2. [32.5.3(a)] This application was reviewed against Site Development Plan requirements only. Any
subdivision related comments are provided for reference only unless necessary for final site plan approval.
Prior to final site plan approval the final subdivision plat and road plan serving the commercial lots shall be
approved by the County, and the plat recorded in the Clerk's Office. The deed book page information of the
recorded plat shall be provided on the final site plan.

3. [32.5.2(n) & (i)] As proposed a portion of the private road is taking place on the adjacent residential parcel
zoned PRD, specifically within the 30' vegetative buffer on the residential parcel and within the area of the
20' undisturbed buffer between the residential and commercial zonings. As you know the property owner
was sited for violations of the above two areas by the Zoning Department for unauthorized disturbance of
these areas. The applicant is currently working to remedy the site plan violation of the 30' vegetative buffer
through a mitigation plan (SDP2013 -35). Prior to final site plan approval the mitigation plan must be
approved by the County, to include ARB, Planning Staff, and Zoning staff.
Final Rev 3: Comment acknowledged by applicant. Pending Sept 3rd BOS meeting, otherwise
mitigation plan is approvable. Please submit a minimum of 4 copies of the mitigation plan for
approval.
Also, the applicant is attempting to remedy the disturbance of the 20' undisturbed buffer through a special
exception as described in Section 21.7(c). The applicant intends to utilize the mitigation plan described
above as an exhibit to take to the Board of Supervisors for review /approval. Prior to the special exception
going to the Board of Supervisors the proposed plantings in the mitigation plan must be approved by ARB,
Planning staff, and Zoning staff. Prior to final site plan approval the applicant shall receive approval of the
mitigation plan, and receive the Board of Supervisors approval of the--special exception. If all the above have
been satisfied then the plantings shall be provided on the final site plan's landscaping plan.

44. [5.1.20] As discussed in the email dated July 16a' 2014 a Special Exception is required for the 100' setbacks
for underground storage tanks to property lines. Chapter 18 Section 5.1.20, Supplemental Regulations
5.1.20(b)J No storage tanks and loading facilities shall be located closer than one hundred (100) feet from
any lot line. ". The special exception request was received on 7 -28 -14 and is being processed. The Special
Exception is required prior to approval of the final site plan as currently designed. Rev 3. Comment still
relevant, pending results of Sept 3 SOS meeting.
45. [8.5.5.3] During the review of the final subdivision plat for the commercial lots (SUB2014 -120) it became
apparent that a variation would be required to the Briarwood PRD application plan (ZMA2005 -09). The
approved application plan does not depict a road in this location which goes through any portion of
Briarwood PRD (specifically the open space TMP 32G- lB -2 -B). The Variation request was received on 8-
4-14 and is being processed. The Variation is required prior to approval of the final subdivision plat as
currently designed. Rev 3. Comment still relevant, pending results of Sept 3 BOS meeting.

46. Landscaping — Page 7, the Gas Station Plant Schedule provides a total canopy of 9,085; however, when the
canopy of the trees listed is added it comes out to 12,833. This appears to be a mathematical error. Revise
accordingly. If when making this correction you choose to modem the amount /type of landscaping provided
staff will need to re- review the landscape plan.
47. Landscaping — Page 7, the Gas Station Landscaping Calculations table lists there as 27 parking spaces;
however, there are only 23 provided on the plan. Revise accordingly. If when making this correction you
choose to modify the amount /type of landscaping provided staff will need to re- review the landscape plan.

Dear Mr. Perez:
We have reviewed the final site plan for the Briarwood Gas Station dated 6/9114 as submitted by
Collins Engineering and offer the following comments:
I . The road plan for "Road A ", "Road B" and improvements to Briarwood Drive and Route
29 should be approved prior to approval of this site plan.
2. All previous review comments have been adequately addressed.
3. A Land Use Permit will need to be obtained from this office for all work to occur within
dedicated right -of -way prior to commencement of such work. This includes the grading
in the Route 29 right -of -way and the installation of the detention outfall located within
the right -of -way.
We have no objection to the approval of this site plan upon the approval of the road plan for
improvements to Briarwood Drive and Route 29. If you need additional information concerning

