STAFF CONTACT(S): Cilimberg, Benish, Grant LEGAL REVIEW: NO AGENDA DATE: July 11, 2012 ACTION: X INFORMATION: CONSENT AGENDA: ACTION: INFORMATION: ATTACHMENTS: YES BACKGROUND: On June 19, 2012, the Planning Commission held a public hearing for the Community Christian Academy special use permit request. The Commission, by a vote of 5:0, recommended approval of the special use permit with conditions as recommended by staff, and as amended. (See Action Letter) DISCUSSION: Classes at the school begin at 8:15 a.m. and end at 3:00 p.m. However, there is an extended day program which allows children to be dropped off at the school as early as 7:40 a.m. and picked up by 6:00 p.m. Condition 4 is revised to include the hours of the extended day program. Also, when the Planning Commission staff report was written, the site was not in compliance with the landscaping shown on the approved site plan, dated 4- 14 -87. During the Planning Commission public hearing the applicant explained that the outstanding landscape issues have been addressed. Staff has confirmed this; therefore, condition 1 is now revised to eliminate landscaping as a major element on the site plan. RECOMMENDATION: Approval of Special Use Permit 201200004 with the following revised conditions: 1. The existing building and use shall be in general accord with the site plan titled Alliance Bible Church "Community Christian Academy" prepared by Roudabush, Greene, & Gale and date approved 4 -14 -87 (hereafter "Site Plan "), as determined by the Director of Planning and the Zoning Administrator. To be in accord with the Site Plan, the existing building and use shall reflect the following major elements within the site essential to the design of the site, as shown on the Site Plan: Location of buildings, uses, and structures Location of parking areas Location of outdoor play area Relation of buildings and parking to the street; and Site access Minor modifications to the plan which do no conflict with the elements above may be made to ensure compliance with the Zoning Ordinance. 2. Maximum enrollment shall be 85 children. 3. All students shall be over the age of 2'/2 years old. 4. Hours of operation for the school shall be between 7:40 a.m. to 6:00 p.m., except that occasional school - related events may occur after 6:00 p.m. ATTACHMENTS: Attachment I: Planning Commission staff report, dated June 19, 2012 SP 201200004 BOS Julyl1, 2012 Executive Summary Page
