Perez, Senior Planner Division: Planning Date: July 7, 2014 Subject: SUB201400093 Hyland Ridge, Phase II - Final Fax 434 - 972 -4126 The County of Albemarle Planning Division will approve the plat referenced above once the following comments have been satisfactorily addressed (The following comments are those that have been identified at this time. Additional comments or conditions may be added or eliminated based on further review.): [Each comment is preceded by the applicable reference, which is to the Subdivision/Zoning Ordinances unless otherwise specified.] 1. [18- 13.3,14- 303(D] It appears this. proposal is taking advantage of the Bonus Cluster provision of the ordinance for R -1 zoning. If this is the case clearly state this information on sheet 1. If the applicant chooses to rely on note #8 to state this information, the note shall be revised to state this information more clearly as. it does not read well and causes confusion. 2. [18- 13.3,14- 303(D] Also, if the site is utilizing Bonus Cluster provision of the ordinance for R -1 zoning, the site requires 25% open space to be provided per the Cluster provisions in the ordinance. To assure this requirement is met, provide a calculation on the cover sheet to depict the 25% open space requirement is met, to exclude future phases and open space which have yet to be platted and is not the subject of the plat under review. Also, to keep track of the open space depicted in the chart, staff recommends the applicant revise sheet 2 to depict all the platted area of open space from previous phases. The preliminary plat did a fairly decent job of providing this information. 3. [18- 13.3,14- 303(D] Minimum Lot Size. Under the Bonus Cluster provision of the ordinance for R -1 zoning, each lot is required to be a minimum of 20,000 Square Foot in area. Provide a note on the plat which states the minimum lot size requirement for this development. Also, on the plat provide the Square Footage calculations for each lot in addition to acreages. Revise appropriately. 4. [14- 403,18- 4.6.1,18 -13.3] Minimum Lot Frontage. Under the Bonus Cluster provision of the ordinance for R -1 zoning, each lot is required to have a minimum of 80' of frontage on a public or private road. The Culdesac lots are permitted a reduction in frontage per section 4.6.1; provided that driveway separation shall be in accordance with Virginia Department of Transportation standards. It appears Lot 83 and Lot 84 take advantage of this provision. For these two lots depict the driveways on the plat, and depict the front yard setbacks, which shall be measured as described in section 4.6.1(c), (front yards to where the minimum lot width is achievable). 5. [14- 302(B)5] Zoning Classification. On sheet 1, under Notes, revise #8 to provide the rezoning. information/ number for "ZMA94 -06 with proffers" which is associated with this parcel and the area being divided. 6. [ZAIA94 -06 Proffer 3] Ten trees per acre shall be provided or retained on all lot designated areas of the final approved plans. Deciduous trees shall be 1.5 to 2 " in caliper; non - deciduous trees shall be four to five feet in height. Location shall be distributed among all lots. This proffer does not appear to be met. How does the applicant intend to meet this proffer? 7. [Condition #7 of Preliminary Plat approval 4-26-20071,4 conservation plan checklist must be completed and incorporated into the site plan with notes to show how any individual trees and groups of trees designated to remain will be protected during the construction of this project. The locations of any tree preservation fencing that coincides with the limits of clearing and other methods ofprotection from the checklist must be shown on the plan for clear identification during field inspections. This condition of approval does not appear to be met. How does the applicant intend to meet this condition? 8. [14- 301(C)] Form and Style of Plats. Pages 3 and 4 depict some of the same lots (77 -80 and 87 -89). To . avoid confusion, revise the plat to provide match lines and avoid depicting the same lots on separate pages. 9. [14- 302(B)10] Stream buffers. On the final plat for the SWM area (0.992 acres) depict the 100' buffer in its entirety to assure it is contained on the lot or does not interfere with development on adjacent lots. 10. [14- 302(3)10] Stream buffers. On the plan provide the following stream buffer note: "The stream buffer(s) shown hereon shall be managed in accordance with the Albemarle County Water Protection Ordinance. " 11. [14- 302(A)14,14- 303(G)] Who will maintain the SWM lot which is depicted on the plat? Sheet 1, note #11 mentions Open Space and Common Areas shall be transferred and maintained by the HOA ... etc. Does the plat list who shall maintain the SWM facility? Or is the SWM facility to be classified as open space too? 12. [14- 302(A)9] Building sites on proposed lots. Assure note #6 is accurate, as the 0.992 acres SWM lot and the 0.032 acres of Open Space do not appear to contain a building site. Revise appropriately. 