Dear Mr. Perez:
We have reviewed the final site plan for the Briarwood Gas Station dated 6.'-'9::14 as submitted by
Collins Engineering and offer the following comments:
1. The road plan for "Road A ", "Road B" and improvements to Briarwood Drive and Route
29 should be approved prior to approval of this site plan.
2. All previous review comments have been adequately addressed.
3. A Land Use Permit will need to be obtained from this office for all work to occur within
dedicated right -of -way prior to commencement of such work. This includes the grading
in the Route 29 right -of -way and the installation of the detention outfall located within
the right -of -way.
We have no objection to the approval of this site plan upon the approval of the road plan for
improvements to Briarwood Drive and Route 29. If you need additional information concerning

The County of Albemarle Planning Division will recommend approval of the plan referenced above once the
following comments have been satisfactorily addressed (The following comments are those that have been
identified at this time. Additional comments or conditions may be added or eliminated based on further
review.): [Each comment is preceded by the applicable reference, which is to the Subdivision/Zoning
Ordinances unless otherwise specified.]
Conditions of Initial Plan Approval (from approval letter dated 6/4/14):
1. [32.6] A site plan meeting all the requirements of section 32.6 of Chapter 18 of the Code.

2. [32.5.3(a)] This application was reviewed against Site Development Plan requirements only. Any
subdivision related comments are provided for reference only unless necessary for final site plan approval.
Prior to final site plan approval the final subdivision plat and road plan serving the commercial lots shall be
approved by the County, and the plat recorded in the Clerk's Office. The deed book page information of the
recorded plat shall be provided on the final site plan.

[32.5.2(n) & (i)] As proposed a portion of the private road is taking place on the adjacent residential parcel
zoned PRD, specifically within the 30' vegetative buffer on the residential parcel and within the area of the
20' undisturbed buffer between the residential and commercial zonings. As you know the property owner
was sited for violations of the above two areas by the Zoning Department for unauthorized disturbance of
these areas. The applicant is currently working to remedy the site plan violation of the 30' vegetative buffer
through a mitigation plan (SDP2013 -35). Prior to final site plan approval the mitigation plan must be
approved by the County, to include ARB, Planning Staff, and Zoning staff.

Also, the applicant is attempting to remedy the disturbance of the 20' undisturbed buffer through a special
exception as described in Section 21.7(c). The applicant intends to utilize the mitigation plan described
above as an exhibit to take to the Board of Supervisors for review /approval. Prior to the special exception
going to the Board of Supervisors the proposed plantings in the mitigation plan must be approved by ARB,
Planning staff, and Zoning staff. Prior to final site plan approval the applicant shall receive approval of the
mitigation plan, and receive the Board of Supervisors approval of the special exception. If all the above have
been satisfied then the plantings shall be provided on the final site plan's landscaping plan.

Staff is concerned with the current proposal, as the entrance to the site relies entirely on the above
approvals. Notably the road as currently depicted relies heavily on retaining walls, staff is apprehensive
about the applicant providing the required plantings as described above on these retaining walls.
Verification will be required prior to final site plan approval that the retaining walls can sustain the required
plantings weight and that the plantings root systems will not jeopardize the integrity of the walls.
Final: Item to be addressed on road plan and by Engineering staff.
4. 132.7.2.1, 32.5.2(m), 32.5.2(n), 32.7.9.71 Vehicular Access to the Site. The final site plan for the gas station
shall include the private road which is to serve the site, to include the right -in- right -out portion of the private
road which accesses Rte 29. This requirement is being predicated by the TIA which relied on the right -in-
right -out to disperse traffic from the site.
Final: Item to be addressed on road plan and is not required for the final site plan. Per discussions
with VDOT the road plan will dictate the right in right out.
Also, the road plan depicts an above ground stormwater management facility near the right -in- right -out
portion of the private road, which serves as the road's stormwater. Because the road is required to serve the
gas station, and the stormwater facility is visible from Rte 29, the stormwater facility shall be screened per
32.7.9.7. The required landscape screening shall be provided on the landscape plan of the final site plan.
Final: Comment no longer valid as the water being sent to the SWM facility is not from the gas station
site.
5. 132.5.2(a) & (n)] General information. The adjacent parcel, north of the site, is labeled on the site plan as
Tract B, TMP 32G Parcel 1, Zoned C -1; however, the GIS and previously recorded plats depict this land as
TMP 032GO- 08- 00- OOOAO, Open Space, Zoned PRD. Revise.

