Regarding: SP- 201.0 -038 Badger Industrial Building
Dear Mr. Custer,
The proposed development of the Badger Industrial Building site, specifically being the
grading shown on the application plan, shows disturbance of slopes greater than 25%. In
according with Albemarle County Code, chapter 18 -42 I am requesting a waiver to allow
disturbance of those slopes as shown on the application plan.
The slopes in question are entirely man -made slopes created by the construction of the
existing industrial building site and the storm sewer system which routes water from
Route 29 to a manmade channel flowing through the back of the site. The channel has
been labeled an intermittent stream, and we have been notified by the Army Corp that
fill of that channel is allowed. A copy of the original plan for the building has been
included for your reference.
The proposed development is simply the extension of the parking area behind the
building further out into the undeveloped wooded areas. The purpose of this work is to
improve and enhance an industrial development area for the purpose of expanding its use
and providing a location for additional sources of employment within Albemarle County.
The primary concerns with development on critical slopes are addressed as follows:
Rapid or Large Scale Movements of Rock and Soil: The extension of the fill area will be at
a lower level than the current pad elevation. This approach creates a step down in the fill
and will lower the height of the fill slope relative to the flat land below. Construction will
consist of compacted fill and erosion control measures shall be installed in accordance
With the water protection ordinance to prevent large scale erosion.
Excessive Storm. Water Runoff: The proposed construction will have water quality
measures and new or upgraded adequate channels from the new development to the river.
Both the water quality treatment and improved channels represent an improvement to
the current conditions at the site. These measures will protect against any increases in
runoff.
Siltation of Natural or Man Made Bodies of Water: As outlined above, all development
shall be subject to the current standards of the County Water Protection Ordinance and
erosion and sediment control measures shall be installed to prevent siltation of water
bodies.
Loss of Aesthetic Resource: This proposal is simply to take out existing trees on an
industrial parcel and to push the slope back into the vacant land. There is no loss of
aesthetic resource from either the disturbance of the critical slopes or disturbance of the
flood plain.
As this development is served by public sewer, there are no concerns related to sewer
effluent.
In summary, the reasons for the request are to allow disturbance of manmade slopes of
25 % or greater for the purposes of making a current industrial site a more productive site
and to efficiently use land within the growth area for the purposes of promoting
additional business and employment within the county.
