Dear Mr. Collins:
Pursuant to Albemarle County Code § 14- 222(D) and (E), the above referenced preliminary subdivision
plat has been disapproved. The specific reasons for disapproval are provided with references to specific
duly adopted ordinances, regulations or policies. Required modifications or corrections that will permit
approval of the preliminary subdivision plat are included as well.
The reasons for disapproval are as follows:
1. Preliminary Plat Deficiency: Albemarle County Code §14- 203(1) requires fees to be paid for
notices to abutting property owners with the preliminary plat. In order to comply with this
requirement, pay the outstanding balance of $214.90 for notice requirements.
Preliminary Plat Deficiency: Albemarle County Code §14- 302(A)(8) requires the approximate
dimensions of each proposed lot be labeled. In order to comply with this requirement, label
the dimensions of all proposed lots. Please note, lots in the Rural Area portion of the
development must have a minimum of 100 feet of frontage and a minimum of 100 feet of
lot width. The minimum lot width of 100 feet shall be maintained between the front and
rear yards.
Preliminary Plat Deficiency: Albemarle County Code §14 -409 requires that all public streets
within a subdivision shall be coordinated as to location, width, grades and drainage with
other public streets, as follows: (i) by coordinating with existing or planned streets within
the general area of the subdivision, including but not limited to existing or future adjacent
subdivisions, or subdivisions contiguous to such adjacent subdivisions; and (ii) by continuing
the public streets to planned, existing, or platted streets into adjoining areas by dedication
or reservation of right of way adequate to accommodate continuation of the streets. In
order to comply with this requirement, coordinate and extend proposed Galena Street to
Hatcher Court and extend Hallam Street to the property line adjacent to Redfields Road. A
request for a variation or exception to the coordination or extension requirements can be
submitted with the preliminary plat in accordance with sections 14- 203.1(A) or 14- 203.1(B).
The public streets within this subdivision must also satisfy Virginia Department of
Transportation Secondary Street Acceptance Requirements for multiple connections in
multiple directions. VDOT provided the following comment (attached): The multiple
connections in multiple directions standard to satisfy SSAR requirements has not been met
with this submittal. Providing a strip of right -of -way does not satisfy the requirement,
especially when the proposed interconnection would be better served on a more direct
route to minimize the length of travel through the adjoining neighborhood.
Within fifteen (15) days after the date this notice of disapproval is provided to the applicant, the
subdivider may resubmit the preliminary plat, as provided by Albemarle County Code §14- 222(E).
If a revised plat is not received within 15 days, the plat shall be deemed to be disapproved and a new
application and fee shall be required for submittal of the plat. In accord with Albemarle County Code
§14 -223, this decision may be appealed. The appeal shall be in writing and be filed with the agent within
ten (10) days after the date of the decision by the agent
