Subject: SUB201400144 Porters Rd. and Dawson Mill Rd — Final
The Planner will recommend approval of the plat referred to above when the following items have been satisfactorily
addressed. (The following comments are those that have been identified at this time. Additional comments or conditions
may be added or eliminated based on further review.)
1. [Section 14- 302(A)(4)] Private Easements. Please add the dimensions, name of the owner of record and the deed
book and page number for the access easement currently shown as "DB XX PG XX."
2. [Section 14- 302(B)(6)] Reservoir watershed; agricultural forestal district. Please add a note to indicate this property
does lie in a water supply protection area. Specifically, it lies in the "Totier Creek Reservoir Water Supply
watershed."
3. [Section 14 -309 and 14 -310] Health Director Approval. I emailed Travis Davis at the Health Department to confirm
whether or not the 2008 approval is still valid based on the new plat. Health Department approval is required before
we can sign the plat.
4. [Section 14 -316] Approval of entrance onto public streets. I emailed Dennis Seale and Troy Austin at VDOT to
request approval of the entrance location for the proposed private street. VDOT approval is required before we can
sign the plat.
5. [Section 14 -3171 Instrument evidencing maintenance of certain improvements. Please submit a private street
maintenance agreement for review by the County Attorney's office.
6. [Section 14- 412(A)(1)] Standards for private streets only. There is a 25 foot front setback from the proposed private
street that applies to the structure addressed 7898 Porters Road (shown on the map below). It appears the corner of
this structure is less than 25 feet from the proposed private street. However, the required minimum travelway width
of the private street is only 10 feet. Please reduce the width of the proposed private street along this section as
necessary to meet the 25 foot setback and label the distances on Sheet 2 to confirm this required setback can be met.
Staff has provided references to provisions of Chapter 14 of the Albemarle County Code. The Code is kept up to date by the
County Attorney's office and can be accessed through their department's website at www.albemarle.oriz.
