the following comments have been addressed: [Each comment is preceded by the applicable reference,
which is to the Subdivision /Zoning Ordinances unless otherwise specified.]
1. [14- 302(A)(1)] Name of subdivision. The name of the subdivision should be the same on both sheets;
revise the title on sheet 2 to match that provided on sheet 1.
2. [14- 302(A)(4)] Private easements. This subdivision application proposes creating one new five acre parcel
that has adequate frontage on an existing public road. Therefore, no private street should be created with
this application (it isn't necessary or approvable until further division of Lot A is proposed). Please remove
the `private road' from the plat and all references to the private road from the notes.
3. [14- 302(A)(7)] Existing and departing lot lines. Old internal boundary lines (from the boundary line
adjustment recorded in DB 4460 PG 74) are shown on this plat to delineate the boundaries of old "Parcel V;
to eliminate any confusion, label these lines with something like `old parcel line vacated with DB 4460 PG
74'.
4. [14- 302(A)(9)] Building site on proposed lots. The building site note provided refers to Lot A only; a
reference to the residue of TMP 47 -57 also having an adequate building site should be added to this note.
5. [14- 302(A)(10)] Right of further division. Please revise the development rights note as follows, "Lot A is
assigned 2 development rights (one from TMP 47 -57 & one from TMP 47 -74 (from parcel x)) and may be
further divided. The residue of Tax Map /Parcel 47 -57 retains 5 development rights (four from TMP 47 -57 &
one from TMP 47 -74 (from parcel x)) and may be further divided. When further divided the development
rights must be used within the limits of the 1980 boundary of their parcel of origin, and the two development
rights from TMP 47 -74 cannot exceed 6 acres total ".
6. [14- 302(A)(11)] Instrument creating property proposed for subdivision. Include the most recent instrument,
DB 4460 PG 74, in the legal references.
7. [14- 302(8)(8)] Yards. Since no private street can be created with this application, the setbacks should be
revised to reflect frontage off of Route 784 (setbacks noted as fronts and rears on this plat should be sides,
and the setback noted as a side should be a rear).
8. [14- 302(8)(8) & 4.6.1(c)] Yards. The depth of front and rear yards must be established where minimum lot
width is achievable, and minimum lot width shall be maintained between the front and rear yard. Therefore,
the front setback line should be moved south and the rear setback line should be moved north to where the
minimum lot width of 250' is achieved.
9. [14- 303(0)] Signature panels. Remove the VDOT signature line from the plat.
10. [14- 308.1] Groundwater assessment. A Tier 2 Groudwater Review must be initiated by paying the required
$330 fee. Approval of this plat cannot be granted until this fee is paid.
11. [14 -309 & 14 -310] Soil evaluations & Health director approval of septic systems. The submitted soils
evaluations were forwarded to the Health Department on April 23, 2014; the plat cannot be approved until
their approval is received.
12. [14 -316] Approval of entrance onto public streets. Please provide VDOT approval of the proposed
entrance; contact information can be provided if needed.
