County Code section 17 -410 and Virginia Code §62.1- 44.15:34 require the VSMP authority to act on any VSMP
permit by issuing a project approval or denial. This project is denied. The rationale is given in the comments below.
The application may be resubmitted for approval if all of the items below are satisfactorily addressed. The VSMP
application content requirements can be found in County Code section 17 -401.
A. Stormwater Pollution Prevention Plan (SWPPP)
The SWPPP content requirements can be found in County Code section 17 -405. A SWPPP must contain (1) a PPP,
(2) an ESCP, (3) a SWMP, and (4) any TMDL measures necessary.
1. SWPPP, dated September 2014, requires revision:
a. Title pg. —Ref WP0201400084
b. Rev. TOC to include specific reference to PPP (p. 8) —Also, g., below.
c. Pg. 3 — bullet 11 inconsistent with p. 7 Stormwater Runoff Consideration narrative.
Please reconcile.
d. Pg 3 — bullet 9: "Permanent rip -rap will be placed for stream and bank stabilization."
Show on plans if riprap furnished. Delete bullet, if not.
e. Pg. 5 -2nd bullet — Furnish dewatering detail on plans; select from VDOT list of approved
systems [image, last pg.].
f. Pg. 6 —Soil Characteristics table — include column for hydrologic soil group —ref attached.
Nearly all site soils are hydrologic soil group `D' —rev. VaRRM - Section C, item #1.
g. Pg. 8 — Include reference to Pollution Prevention Plan (subheading subtitle, for example).
h. Pg. 9 —Text box lists items required to be shown schematically (plan view) on 11" x 17"
reduced plan sheets. Show proposed location of on -site sanitary facilities, dumpsters,
vehicle wash and concrete truck washout, etc. Also, see section 6 of County SWPPP
template for list of features required with SWPPP. These features do not need to be
shown on ESCP /SWMPs, just an 11" x 17" SWPPP insert.

j. Pg. 10 —Top of page: Revise reference to removing ESC to include approval of County
inspector.
k. Page 10 —Temp Structural Practices reference PCE: Revise ESCP to include PCE labels.
1. Page 12 —Copy HUC/Receiving waters data to WPO Plan cover sheet.
m. Page 12 —Show stockpiles on ESCP.
n. Page 12 — "GutterBuddy" inlet protection appears a mismatch with dewatering activities.
2. Replace term contractor with operator to reference General VPDES Permit holder. Although a
contractor may apply directly for VPDES permit coverage for this project by completing a General

VPDES permit registration form, in this instance, ACSA (Owner) has registered as VPDES
operator. VPDES permit will be issued to ACSA (Operator). Permit may be transferred. It is
improper to reference an unnamed contractor in the SWPPP, unless contractor is VPDES operator.
SWPPP and VGP duties attach to the permit operator as a matter of law and administration.
3. Include plan sheets (VAR10, Part II.A. l .e). -Also, sections 4, 5, 6 of COUNTY OF ALBEMARLE
SWPPP TEMPLATE -link: http:// www.albemarle.orWdepartment.asp ?department =cdd
4. Amend p. 8 subsection title to make clear that SWPPP contains Pollution Prevention Plan elements
(PPP). -Also, section 6 of County SWPPP template. Please call to discuss if any questions.
5. Furnish revised/signed SWPPP certification statement to read exactly as found at VAR10 Part
III.K.4. (Jeremy Lynn signature required.)
6. Include copy of VAR10 (download from VDEQ website; attach 22 -p .pdf to SWPPP).
7. Revise /delete reference to unrelated project, for example: "...installation of the new gravity sewer"
(p. 5); "and be captured in the existing storm drain system" (p. 11); and "to existing catch basin to
the south of project and discharge to an onsite creek" (p. 11).
8. Page 12 -Identify qualified individual (RLD). Ref. VAR10 Part II.F.1. -Also, sec. 8 of County
SWPPP template.
9. Page 13 - TRANSFER AGREEMENT -If this statement is included, print conditions exactly as found at
VAR10 Part III.Y.2.
10. Maintenance of SWPPP - Delete reference to "someone empowered to implement modifications to
this SWPPP," since qualified individuals must be named in SWPPP. Identification cannot be left
indeterminate. For now, the qualified individual appears to be Jeremy Lynn, ACSA.
11. Maintenance of SWPPP - Identify contractor, or replace Contractor with VPDES Operator. -see
2, above; Also, VAR 10, Part II.B.3.
12. Awareness -p. 15 - furnish specifics. VAR10 Part 11.4.f: "Describe procedures for providing
pollution prevention awareness..."
13. Specify plan for making SWPPP pubicly accessible -ref. VAR10 Part II.D.3.
B. Pollution Prevention Plan) - Addressed under Stormwater Pollution Prevention Plan, above.
The PPP content requirements can be found in County Code section 17 -404.
C. Stormwater Management Plan (WP0201400084)
VSMP Regulation 9VAC25- 870 -108 requires the VSMP authority to approve or disapprove a SWMP. This plan is
disapproved, and the reasons are provided in the comments below. The stormwater management plan content
requirements can be found in County Code section 17 -403.
1. VaRRM does not consider loss of forest due to linear utility, or provide treatment for 1.57 acre area of
disturbance. VaRRM includes 0.33 Ac. turf, 0.10 Ac. impervious; .xls assigns these to soil group B. Please
revise VaRRM (and SWM design) to address 1.57 acre area. Assign areas to soil group D, as appropriate.
2. Identify total area disturbed - should match 1.57 acre area on General VPDES Permit registration statement.
3. Sheet 18 -Show full length of bioretention facility outfall pipe, or dimension its length.
4. Sheet 18 -Ref. VA DEQ Stormwater Design Specification No. 9, Level 1: 6.4 - Pretreatment required.
Furnish pretreatment, per design table (grass Swale conveyance, to bioretention facility).
5. Sheet 18 -Plant and Composition schedule: ref. design table (item #4, above). Furnish note or details to
assure vegetation achieves at least 75% surface area coverage within 2 years. Link:

6. Sheet 18 - Dimension bioretention facility cross - sections (L x W).
7. Sheet 18 - Bioretention facility longitudinal cross - section appears to call for P pea gravel layer, V stone
layer, while bioretention basin data, sheet 19, references 1' total stone depth; reconcile data/x- section.
8. Sheet 18 - Delineate 18,731 SF area draining to SWM facility -show boundaries.
9. Minor, sheet 19 - Correct Rv value in equation to read 0.37 (formula/calc are correct).
10. Minor, title pg. - Include WP0201400084.

