[14- 302(A)(9)] Building sites on proposed lots. Revise the building site note to indicate that TMP 104 -13C does not have a building site that meets section 4.2.1, but there is an existing house on the parcel. 2. [14- 302(A)(10)] Right of further division. The development rights note should be revised as follows: Development rights are not affected by this boundary line adjustment plat. Tax Map 104, Parcel 12 has five theoretical developments rights and may be further divided. Tax Map 104, Parcel 13C has one development right and may not be further divided. Please also remove the note that states, "no further division without planning commission approval ". 3. [14- 302(8)(2)] Name of plat preparer. Provide the seal of the plat preparer. 4. [14- 302(8)(5)] Zoning classification. Add FH (flood hazard overlay) to the zoning note for each parcel. 5. [14- 302(8)(10)] Stream buffers. Portions of the stream buffer appear to be represented incorrectly, show the stream buffer as it appears in County GIS. 6. [14- 303(A)] Statement of consent to division. The County's standard consent statement was revised effective January 1, 2014 to be in compliance with state code. Please revise the three statements on the plat to the following: "The platting or dedication of the following described land [insert a correct description of the land subdivided] is with the free consent and in accordance with the desire of the undersigned owners, proprietors and trustees if any." (see the new checklists for all subdivision applications) Staff has provided references to provisions of Chapter 14 of the Code of the County of Albemarle. The Code is kept up to date by the County Attorney's office. The Code may found on the County Attorney's website which may be found under "Departments and Services" at Albemarle.org. In accord with the provisions of Section 14- 229(B) of Chapter 14 of the Code if the developer fails to submit a revised final plat to address all of the requirements within six (6) months after the date of this letter the application shall be deemed to have been voluntarily withdrawn by the developer.
