HomeMy WebLinkAboutSDP201100025 Legacy Document 2012-06-28WO I To Albemarle County Community Development: RE: section 4.2.5 Modification or waiver: We are requesting consideration of a waiver of Section 4.2.5. (a) (3) of the Albemarle County code for the following reason: we want to build a 2 "d dwelling on our property at 4692 Browns Gap Turnpike, Crozet, VA 22932 and the existing buffer zone is too wide. 4.2.5.a.3 Findings: a. Strict application of the requirements of section 4.2 would not forward the purposes of this chapter or otherwise serve the public health, safety or welfare; Allowing the waiving of the buffer zone on the west side of the road running through our property (Browns Gap Turnpike) would give us the requisite 30,000 sq footage building site we need to build a 2 "d home on the flat south end of our property. The waiver would allow us to comply with section 4.2.2.a.1. The waiver would enlarge the existing available sq footage for building on our total property from 51,581 sq ft to 80,160 sq ft. See accompanying GIS pages #1, #2 and 3, surveyed and prepared by Archie J. Dodson, Jr., for the difference in the square footage with and without the west side of the buffer zone. I have penciled in the proposed location of the dwelling. b. Alternatives proposed by the developer or subdivider would satisfy the intent and purposes of section 4.2 to at least an equivalent degree; This requested realignment of the buffer line would allow adequate sq footage for the septic system for the proposed building site allowing us the full use of the flat area of our property and thus would not "unreasonably restrict the use of the property." The total of usable land, 80,160 sq ft— see GIS #3, would allow for each house (the existing one and the proposed one) to contain the required 30,000 sq feet per building site. The road itself would continue to be the western edge of the buffer zone preventing any possible interaction with Doyle's River. In the 26 years we have lived on this property the river has never reached the height of the roadbed. Due to the property's unusual size, topography, shape, location or other unusual conditions, excluding the proprietary interest of the developer or subdivider, prohibiting the disturbance of critical slopes would effectively prohibit or unreasonably restrict the use of ATTACHMENT A the property or would result in significant degradation of the property or adjacent properties; The proposed building site does not disturb the slope. d. Granting the modification or waiver would serve a public purpose of greater import than would be served by strict application of the regulations sought to be modified or waived. We have lived on this property since 1985. We feel that a grant of a waiver would have a major impact on our quality of life as we age and continue to live in our home. "A public purpose of greater import" to us means the continuation of our commitment to family and our strong desire to continue to live in rural Albemarle County. It has long been our intention to build another house on the southern end of the property to allow one of our children to live near us. However due to a devastating fire (2000) and the necessary rebuilding of our original house we had to put our plans for a second house on hold until this year. Now eleven years later it is even more important to us to build a house where our grown son and his family can live near us.