13. [14- 302(A)9] Building sites on proposed lots. The Planning Commission approved a critical slope waiver request for this subdivision on April 17, 2007. Please note this waiver and date of approval on the plat. 14. [Comment] On sheet 1, under Area and Density Calcs for the Tree Conservation Area of Phase 3A, the plat lists Area `A'; however, upon review of that sub plat (DB4420PG576) it truly is listed as Area `D' on the plat. Revise appropriately as this appears to be a typographical error. 15. [Comment] On the plat label the 0.032 acres as "Open Space for Pedestrian Trail"'. 16. [14- 302(T)] Special Lot. The plat creates a 0.992 acre SWM lot and a 0.032 acre Open Space lot; these are classified as special lots per Section 14 -106. On the plat provide the following note: "Lot `X' is a special lot established solely for (insert purpose for the special lot as identified in the definition of special lot in section 14- 106)." Revise appropriately. 17. [14 -317] Instrument evidencing maintenance of certain improvements. Prior to Final Plat approval, an instrument evidencing maintenance of the Open Space will need to be submitted for County review and approval. The County Attorney will be required to review/ approve the maintenance documents prior to final plat approval. Submit the draft documents to Planning staff for cursory review and then we'll forward them to the County Attorney for review/ approval. 18. [14 -3035] Control points. Control points must be submitted. At the option of the subdivider, the control points may be shown on a copy of the final plat, rather than on the original final plat. 19. [14- 302(B)(1)] General Information. When the plat is revised, please provide the date of the last revision on the plat. 20. [14- 303(L)] Public utility, drainage and sight distance easements. Please provide a Deed of Easement for all drainage easements for review and approval by the County Attorney's Office. This deed must be recorded with the plat. 21. [Comment] Has Hyland Creek Drive already been platted and recorded? Staff asks because this road is depicted on the County Web GIS. If it has been, please provide the deed book page reference information on the plat for the right of way. 22. [14 -435] Does Hyland Creek Drive have an approved road plan associated with it? Staff has been unable to locate an approved road plan for this section. If a road plan was approved, when was it approved, and under what SUB #? If a road plan has not been approved, such a plan shall be furnished to the County for review. Also, roads must be built or bonded prior to the signing of the final plat. 23. [14 -414, 430] Public water and sewerage, Dedication of water and sewerage system. ACSA approval is required. 24. [14 -426, 4281 Dedication of land for public use, Dedication of streets. VDOT approval is required. 25. [Comment] This plat cannot be approved until all bonds for this phase have been posted (Road and WPO). Additionally, the Deed of Drainage Easement must each be reviewed by the County Attorney's Office. Once the plat is approvable, the Deeds must be modified with the latest revision date and resubmitted for County Executive signature. The supplemental declaration must also be reviewed by the County Attorney's Office, but no County signature is required. The approved plat cannot be released until all associated documents are approved and signed. Please contact Christopher P. All infrastructure must be built or bonded prior to plat approval. 2. Please show the 100 year water level limits, inlet and discharge in the swm area parcel, to ensure that the area adequately covers the facility. 3. Drainage easements to be maintained by VDOT with the road must be dedicated to public use. My comments are as follows: • V3: Call out sewer easement as "New 20' ACSA Sanitary Sewer Easement." • V3: Sewer easement on lots 88 and 89 do not match the approved plans. • V3: Show new or call out existing sewer easement on Lot 94. • V3: Show sewer easement along the following parcels: o 70 o 71 o 72 o 69 o 73 • V3: Show existing sewer easements in Phase 3A. • V4: Call out sewer easement as "New 20' ACSA Sanitary Sewer Easement."
