County of Albemarle Department of Community Development Memorandum To: Claudette Grant, Senior Planner From: Francis MacCall, Senior Planner Division: Zoning Date: September 30, 2011 Subject: ZMA 2011 -006 & SP 2011 -14 Albemarle Health & Rehab Center — 2nd Round Please consider the following comments: In the request for the parking waiver the applicant states that the use is a combination of both nursing home and a congregate care facility. This should be OK as long as the congregate care use meets the requirements zoning has determined for congregate care which are as follows: Congregate care definition: A residential facility for persons who are elderly or of impaired functional ability. Such facilities are characterized by a variety of elements that include common dining, social and recreational features, special safety and convenience features designed for the needs of the elderly, such as emergency call systems, grab bars and handrails, special door hardware, cabinets, appliances, passageways, and doors designed to accommodate wheelchairs. A congregate care facility must provide on an appropriate, regular basis at least two of the following to qualify for the parking standard: meal services, transportation, housekeeping or organized social activities. Facilities that meet this definition shall be required to meet the following parking standard: Congregate care unit with no separate bedroom or one bedroom: Three fourths (3/4) spaces per unit plus one (1) space per employee on the major shift. Congregate care unit with two or more bedrooms: One and one - quarter (1 1/4) spaces per unit plus one (1) space per employee on the major shift. If this is truly the use the combination of the 2 parking calculations is OK and if that is the case then a waiver for the increase in the 20% allowed over the standard should not be needed. Please recalculate and make sure that it is represented properly on any final plan submitted to the PC and BOS. They can run the numbers by us at anytime. 2. Zoning will leave the appropriateness of the other three waivers to the Planning review. If you have specific questions to these requests then I will assist where I can. Attachment J