12. If proposed limits of clearing = proposed limits of disturbance, furnish notes /labels to this effect.
13. Demonstrate compliance with MS -19 —ref 9VAC25- 870 -66.
14. If, considering effects of forest clearing (conversion of forest to permanently cleared utility easement), on-
site water quality compliance proves untenable, off -site nutrient credit options exist: ref 9VAC25- 870 -69
(link: hgps: / /Iegi.state.va.us /cgi- bin /legp5O4.exe ?000 +reg +9VAC25- 870 -69 ). Less than five acres of land will be
disturbed. The post - construction phosphorus control requirement is less than 10 pounds per year. Also:
§66.1- 44.15.35 (link: htWs:Hlegl. state .va.us /cgi- bin/legp504.exe ?000 +cod +62.1- 44.15C35 ). —Also, #1, above.
D. Erosion and Sediment Control Plan (ESCP - WP0201400084)
Virginia Code §62.1- 44.15:55 requires the VESCP authority to approve or disapprove an ESCP. This plan is
disapproved, and the reasons are provided in the comments below. The erosion control plan content
requirements can be found in County Code section 17 -402.
1. Sheet 14 — Revise ESC legend to include TS, DC, MU —Ref. Mgmt Strategies, #3, Sheet 16; also, SWPPP.
2. Sheet 14 —Label construction entrances (CE) paved construction entrances (PCE). —Also SWPPP, p. 10.
3. Sheet 14 —Show vehicle wash waters draining to settling basin. —Also, sec. 6 /table, of County SWPPP
template, and item # 14, below.
4. Sheet 14 —Show stockpile location (initial location; location may change).
5. Sheet 14 —Show staging area (initial location; location may change).
6. Sheet 14 — Show /label LOD. Provide LOD acreage.
7. Sheet 14 —Label contours.
8. Sheet 14 — Indicate flow lines.
9. Sheet 14 —Label managed slopes.
10. Sheet 14 — Delineate area draining to bioretention facility.
11. Sheet 14 —Label stream. Label intermittent, if intermittent.
12. Sheet 16 — Management Strategies — revise text, consistent with General VPDES Permit Operator
responsibilities. Delete or revise reference to Job Superintendent, unless this individual is named, with
qualifications listed in SWPPP —ref. Sec. A, above.
13. Sheet 16 — Structural Practices, re£ paved construction entrances /s.
14. Sheet 16 — Structural Practices states that "Wash water must be carried away from the entrance to an
approved settling area to remove sediment." Show approved settling areas on sheet 14.
15. Sheet 16 — Sediment Control Program, Phase 1 —Note #2 (Clear the site to no more than the limits shown on
the construction plans) conflicts with Note 1 on sheets 7, 8, 9, 10, and 11: "Contractor shall clear and grub
the areas coincide with limits of permanent easements and /or public right -of -way or as designated on the
drawings and portions of temporary easements as deemed necessary for the construction at no additional
cost to the owner." This note is misleading; it would allow clearing that exceeds LOD reported elsewhere.
Revise or delete Note 1, plan sheets 7 -11.
The VSMP permit application and all plans may be resubmitted for approval when all comments have been satisfactorily
addressed. For re- submittals please provide 2 copies of the complete permit package with a completed application form.
Engineering plan review staff is available from 2 -4 PM on Thursdays, should you require a meeting to discuss this review.
Process:
After approval, plans will need to be bonded. The bonding process is begun by submitting a bond estimate request
form and fee to the Department of Community Development. One of the plan reviewers will prepare estimates and
check parcel and easement information based on the approved plans. The County's Management Analyst will
prepare bond agreement forms, which will need to be completed by the owner and submitted along with cash,

certificates or sureties for the amounts specified. The agreements will need to be approved and signed by the County
Attorney and County Engineer. This may take 2 -4 weeks to obtain all the correct signatures and forms.
Stormwater Management Facilities Maintenance agreements will also need to be completed and recorded. The
County's Management Analyst or other staff will prepare the forms and check for ownership and signature
information. The completed forms will need to be submitted along with court recording fees.
After bonding and agreements are complete, county staff will need to enter project information in a DEQ database
for state application processing. DEQ will review the application information based on local VSMP authority
approval. At this time, the DEQ portion of the application fees will need to be paid directly to the state. For fastest
processing, this is done electronically with the emails provided on the application. DEQ should notify applicants
with instructions on how to pay fees. When DEQ approves the application, they will issue a permit coverage letter.
This should be copied to the county.
After DEQ coverage is issued, via the coverage letter, the County can hold a pre - construction conference. Applicants
will need to complete the request for a pre - construction conference form, and pay the remainder of the application
fee. The form identifies the contractor and responsible land disturber, and the fee remaining to be paid. This will be
checked by county staff, and upon approval, a pre - construction conference will be scheduled with the County
inspector. At the pre - construction conference, should everything proceed satisfactorily, a joint VSMP and grading
permit will be issued by the County so that work may begin.