6. 132.5.2(a), (n) & (i)] General information. As discussed above a portion of the private road is taking place
on the adjacent residential parcel TMP 032GO- 08- 00- OOOAO. As such this parcel shall be listed on the site
plan. Throughout the site plan revise to include the correct adjacent parcel information, such as: owner
information, tax map parcel number, and zoning.

7. [32.5.2(i)] All proposed off site easements will need to be submitted as a plat and be recorded prior to
approval of the final site plan.
Final Rev 2: Comment being addressed through final subdivision plat. The plat shall be approved and
recorded prior to approval of final site plan.
8. [32.5.2(n)] Proposed improvement. The road serving the site is proposed to be private. The applicant has
chosen to move forward with the subdivision of commercial lots and the road plan for review/ approval of
the private road that meets county Private Road Standards pursuant to Section 14 -412B. The private road
request will need to meet the requirements of Section 14 -234. After the subdivision and road plan has been
reviewed/approved and recorded the site plan shall depict the private road and then the final site plan can be
approved (provided all other site plan related requirements have been met).

9. [32.5.6(i), 4.12.17(c)(1)] Proposed improvement. Two way vehicle access aisles are required to be 20'
minimum. The plan proposes access ways of varying widths, such as 16' and 18'. This is not adequate.
Revise to provide for the required 20' minimum for all two way accesses.

10. 132.5.2(n), 4.12.19(c)] Screening. Dumpsters shall be screened as required by section 32.7.9 and, where
applicable, section 30.6. Assure the dumpster is appropriately screened. On the final site plan provide the
material used in the enclosure and the height of the enclosure.

11. [32.5.2(n)] Proposed improvement. On sheet 3, the plan depicts a thatched area adjacent to the 6 parking
spaces fronting the building. On the site plan label this improvement.

12. [32.5.2(n)] Proposed improvement. Sheet 1, general notes, under retaining walls, there is a note which
reads: "no retaining walls are proposed". The proposal utilizes retaining walls. The note shall be
revised/removed on the final site plan. Also, the engineering details for the retaining walls shall be provided
in the final site plan.

13. [32.5.2(n)] Proposed improvement. Dimension the full height and width of the retaining walls required for
construction.

14. 132.5.2 (n)] Proposed improvement. What kind of walls are the retaining walls? Are they block/redi -rock
walls, geogrid? Provide this information on the plan.

15. 132.5.2 (n)] Proposed improvement. On the plan provide the limits of disturbance for the proposal, to
include the area to construct these walls, and the private road.

16. [32.5.2 (m) & (n), 4.12.17(b)] Proposed Egress. "Entrances to parking areas from public streets or private
roads shall be designed and constructed in accordance with Virginia Department of Transportation
standards... " VDOT approval shall be required.

17. [32.5.2 (n)] Proposed improvement. Indicate the height of the gas canopy structure. Also provide the height
the of the gas station building. Does the site propose to have a loading space? If so, provide the location and
dimension of the loading space.

18. [32.5.2(m), 14- 422(D) & 32.7.9.51 Planting Strip. Dimension the sidewalks and the plantings strips.
Planting strips are required to be a minimum of 6' in width. If the applicant wishes to seek a special
exception by the Board of Supervisors for the planting strip requirements per 14 -422F please submit the
request and appropriate documentation.
Final Rev 2: The waiver was approved by the PC. Thus as condition of approval the required street
landscaping is to be pushed outside of the planting strip and is to be behind the sidewalk, landscape
easements to contain these plantings shall be platted on the final subdivision plat for the commercial
lots, as they are no longer in the right of way. The easements and required street trees shall be shown
on the final site plan, as the required trees cannot be bonded on the road plan be they are out of the
right of way. The site plan shows these easements but the final plat does not. Assure these efforts are
coordinated on all plans.
19. [32.5.2(1)] Existing and proposed utilities. Provide the location of any existing utilities and utility easements
including telephone, cable, electric and gas.

