Main Street, Suite 400 Charlottesville, VA 22902 RE: SP2014 -00010 — Branchlands Assisted Living Facility Dear Valerie: Staff has reviewed your re- submittal request for an assisted living facility, dated June 2, 2014. The following divisions have no objection to this special use permit proposal: Planning, Engineering, Fire - Rescue, Zoning and VDOT. ASCA Comments from ACSA will be provided upon receipt. Staff understands that Mr. Adelman has been meeting with members of the Branchland's Property Owners Association to resolve and clarify some of the adjacent resident's concerns. I would like to discuss the status of this with you prior to the public hearing. SP Conditions The following SP Conditions were approved with SP 96 -22: 1. Development limited to 90 units containing not more than 120 beds; 2. Prior to occupancy, the applicant shall present to the Zoning Administrator proof of licensure by the VA. Department of Health and the Virginia Department of Social Services; 3. This use shall be operated only under licensure of the Virginia Department of Health and the Virginia Department of Social Services. The following Conditions are proposed with SP2014- 00010: 1. Development and use shall be in general accord with the following revised plan prepared by Timmons Group Sheet(s) C1.0 (SUP Conceptual Plan), dated March 17, 2014, revised 6/2/14 (hereafter "Layout Plan "), as determined by the Director of Planning and the Zoning Administrator. To be in general accord with the specified plans, development and use shall reflect the following major elements as shown on the plans: — Building location, orientation and mass Page I of 3 Revised 4 -25 -11 eke — Location and general character of parking and garden Minor modifications to the plan that do not otherwise conflict with the elements listed above, may be made to ensure compliance with the Zoning Ordinance. 2. Development shall be limited to 84 units containing not more than ? beds; 3. Prior to occupancy, the applicant shall present to the Zoning Administrator proof of licensure by the VA. Department of Health and the Virginia Department of Social Services; 4. The use shall commence on or before [2 years from date of approval] or the permit shall expire and be of no effect. In general, primarily all of the staff comments have been addressed. You have until July 7, 2014 to formally request a public hearing with the Planning Commission and pay the legal ad fees, which are listed below. Following this schedule, a public hearing with the Planning Commission could be no sooner than July 29, 2014. Notification and Advertisement Fees Prior to scheduling a public hearing with the Planning Commission, payment of the following fees is needed: $93.35 Cost for newspaper advertisement $200.00 Cost for notification of adjoining owners (minimum $200 + actual postage /$1 per owner after 50 adjoining owners) $293.35 Total amount due prior to Planning Commission public hearing Prior to the Board of Supervisor's public hearing, payment of the newspaper advertisement for the Board hearing needed. $93.35 Additional amount due prior to Board of Supervisors public hearing $386.70 Total amount for all notifications Fees may be paid in advance. Payment for both the Planning Commission and Board of Supervisors public hearings may be paid at the same time. Additional notification fees will not be required unless a deferral takes place and adjoining owners need to be notified of a new date.
