RE: SDP2014 -052 Mechum's Trestle- Preapplication Plan
Mr. McKechnie:
Your preapplication submittal has been reviewed and comments are provided below. These comments do
not constitute a final review of your project. The Agent has made a good faith effort to determine
compliance with the requirements of Chapter 18 of the Code of the County of Albemarle, and to identify
all deficiencies. This has not been reviewed by Fire and Rescue or the Building Official, and it is
possible that those entities may have additional significant comments. It is possible that during the
formal review of your application that additional comments may be generated. Failure to identify a
deficiency during preapplication review does not relieve the project from compliance with Chapter 18 of
the Code.
In accord with the provisions of Section 32.4.1.4 of Chapter 18 of the Code of the County of Albemarle
the agent has reviewed the above referenced preapplication plan and has the following comments:
Special Use Permits Required:
1. [22.2.2 (11)] Water Usage exceeding 400 gallons per site acre per day. Please be advised that if
the proposed use will exceed 556 gallons of water usage per day, a special use permit is required
prior to site plan approval. Please work the Health Department for this water usage calculation
and provide it to us.
2. Proposed grading activities in the floodway fringe; Per section 30.3.11, "Grading activities,
including cut or fill, in compliance with the Water Protection Ordinance, but for which the floodplain
administrator determines will or may cause the base flood elevation to rise or the horizontal limits of the
floodplain to expand"
Please consult the Zoning Ordinance table in section 30.3.11. Grading activities in the floodway
are prohibited.
For proposed grading activities in the floodway fringe, a Floodplain Development Permit is
required according to section 30.3.12A. This is a detailed study area (Zone AE, FEMA FIRM
235 and 245) which falls under criteria in 30.3.13A.
Special Exceptions Required:
1. [32.7.9.5(d)] The landscape buffer shown closest to Route 240 adjacent to the parking lot is
required to be located in the parking setback. This requirement will need to be modified to allow
the landscape buffer to be located in the right of way.
2. Exception to allow development within the stream buffer. The program authority is only
authorized to allow development within the landward 50' of buffer in accordance with Water
Protection Ordinance section 17 -604A. Section 17 -408 allows a possible exception to this in the
context of the overall VSMP package.
3. [4.2] Disturbance of critical slopes
4. [4.12.15(g)] Modification to allow no curb or gutter within parking area
Virrinia Department of Transportation:
1. VDOT- AME spacing exception for the entrance
Required chanzes. The following changes are required for the plan to comply with Chapter 18 of the
Code:
1. [32.5.2(n)] Existing and proposed improvements. Provide the exact square footage of the
restaurant, including outdoor seating area in order to determine if more parking is
needed/required. The plan states plus or minus 4,OOOsf, however the front page states 4,000,
clarify.
2. [32.5.2(b)] Information regarding the proposed use. Break down the schedule of parking, show
the amount required vs provided. Also, include how many loading and handicap spaces are being
provided.
3. [32.5.2(s)] Additional information. Submit Dam Innundation zone information for assessment by
DCR (reference Section 32.5.6).
4. [32..4.13(d)] Topography and proposed grading. Topography must be shown for the entire
parcel and fifty feet outside of the parcel. Show the topography on the other side of the
Lickinghole Creek.
5. [32.4.1.3(n); 4.12.19] Existing and proposed improvements. Dumpster pads. The dumpster pad
does not meet the requirements of theordinance. Also, screening will need to be provided.
6. [32.4.1.3(n)] Existing and proposed improvements. The plan does not state whether or not there
will be lighting. If lighting is proposed, it will need to meet ARB guidelines and section 4.17 of
the zoning ordinance.
7. [32.4.1.4(f)] Additional information. Architectural information should be submitted with the
initial site plan for ARB review.
8. [32.4.1.4(f)] Additional information. The footprint of the building appears to be different than
what was originally approved by the ARB. It will require additional review.
9. [32.4.1.4(f)] Additional information. Overhead electric line may interfere with required
landscaping by the ARB.
10. [32.4.1.4(f)] Additional information. This preliminary review does not include information from
Fire and Rescue or the Building Official. They may have additional comments.
11. [32.4.1.4(f)] Additional information. Will the well be located on its own lot? If so, a well lot
subdivision plat will need to be submitted and approved.
Additional information. The following information is required to be submitted with your site plan
application:
- Application [Attached]
- Exceptions with justifications for above noted modifications
- Dam Inundation Zone information
- BS &P Permit
- Mitigation plan for the disturbance within the stream buffer
- AME spacing exception for entrance to be submitted to VDOT
Staff has provided references to provisions of Chapter 18 of the Code. The Code is kept up to date by the
County Attorney's office. The Code may found on the County Attorney's website which may be found
under "Departments and Services" at Albemarle.org.