20. [32.5.2(p)] Landscape plan. When the landscape plan is provided assure that the proposed plantings are
outside of existing and proposed easements or provide proof of authorization from the easement holder.

21. [32.5.2(e)] Landscape plan. Show the utilities on the landscape plan to ensure that plantings are not
occurring overtop of easements or pipes.

22. [32.5.2(e), 32.7.9.4(c)] Existing landscape features. The site has a small stand of existing trees onsite;
however, none of these trees are depicted on the existing conditions sheet. Depict these trees on existing
conditions sheet of the plan. If they are to be removed, on the plan depict this.

23. [32.5.2 (b) & (n)] Information regarding proposed use. Assure that the proposed size of the building is
correct throughout all sheets of the site plan. As sheet 1, under general notes, Existing/ Proposed Use and
Impervious Area for the building lists 3,600 SF building; however, sheet 3 provides for a 50'x74' building,
which is 3,700 SF. Revise.

24. 132.5.2 (b) & (n) & 4.12.2(a)(3), 4.12.4(a)] Maximum number of parking spaces. Sheet 1, General Notes,
under Parking Required, assure the calculation utilizes the correct square footage of the building, currently
it's listed as 3,600 SF.

25. 132.5.2 (b) & (n) & 4.12.2(a)(3), 4.12.4(a)] Maximum number of parking spaces. Sheet 1, General Notes,
under Parking Proposed the plan lists 27 spaces; however, the number of parking spaces in a parking area
may not exceed the number of spaces required more than twenty (20) percent. This site appears to be over
the maximum permitted. Revise.

26. [32.5.2(a), 21.7] Setbacks. With the proposed widening of Briarwood Drive the proposed gas station
building does not appear to meet the minimum 30' setback to a public right of way. Revise appropriately.

27. [32.5.2(i)] Street names. Provide street names for all proposed streets for approval from E911.

28. [32.5.2(s)] Additional information. On the site plan provide a diagram for Fuel Truck Turning Movements.

29. [32.5.2(a)] Being this site is located in the Entrance Corridor (EC), approval from the Architectural Review
Board (ARB) is required prior to final site plan approval.

30. [32.5.2(n)] Will a free standing sign be on the property? If so, show the location of the sign. A separate sign
permit will need to be submitted, however, you will need to show the location of the sign on the site plan.

31. [32.5.2(n) & (p)] The following will be required for final site plan approval:
- Outdoor lighting information including a photometric plan and location, description, and photograph or
diagram of each type of outdoor luminaire [Sec. 32.7.8 & Sec. 4.17] Final Rev 2: Comment addressed
- A landscape plan in accordance with [Sec. 32.7.9]. Final Rev 2: mitigation plan (8 -7 -14) is

32. [32.7.9] Landscaping. Sheet 6, plant schedule, AG — Amalanchier x Grandifora (Serviceberry) is depicted as
2.5" caliper; however, the approved plant canopy list utilizes height of 6 -7' at the time of planting to qualify
for the 130 SF canopy calcs. Revise appropriately. Final Rev 2: Comment addressed
33. [32.7.9] Landscaping. Sheet 6, plant schedule, CC - Cercis Canadensis (Redbud) is depicted as 2.5" caliper;
however, the approved plant canopy list utilizes height of 6 -7' at the time of planting to qualify the 124 SF
canopy calcs. Revise appropriately. Final Rev 2: Comment addressed
34. [32.7.9] Landscaping. Sheet 6, plant schedule, PY — Prunus Yedoensis (Yoshino Cherry) is depicted as 2.5"
caliper; however, the approved plant canopy list utilizes height of 6 -7' at the time of planting to qualify the
99 SF canopy calcs. Revise appropriately. Final Rev 2: Comment addressed
35. [32.7.9] Landscaping. There is a note provided on sheet 3, which states: "Existing 20' land use buffer see
sheet 10 for mitigation planting... "; however, there is not a sheet 10 associated with the final site plan.
Revise the note appropriately. Final Rev 2: Comment addressed
36. [32.7.9] Landscaping. Provide the approved mitigation plan's landscape sheet in the final site plan for the
gas station.
Final Rev 2. Page 9 shall be revised to match approvable landscaping of SDP2013 -35. Comments were
provided to the applicant on the mitigation plan 7 -24 -14 which call for substantial relocation of the
plantings due to retaining wall structural engineering required setbacks. Staff received the revised
mitigation plan on 8 -7 -14, the landscaping is approvable. Assure the landscaping plan is depicted on
the final site plan. Revise.
37. [32.7.9] Landscaping. If the required street landscaping is pushed outside of the planting strip and is to be
behind the sidewalk, landscape easements to contain these plantings shall be platted on the final subdivision
plat for the commercial lots. The easements and required street trees shall be shown on the final site plan, as
the street trees cannot be bonded on the road plan be they are out of the right of way.
Final Rev 2. The site plan shows the landscape easements but the final plat does not. Assure these
efforts are coordinated on all plans and plats. Notably, the final sub plat shall be recorded prior to the
final site plan approval.
38. [Sec. 32.7.8 & Sec. 4.17] Lighting. A lighting note appears on sheet 7, but it does not include the required
wording. Add the standard lighting note to the plan: "Each outdoor luminaire equipped with a lamp that
emits 3, 000 or more initial lumens shall be a full cutoff luminaire and shall be arranged or shielded to
reflect light away from adjoining residential districts and away from adjacent roads. The spillover of
lighting from luminaires onto public roads and property in residential or rural areas zoning districts shall
not exceed one halffootcandle. " Final Rev 2: Comment addressed.
39. [32.6] Grading. All grading for the site shall be provided on the final site plan. Currently the applicant relies
on the road plan to provide the required information; however, this is not sufficient. The information must
also be provided on the final site plan. Revise. Final Rev 2: Comment addressed.
40. [Comment] To avoid confusion the title of the plan should be revised to `Briarwood Gas Station — Final
Site Plan SDP201400047 ". Final Rev 2: Comment addressed.
41. [Comment] Throughout the plan directional arrows are provided throughout the drive aisles; however, the
arrows are backwards (have drivers driving on the left side of the aisle). This is very dangerous and may
cause substantial confusion for patrons of the gas station. Revise. Final Rev 2: Comment addressed.
NEW COMMENTS
42. [Comment] Sheet 5, in the Road Notes, Note: "Mandatory Inspection at the following phases are required

by an engineer to certify the construction of the roadway for final acceptance by Cumberland County. " If
the notes required it should be revised to reflect this project, in this County. Appears to be a typographical
error.
43. [Comment] Sheet 7, there is note at the top of the sheet: "See SDP2013 -35 for mitigation area... attached to
this final site plan, see sheet 8." The page reference appears to be a typographical error, and should be
revised. Currently sheet 9 is the mitigation plan. Revise.
44. [5.1.20] As discussed in the email dated July 16`h 2014 a Special Exception is required for the 100' setbacks
for underground storage tanks to property lines. Chapter 18 Section 5.1.20, Supplemental Regulations
5.1.20(b)J No storage tanks and loading facilities shall be located closer than one hundred (100) feet from
any lot line. ". The special exception request was received on 7 -28 -14 and is being processed. The Special
Exception is required prior to approval of the final site plan as currently designed.
45. [8.5.5.3] During the review of the final subdivision plat for the commercial lots (SUB2014 -120) it became
apparent that a variation would be required to the Briarwood PRD application plan (ZMA2005 -09). The
approved application plan does not depict a road in this location which goes through any portion of
Briarwood PRD (specifically the open space TMP 32G- 1B -2 -B). The Variation request was received on 8-
4-14 and is being processed. The Variation is required prior to approval of the final subdivision plat as
currently designed.

On September 19th we received copies of the revised final site plan to depict the new /modified retaining wall
designs and other minor items previously discussed. Staff sent this plan set out to three (3) reviewers: ARB,
Engineering, and Planning. I offer the following, which are also available in Countyview. Please assure the plan
is revised to address the remaining comments. Per discussions with Engineering if the plans are revised as
requested we don't need to re- review them, just assure they are provided on the signature copies. (If you want to
send PDF copies with the revisions for final review, we can take a quick look at them fairly quick). If you have
any questions, give me a call. I offer the following comments:
ARB — had no objections
Engineering provided the following comments which need to be addressed.
1. Provide additional detail with proposed revised retaining wall design (9/17/14): provide Wall 1 and 2 cross -
section view that shows Wall 1 and 2 relative to one another. —ref sheet 4 of 8, 7/18/14 M. Circeo design,
shown as panel, plan sheet 17, 8- Aug /27 -Aug -14 road plans.
2. Arrange revised retaining wall design as shown on prior plans, with requested item #1 appearing on sheet 17,
and with Wall 1 and 2 profiles appearing as side -by -side panels on sheet 18.
3. Geotechnical sheets 4, 5, and 7 show 4 -ft tall handrail at Wall 1 and 3. Geotechnical sheet 3 furnishes 2
details: handrail/fence post detail; sleeve -it fence post detail. Handrail detail is consistent with safety handrail.
Specify proposed location for sleeve -it fence post detail —if this detail is not required for safety handrail (Wall 1
and 3), please delete this detail. If two details are offered as equivalent options, select detail to be used;
eliminate detail not used.
4. Revise sheet 5 wall section views to show 4' handrail set behind wall, not in top course of block. Handrail
set in top course of block is consistent with Redi -rock wall system, not proposed system (Anchor diamond pro
unit).
Planning provided the following comment which needs to be addressed.
1. [32.5.2(a)] General information. On the cover sheet of the site plan assure that all waivers, variations, and
special exceptions are provided. Please add the following statements to the plan as they are all the items which
have been approved, some with conditions.
"Variation approved with this proiect at the July 29, 2014 Planning Commission meeting under
SUB2014 -120
1) Variation to the planting strip requirements, from six (6) feet to three (3) feet width and allow the planting
strip to be located on the back side of the sidewalk, in accordance with 14- 422(F) of the Subdivision Ordinance.
Approved with a condition "The required street trees will be provided behind the sidewalks in landscaping
easements to be recorded on a plat and depicted on the final site plan. "
Special Exceptions and Variation approved with this proiect at the September 3, 2014 BOS meeting
under SUB2014 -120 and SDP2014 -47
1) Buffer Zone Disturbance Waiver Section 21.7(c) — to disturb the 20 foot buffer zone adjacent to residential
districts to facilitate construction of Boulderview Road and Elm Tree Court. Portions of each street are to be
located within the 20 foot buffer, as well as grading and landscaping associated with a landscape mitigation plan
to remedy a site plan violation on the property. With a condition of approval that: "Landscaping shall be
installed as depicted on SDP2013 -35 Landscape Mitigation Plan which provides plantings between the
proposed road and Briarwood property line. "
2) Variation to Briarwood PRD application plan (ZMA2005 -09) — A variation to Briarwood's application
plan was approved to construct Elm Tree Court on a portion of open space associated with the Briarwood PRD.
With a condition of approval that: "Landscaping shall be installed as depicted on SDP2013 -35 Landscape
Mitigation Plan which provides plantings between the proposed road and Briarwood property line. "
3) Setbacks for Fuel Storage Tank Waiver Section 5.1.20(b) — to locate the gas station's underground storage
tanks and loading facilities closer than the required 100' from any property line provided they meet the
requirements of Section 5.1.20(a), which is a 3 foot setback."

18- 4.12.13.a. – "Loading spaces shall be provided on the same lot with the use to which it is appurtenant
and shall be adjacent to the structure it serves." Loading spaces are not adjacent to the gas station;

We have reviewed the final site plan for the Briarwood Gas Station dated 619114 as submitted by
Collins Engineering and offer the following comments:
1. The road plan for "Road A ", "Road B" and improvements to Briarwood Drive and Route
29 should be approved prior to approval of this site plan.
2. The impact of the outfall from the underground detention on the Route 29 drainage needs
to be evaluated and provided for review. Potential erosion and capacity impacts will
need to be provided.
3. Road "A" should be designed to VDOT standards per County requirements. As such, the
proposed entrances should be modified as described below:
a. The maximum width of each entrance should be 40'.
b. The minimum sight distance should be 280' as 25 mph is likely to be the posted
speed limit of Road "A" if it were a public road.

I have reviewed the resubmittal for the above - referenced application and I have the following comments:
1. Increase the height of shrubs for the stormwater facility located south of the gas station and for the outfall
area located north of Briarwood Drive to 24" minimum at planting. Increase the size of the London
Planetree north of Briarwood Drive to 3'/2" caliper minimum at planting.
2. The ARB considered the canopy /glare issue at its June 23, 2014 meeing. Regarding the color for the
underside of the canopy, provide photographs showing the difference between the plain and textured
surfaces, confirming that the textured surface reduces glare. Or, install the canopy underside material
marked ".032 white aluminum embossed" as the exposed face.
3. A lighting note appears on the plan, but it does not include all the required wording. Add the standard
lighting note to the plan: "Each outdoor luminaire equipped with a lamp that emits 3,000 or more initial
lumens shall be a full cutoff luminaire and shall be arranged or shielded to reflect light away from
adjoining residential districts and away from adjacent roads. The spillover of lighting from luminaires onto
public roads and property in residential or rural areas zoning districts shall not exceed one half
footcandle."
4. Provide additional information on the plan to show how the upper retaining wall will accommodate the
planting of trees close -by. Indicate if geogrid reinforcement will be used for that wall. If it will be used,
show on the plan how far the geo -grid will extend beyond the wall.
5. Comment #11 from our May 19, 2014 letter stated that interior parking lot trees should be revised to a
large species, 2' /z" caliper at planting. The 2'/Z" caliper change has been made; however, the change to a
large species has not. It is recommended that the serviceberry and redbud at the interior of the parking lot
be replaced with a large tree species. It may be expensive and /or difficult to find serviceberry and redbud
at that size.
6. The ARB considered the retaining wall block at its June 23, 2014 meeting. The RediRock Ledgestone will
be appropriate if the landscaping is increased to sufficiently minimize the effect of the monotone white
color. This can be accomplished with plant size, spacing and species.
7. The version of the mitigation area landscape plan included in this submittal reverts to a much earlier layout
that staff commented on in July, 2013. Staff's comments were addressed in the plan that the ARB
reviewed in January 2014. Provide for review a detailed landscaping plan for the mitigation area (with
plant schedule and plants identified) based on the plant layout reviewed by the ARB in January, 2014, not
the earlier version.
Please provide:
1. One set of revised drawings addressing each of these conditions. Include updated ARB revision dates on
each drawing.
2. A memo including detailed responses indicating how each condition has been satisfied. If changes other
than those requested have been made, identify those changes in the memo also. Highlighting the changes in
the drawing with "clouding" or by other means will facilitate review and approval.
3. The attached "Revised Application Submittal" form. This form must be returned with your revisions to
ensure proper tracking and distribution.
When staff s review of this information indicates that all conditions of approval have been met, a Certificate of
Appropriateness may be issued.

Conditions of Initial Plan Approval (from approval letter dated 6/4/14):
1. [32.6] A site plan meeting all the requirements of section 32.6 of Chapter 18 of the Code.

2. [32.5.3(a)] This application was reviewed against Site Development Plan requirements only. Any
subdivision related comments are provided for reference only unless necessary for final site plan approval.
Prior to final site plan approval the final subdivision plat and road plan serving the commercial lots shall be
approved by the County, and the plat recorded in the Clerk's Office. The deed book page information of the
recorded plat shall be provided on the final site plan.

3. [32.5.2(n) & (i)] As proposed a portion of the private road is taking place on the adjacent residential parcel
zoned PRD, specifically within the 30' vegetative buffer on the residential parcel and within the area of the
20' undisturbed buffer between the residential and commercial zonings. As you know the property owner
was sited for violations of the above two areas by the Zoning Department for unauthorized disturbance of
these areas. The applicant is currently working to remedy the site plan violation of the 30' vegetative buffer
through a mitigation plan (SDP2013 -35). Prior to final site plan approval the mitigation plan must be
approved by the County, to include ARB, Planning Staff, and Zoning staff.

Also, the applicant is attempting to remedy the disturbance of the 20' undisturbed buffer through a special
exception as described in Section 213(c). The applicant intends to utilize the mitigation plan described
above as an exhibit to take to the Board of Supervisors for review /approval. Prior to the special exception
going to the Board of Supervisors the proposed plantings in the mitigation plan must be approved by ARB,
Planning staff, and Zoning staff. Prior to final site plan approval the applicant shall receive approval of the
mitigation plan, and receive the Board of Supervisors approval of the special exception. If all the above have
been satisfied then the plantings shall be provided on the final site plan's landscaping plan.

approvals. Notably the road as currently depicted relies heavily on retaining walls, staff is apprehensive
about the applicant providing the required plantings as described above on these retaining walls.

plantings weight and that the plantings root systems will not jeopardize the integrity of the walls.

I have reviewed the resubmittal for the above - referenced application and I have the following comments:
1. Increase the height of shrubs for the stormwater facility located south of the gas station and for the outfall
area located north of Briarwood Drive to 24" minimum at planting. Increase the size of the London
Planetree north of Briarwood Drive to 3'/2" caliper minimum at planting.
2. The ARB considered the canopy /glare issue at its June 23, 2014 meeing. Regarding the color for the
underside of the canopy, provide photographs showing the difference between the plain and textured
surfaces, confirming that the textured surface reduces glare. Or, install the canopy underside material
marked ".032 white aluminum embossed" as the exposed face.
3. A lighting note appears on the plan, but it does not include all the required wording. Add the standard
lighting note to the plan: "Each outdoor luminaire equipped with a lamp that emits 3,000 or more initial
lumens shall be a full cutoff luminaire and shall be arranged or shielded to reflect light away from
adjoining residential districts and away from adjacent roads. The spillover of lighting from luminaires onto
public roads and property in residential or rural areas zoning districts shall not exceed one half
footcandle."
4. Provide additional information on the plan to show how the upper retaining wall will accommodate the
planting of trees close -by. Indicate if geogrid reinforcement will be used for that wall. If it will be used,
show on the plan how far the geo -grid will extend beyond the wall.
5. Comment #11 from our May 19, 2014 letter stated that interior parking lot trees should be revised to a
large species, 2'/2" caliper at planting. The 2' /z" caliper change has been made; however, the change to a
large species has not. It is recommended that the serviceberry and redbud at the interior of the parking lot
be replaced with a large tree species. It may be expensive and /or difficult to find serviceberry and redbud
at that size.
6. The ARB considered the retaining wall block at its June 23, 2014 meeting. The RediRock Ledgestone will
be appropriate if the landscaping is increased to sufficiently minimize the effect of the monotone white
color. This can be accomplished with plant size, spacing and species.
7. The version of the mitigation area landscape plan included in this submittal reverts to a much earlier layout
that staff commented on in July, 2013. Staff s comments were addressed in the plan that the ARB
reviewed in January 2014. Provide for review a detailed landscaping plan for the mitigation area (with___
plant schedule and plants identified) based on the plant layout reviewed by the ARB in January, 2014, not
the earlier version.
Please provide:
1. One set of revised drawings addressing each of these conditions. Include updated ARB revision dates on
each drawing.
2. A memo including detailed responses indicating how each condition has been satisfied. If changes other
than those requested have been made, identify those changes in the memo also. Highlighting the changes in
the drawing with "clouding" or by other means will facilitate review and approval.
3. The attached "Revised Application Submittal' form. This form must be returned with your revisions to
ensure proper tracking and distribution.
